目前,我国行政诉讼受案范围过于狭窄,出于保护行政相对人合法权益及中国加入世界贸易组织的要求,扩大行政诉讼受案范围势在必行。当然,行政诉讼受案范围的扩大并非是无限的,应处理好行政权与司法权以及与行政相对人权利之间的关系。可从扩大具体行政行为的审查标准、将抽象行政行为纳入行政诉讼受案范围、建立行政公益诉讼以及扩大行政诉讼法的权利保护范围四方面做起。 相似文献

“法院主导地位说”长期统治民事诉讼法学界并根植于人们的观念中。而笔者以为,诉讼机制的现代化需要诉讼程序与制度设计的科学化和正当化,而这与诉讼观念与诉讼主体地位观念的现代化不无密切关联。基于此,本文提出并论证了民事诉讼中的法院与当事人诉讼主体地位平等性问题,旨在唤起人们在当今的社会情势下对民事诉讼中法院与当事人的关系重新予以审视,并意图动摇已在人们意念中根深蒂固的“法院主导地位说”。 相似文献

In the run-up to the elections of 18 September 2016, suggestions were made that a change in the rules for electing the State Duma (a return to a mixed majority-proportional system) would affect the qualitative composition of the deputy corps.1 Today, a year since the Duma campaign, we already have sufficient information to move from hypothetical arguments to a specific study not only of the composition, but also the style of work of the new parliament.Existing data allow us to say that two different tendencies exist in the Duma. One of them is connected with the change in the composition of the deputy corps, caused by the addition of a majority component, which has influenced the principles of selecting candidates, and by a number of other causes—from the assumption of a low turn-out to the emergence of new bans and restrictions in legislation. Another involves the change in style of work of the lower chamber of the Federal Assembly. Besides efforts directly toward reducing scandalous behavior and overcoming the reputation of a “maniacal printer,” this concerns attempts by the leadership of the Duma in general and individual parliamentary groups to regulate and centralize the lawmaking process as much as possible. If the first tendency involves increasing political independence of deputies (as a consequence of the increase of the importance of their personal qualities at elections), the second means an even greater reduction of their influence on decisions taken by the Duma. 意思表示解释对当事人真意的探寻实际上需要通过语义的探究来实现。语用学以语言哲学对意义的思考为滥觞,为意思表示的解释提供了新的视野和方法。依照解释学理论建构的意思表示解释规则,在一定程度上与语用学的意义探究方法相契合,但同时也表现出零散、不系统和立场游移的特点。因而,意思表示解释规则的建构应综合解释学的"解释者—文本"与语用学的"言语—言说者"双重视角,为解释者提供更具操作性的规则。 相似文献

We examine the role of a norm protecting women in understanding third‐party partisanship in verbal and violent disputes. Our analyses are based on reports provided by male inmates and men they know who have never been arrested. The results show that third parties are more likely to support female adversaries than male adversaries. The gender effect is stronger when we control for the relational distance between adversaries, which indicates that a privacy norm might inhibit this normative protection. The gender effect is somewhat weaker when we control for the relative physical size of the adversaries, which indicates that a general norm protecting vulnerable people partly explains the gender effect. The strong gender effect that remains, however, demonstrates the importance of the normative protection of women, regardless of relative size, during disputes. The results have implications for research on situational factors in violence and violence against women. 相似文献

Parliamentary party group leaders (PPG leaders) are crucial – yet understudied – actors in modern representative democracies. Inspired by the literature on parliamentary roles, we test a deductive approach in order to explore the attitudes and behaviours of PPG leaders. Given their common duties, such as monitoring group members and securing party cohesion, we expect that PPG leaders across several countries would exhibit a common pattern that distinguishes them from other MPs. However, neither a common, nor a distinguished pattern of attitudes and behaviour is confirmed by our results based on Partirep MP Survey data. This, together with other theoretical difficulties, points us to the need to study PPG leaders’ roles by using in-depth single-country studies. 相似文献
