和谐侦查是指权力机关在办理案件过程中,依照法律和社会许容度进行的专门调查工作和有关的强制性措施。侦查语境指的是侦查存在和运行的外部环境。和谐侦查的实现应以相关语境为依托,汲取语境的合理内核,相辅相成。其现实语境应涵盖以人为本的政治语境,正义实现的法律语境,探求真实的哲学语境。和谐侦查的构建没有现成的经验可供借鉴,因此,侦查所应有的各项理性规则与程序,侦查所面临的评价标准等等,仍待进一步实践和探索。 相似文献

社会转型和城市化进程加速引发了人员迁徙浪潮和社会关系的急剧变化,犯罪率和重新犯罪率呈持续攀升,并突破历史的高点。人员迁徙,社会管理保障不配套,引发犯罪和再犯罪;教育滞后,低素质面临高诱惑、强竞争,引发犯罪和再犯罪;道德缺位,导致亚文化盛行,行为内控力、制约力弱化,放纵犯罪和再犯罪。改造罪犯压力剧增,监狱在解决自身矛盾中工作没及时调整到位,难以有效扼制重新犯罪和大要案的发生,已成为构建和谐社会过程中突出而尖锐的问题。 相似文献

Recent developments in regulation and tax administration in Australia inspired this article on tax compliance and responsive regulation. This article analyzes the economics of crime and compliance as the dominant approach to tax enforcement of the past three and a half decades. It evaluates the key advantages and disadvantages of the economic approach as well as its application to tax. The article then explores responsive regulation as an alternative method that draws on the economic paradigm but also supplements this approach with other theories, particularly those involving identity, conflict escalation, and procedural justice. Building on this analysis and a case study of Australian investors in mass marketed tax schemes, the article suggests that the broader, more balanced, and closely tailored method of regulating responsively may enable regulators to draw on the advantages of the economic model while alleviating some of its drawbacks. Responsive regulation may therefore constitute a superior method for regulating compliance. 相似文献

Citizenship is not just a status (defined by a set of rights and obligations), it is also an identity that expresses membership in a political community. It also has a substantive political dimension of active participation in the public sphere. Traditionally, collective identity and the membership dimensions of citizenship have been seen as intrinsic to the nation-state. The processes of globalization that have undermined the sovereignty of the nation-state make it necessary to reconceptualize citizenship in light of a ‘post-national’ framework. At the same time, however, the ‘culturalization’ of the social and the ‘multiculturalization’ of societies are putting into question the homogeneity of a collective identity. According to a recent hypothesis, a new post-national model of citizenship is emerging, one of European construction. In seeking to explore this position, the paper advances two additional hypotheses: (i) EU policy-making and governance are likely to foster a post-national European civil society with multi-level citizenship participation; and (ii) European anti-discrimination regulations are likely to accelerate the emergence of an alternative model to multiculturalism that can address differences within a universal framework of rights. 相似文献

Although agricultural biotechnology has been a seminal reference point in risk perception studies, public awareness of their exposure to risk deriving from this new technology has been minimal at best. However, recent events indicate there may be growing public concern as new variations of this technology appear. Understanding what drives perceptions of benefits from the third generation of the agricultural biotechnology and what determines public worries are keys for the future of this technology. To this end, this study analyzes survey data from the midsouth region of the United States to construct four separate regression models of perceived benefits from and worries over plant‐made industrial products and plant‐made pharmaceuticals. Findings suggest that while prior experience with and knowledge about agricultural biotechnology has an impact on perceptions of benefits and worries, trust in farmers plays a highly important role in determining perceptions. 相似文献

As a goal pursued by human beings, a harmonious society can be constructed through a bottom to up social construction mechanism and top to bottom social mobilization mechanism. A healthy social construction mechanism can promote social wealth and allocate it impartially by jointing production of member of society and cooperation-benefit. At the same time, a good social mobilization mechanism, on the other way, makes the members of society reach a harmonious consensus by social mobilization and social civilization. In order to create these two types of mechanisms, public administrators need to develop mechanisms to promote cooperation and develop cooperation productivity.
