论民事起诉权

民事起诉权是当事人一项重要的诉讼权利,是公民的基本权利在民事诉讼领域的重要体现。它具有启动民事诉讼程序、维护当事人合法权益、制约法院审判权的滥用等多方面的功能。我国现行的一些制度诸如起诉和受理制度等对于民事起诉权的保障还存在许多不足,有待于进一步完善。     

论弱势群体的社会经济权利

弱势群体是现实社会的客观存在。处于社会弱势地位的人群并不是社会的弃儿,他们同样是社会共同体的平等成员。对弱势群体权利的关注和保障,奠基于基本的社会价值和人性立场。在诸多权利中,对于弱势群体而言,最重要、最具实质性的是社会经济权利。     

Data Protection: An Opening Door?

Swedish public law has incorporated a general rule of public access to documents, and to information in the wider sense, since the Freedom of the Press Act of 1766. On the Community level, the relationship between Regulation (EC) 45/2001 on data protection and Regulation (EC) 1049/2001 on public access to documents exemplifies the tension between the public's interest in scrutinising the administration carried on in its name, and the integrity of the individual. However, a similar tension exists between Sweden's Personal Data Act of 1998, implementing Directive 95/46, and the Freedom of the Press Act. A misuse model of data protection law, by seeking to concentrate on serious rather than technical infringements of privacy, might serve to ease the tension. Managing commercial risks in open source software licensing

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. End users and resellershave to adjust their own in- and out-licensing models to accommodatethis situation.     

Four Lessons for Developing Countries from the Trade Negotiations Over Access to Medicines

After the Agreement on the Trade-Related Aspects of Intellectual Property Rights (TRIPS) came into operation in 1995 developing countries have found themselves in a process of continual negotiation over intellectual property rights and access to medicines. These negotiations have taken place in the World Trade Organization and in the context of free trade agreements. The paper suggests that the only real win for developing countries has been the Doha Declaration on the TRIPS Agreement and Public Health in 2001. What have been the lessons for developing countries in a decade of negotiations over access to medicines? Drawing on themes of rule complexity and regulatory ritualism the paper discusses four key lessons for developing countries. It concludes by arguing that developing countries will do better if they adopt a networked governance approach to negotiation rather than continuing to rely on traditional coalition formation.     

鸡IFN-γ重组鸡痘病毒对鸡传染性腔上囊炎MB43弱毒疫苗免疫鸡免疫应答的影响

将重组鸡痘病毒(rFPV-IFN-γ)与IBD MB43弱毒疫苗联合接种SPF鸡,研究重组鸡IFN-γ对IBD疫苗免疫效果的影响.结果显示,rFPV-IFN-γ和MB43弱毒疫苗联合免疫组(MB43+rFPV-IFN-γ)及rIFN-γ和MB43弱毒疫苗联合免疫组(MB43+rIFN-γ)在免疫后第2周即可检出ELISA抗体,比MB43疫苗单独免疫组早1周.用IBDV Gx株攻击后,MB43+rFPV-IFN-γ组和MB43+rIFN-γ组免疫鸡的脾只有个别淋巴细胞核浓缩、核崩解,少数滤泡萎缩变性坏死;胸腺损伤程度轻于MB43疫苗单独免疫组和非免疫对照组.免疫后1周,3个免疫组外周血CD8+T淋巴细胞含量均显著高于非免疫对照组,CD4+T淋巴细胞含量变化不明显;攻毒后第2周,3个疫苗免疫组CD4+、CD8+T淋巴细胞含量均显著升高,各组之间CD4+、CD8+T淋巴细胞含量无明显差异.证实,rFPV-IFN-γ和rIFN-γ可加强疫苗的细胞免疫和体液免疫应答.     

泰国：20世纪二三十年代海外潮剧的中心

泰国潮剧源于中国。20世纪二三十年代,伴随着现代化的进程,泰国潮剧逐渐本土化,并对中国潮剧产生一定的影响,成为海外潮剧的中心,对潮剧艺术的发展做出了巨大的贡献。同时,潮剧在泰国与中国之间的地理位移意味着这一特殊戏曲艺术在整体格局中的边缘与中心地位的互换,其后隐藏着特定的社会背景和历史渊源,给予人们深刻而独特的文化启示。     

牛分枝杆菌esat-6和mpb70-mpb83基因DNA疫苗的免疫效果

用PCR技术和重叠延伸剪接技术获得牛分枝杆菌esat-6基因和mpb70-mpb83融合基因,连接真核表达载体pcDNA3.1(+),构建了重组质粒pCE6和pC70-83-E6。分4组免疫小鼠:pCE6组、pC70-83-E6组、pcDNA3.1(+)和PBS对照组,采用间接ELISA法检测免疫小鼠血清特异性抗体水平,MTT法检测免疫小鼠脾淋巴细胞增殖情况和IFN-γ分泌情况。结果表明,2重组质粒免疫组小鼠的血清抗体水平持续上升,而2对照组始终维持在较低水平,且pC70-83-E6组小鼠的抗体水平高于pCE6组。经PPD刺激后,pCE6组和pC70-83-E6组小鼠的SI值与2对照组均差异显著(P<0.05),2重组质粒免疫组间差异不显著(P>0.05);2重组质粒免疫小鼠脾细胞产生的IFN-γ均显著高于2对照组(P<0.05),且pC70-83-E6组明显高于其他3组(P<0.05)。证实本试验构建的2种牛分枝杆菌DNA疫苗可有效诱导实验动物产生体液免疫和细胞免疫应答。     

中国宪法文本上“农民”条款的规范分析——以农民报考国家公务员权利为例

限制农民报考国家公务员的现象,目前在全国的部分地方依然存在,这不仅影响国家宪法秩序的稳定与统一,而且剥夺和限制了农民群体参加国家管理、担任国家公职的权利。本文从宪法解释学的角度分析了宪法文本上“农民”的涵义及农民报考公务员权利的性质,提出了以宪法为基础建立保障农民基本权利体系的设想。     

The European airline industry: law and economics of low cost carriers

This article offers an analysis of the European airline industry in order to understand the new dynamics of the competitive field. The liberalization process did not lead the entrance of competitors similar to incumbents, but a new organizational model has been developed, the one of low cost carriers. The incumbents’ reaction to the liberalization process coupled with the entrance of low cost companies into the sector are hence considered. Two theories are analysed: the contestable markets theory, to understand the theoretical vision that has influenced the liberalization process, and the core theory, a modern approach to the concept of destructive competition that, according to some authors, is a recurring problem in the sector. While numerous barriers to entry still exist, the paper examines how the organizational model of low cost companies has helped new entrants to overtake these obstacles. By the same token, the application of the core theory does not seem to justify strategic alliances taking place in these years. The competitive framework is definitely clearer if we analyse sector changes in a different way, from the point of view of low cost companies considered as new market actors.
