In this paper some studies with respect to empirical socio-economic research which has been undertaken in Belgium and the Netherlands concerning the functioning of legal rules and institutions are discussed. The paper focuses on the domains of criminal law, civil procedure, liability and insurance. The paper argues that contrary to the overwhelming economic literature on liability and insurance, the empirical results in that domain are poor. More research is undertaken in the area of criminal law and apparently it is overwhelming in the area of civil procedure. The latter studies are, however, mainly undertaken by socio-legal scholars and less by economists. The general conclusion of the empirical studies discussed seems to be that while the empirical literature on the effect of changes in the decision making environment on rational actions in the legal system is rich and provocative, there is much less empirical testing of the effects of legal rules as such on allocational outcomes. This article provides an overview of the measures and actions taken by the Member States of the European Union in their fight against organised crime and transborder crime. The Action Plan to Combat Organized Crime adopted by the Ministers for Justice and Home Affairs during the Dutch EU Presidency, submitted some 30 recommendations with respect to greater harmonisation regarding the fight against organised crime in the EU Member States. The author gives a concise summary of the most relevant changes and the structural characteristics per Member State, paying attention to developments in the specific countries and the organisations involved. One of the conclusions reached is that few or no reforms within national investigative and prosecution authorities may be directly traced back to the regulatory impulses of the EU. Although the EU Action Plan has not yet realised a convergence of the systems, the European process of integration has increased the mutual transparency and knowledge of one another's systems. 相似文献

The purpose of this research note is to share and discuss my experience of interviewing a first generation migrant Indian man. The note demonstrates how an amalgamation of English language proficiency and assumed social class, educational status, and gender effected the power relations in an interview, and thus the data collected. It suggests how the power relation brought into play due to differences in English language proficiency between the participant and the researcher/interviewer can be reduced, if not eliminated. 相似文献

Nearly 15 years after embarking on its large‐scale decentralisation programme, Indonesia has decided to extend its efforts to the village level. Decentralising to villages is intended to improve service delivery performance at the lowest administrative tier and reduce social inequality and poverty. A number of potential difficulties with the design of Indonesia's nascent village decentralisation initiative have already become apparent. Methods used to allocate funds to villages are particularly problematic. Oddly, fund distribution procedures insist to a large extent on equal per village allocations, despite the significant heterogeneity of villages. And they ignore other sources of revenue to which villages have access. In the event, village revenues will be very inequitably distributed: villages with high levels of poverty will receive less money than they need and villages with access to significant funding from oil and gas revenues will receive more than required. Also, village service responsibilities are unclearly defined, village financial management systems are inadequately prepared to handle large increases in funding, and mechanisms to monitor and control village spending are underdeveloped. These difficulties will severely constrain the achievement of official objectives and create further challenges for reformers in their attempts to combat corruption at the subnational level. For a long time Africa's political parties have been neglected in political science research, although they have mushroomed during the last decade and are being seen as crucial for the democratic development of the continent. Part of the neglect was due to the very specific western European bias of political science party research, while Africanists claimed the uniqueness of the subject. Despite this bias, the article argues that the framework of established party research can be applied to African parties as well – provided that some modifications are considered. These necessary modifications are explained for four ‘fields’, namely the functionalist approach, the cleavage model, the inclusion of informal politics, and finally whether a distinctively ‘African’ or a universal party typology approach should be applied. 相似文献

This article has two principal objectives: (1) to study the behavioral dimensions of Muslim prisoners which predict their Islamist radicalism and (2) to study whether the behavior manifested by them is higher in prisons with a greater concentration of Muslims and a higher presence of prisoners convicted for Islamist terrorism than in prisons with fewer Muslims and no convicted Islamist terrorists. We conclude that some Spanish prisons may provide favorable social environments for jihadist radicalism and that the questionnaire utilized is a useful diagnostic tool for evaluating the magnitude of this phenomenon. 相似文献

ABSTRACTIn the conceptual literature on terrorism, there is no shortage of answers to the question: “What is terrorism?” Indeed, the terrorism literature has been heavily criticized for a deluge of definitions. And yet the booming quantitative terrorism literature generally examines a narrow set of “what is terrorism?”: how country-level factors explain variation in the number of terrorist attacks. This article demonstrates the variety of ways in which scholars currently operationalize terrorism and compares them to the ways it could be operationalized. I replicate studies using alternative operationalizations of terrorism to examine the consequences of the terrorism literature’s collective bet to focus on attack counts at the country level. Finally, I discuss the implications of the narrow set of operational choices with an eye towards how a greater variety of approaches would produce a more robust research agenda. 相似文献
