Forensic investigation of OOXML format documents

MS Office documents could be illegally copied by offenders, and forensic investigators still face great difficulty in investigating and tracking the source of these illegal copies. This paper mainly proposes a forensic method based on the unique value of the revision identifier (RI) to determine the source of suspicious electronic documents. This method applies to electronic documents which use Office Open XML (OOXML) format, such as MS Office 2007, Mac Office 2008 and MS Office 2010. According to the uniqueness of the RI extracted from documents, forensic investigators can determine whether the suspicious document and another document are from the same source. Experiments demonstrate that, for a copy of an electronic document, even if all the original characters are deleted or formatted by attackers, forensic examiners can determine that the copy and the original document are from the same source through detecting the RI values. Additionally, the same holds true if attackers just copy some characters from the original document to a newly created document. As long as there is one character left whose original format has not been cleared, forensic examiners can determine that the two documents are from the same source using the same method. This paper also presents methods for OOXML format files to detect the time information and creator information, which can be used to determine who the real copyright holder is when a copyright dispute occurs.     

AN EXAMINATION OF RETAIL CLIENTS’ INVESTOR SUITABILITY RULES IN THE COBS AND THE LESSONS FOR CHINA

Nowadays, the complexity of financial products makes it difficult for retail clients to identify investment risks, and there is an increasing tendency for firms, stipulated by the maximum profits, to recommend or enter into unsuitable transactions to or for retail clients while providing services of investment advice and portfolio management, which causes great losses to a significant number of investors. So, in the contemporary society, the investor suitability rules through which retail clients can purchase suitable financial products are the indispensable legal basis of investor protection. Currently, the regulations concerning investor suitability management in China have several problems, including the chaotic legal system, low effectiveness level and defective contents, which may make it difficult for suitability to be applied in justice and managed effectively. Since the UK’s investor suitability rules in the Conduct of Business Sourcebook that apply to retail clients whose contents include requirements of obtaining retail clients’ information, requirements of information to be provided to retail clients and criteria of assessing suitability are clear and comprehensive, the authors believe that the UK’s experiences can provide a great enlightenment for China to better investor suitability management rules, including integrating legal documents and optimizing effectiveness level, rationalizing application scope, adding criteria of assessing suitability and revising specific clauses.     

Benchmarking Tax Compliance Efficiency Among South African Retail Firms Using Stochastic Frontier Approach

Random selection of taxpayers for audit mostly nets tax compliant taxpayers. There is hence a need to adopt other methods that are efficient and and effective in performing their specific and general deterrence roles. This article uses profit efficiency benchmarking to analyze selected retail firms tax compliance risk in South Africa over the 2005–2006 period. It seeks to identify firms that should be audited because of their suspected tax compliance risk, using a stochastic frontier analysis. The profit efficiency estimates of 24 retail stores are used to rank them in terms of their performance. They are also tracked over time. Approximately, 50 percent of the firms performed better than the average profit efficiency of 0.39. The top 10 firms are significantly performing better. However, the bottom 50 percent of the retail firms performed poorly and could be targeted for tax audit.     

Negotiating Umbrella Agreements

Experienced negotiators know that it is often impossible to define all terms of a complex agreement. By negotiating umbrella agreements, the negotiating parties try to balance the need for certainty and calculability of give-and-take processes with the need to remain sufficiently flexible to embrace new or emerging business opportunities. Umbrella agreements describe a joint consent that explicitly articulates a framework of rules and principles that guides future agreements. It is argued that negotiators are better able to maximize their joint gains if they differentiate between agreements and the framework in which agreements are made.     

Slips and falls in stores and malls: Implications for community‐based injury prevention

An empirical analysis of the behavioral ecology of slip, trip, and fall accidents in grocery stores and shopping malls is presented. The store data set comprised 36 consecutive months of data collected from a chain of grocery stores in the Midwestern USA and the mall data set included 24 consecutive months of data collected from 22 malls across the continental USA, with a concentration in the southern region. Analyses showed that the majority of the slip, trip and fall accidents occurred on the inside of the establishments, on the same level, and resulted from a water or liquid spill or food item on the floor. Design deficiencies accounted for the least amount of occurrences and cost of the accidents, while housekeeping and inspection deficiencies accounted for the bulk of the accidents. Data‐based recommendations for slip, trip and fall injury‐prevention strategies in these public places, focusing on management action, are offered.

电视台为追求高额利润,对其他电视台深受欢迎的电视节目进行复制、借鉴的情况时有发生。为维护自己利益,某些电视组织开始诉求司法部门给予自己的电视节目版式以法律保护。面对这个问题,欧美国家的法院在保护与否的立场上曾一度持否定态度。但近几年的司法判例结果显示这种立场正在发生变化,认可电视节目版式的版权属性,支持给予保护的观点逐渐占据上风。但电视节目版式版权保护在理论基础上仍存在争议。从已发生之判决来看,对电视节目版式除以版权路径给予保护之外,还可以寻求反不正当竞争法和商标法等相关法律给予保护。

Chaebol and the Turn to Services: The Rise of a Korean Service Economy and the Dynamics of Self-Employment and Wage Work

ABSTRACT

This article examines the growing insecurity for the Korean self-employed who were once responsible for a large proportion of domestic service operations. Since the 1980s, changing regional and domestic economic circumstances, the restructuring of regional and chaebol manufacturing operations and liberalisation of the domestic service economy had led to enterprise diversification into the distributive sectors and the systematisation of the domestic service economy. Conducting a historical analysis of service sector development and decomposing the Korean Economically Active Population survey (1989–2011), this article charts the process of Korea’s distributive sector development and its effect on the self-employed. It argues that chaebol systematisation of Korea’s service sector consolidated the domestic economy after 1997 and exerted pressure on the country’s self-employed. Large businesses formalised the service sector, displaced the self-employed, and instead generated mostly non-regular wage work, proletarianising a significant segment of the service workforce.
