两岸跨境犯罪新情势、新问题分析

2010年的"1011"与"0810"项目,以及2011年的"0310"项目行动,让人们见识到跨境电话诈骗之猖獗。事实上,打击跨境犯罪的困境,体现在"跨境"的字义上。从犯罪人的角度而言,跨境犯罪的实施,便意味着增加了执法机关追诉的困难并降低了犯罪人被捕的风险。另外,在此信息社会下,两岸跨境犯罪呈现组织化、科技化、隐蔽化、严重化及被害普及化之新趋势,传统跨境治理体系已无法处理日益复杂化的全球跨境犯罪问题。如何避免全球治理缺口,即"管辖权的缺口"、"参与性的缺口"、"诱因性的缺口"及"功能性的缺口",成为当前防治跨境犯罪急需注意的课题。所以,未来两岸为了有效防治跨境犯罪,应以全球化治理的观点来检视两岸跨境犯罪问题,以强调"网络"、"互赖"及"规制"的特质(低政治、高功能),建立一个永续合作的发展模式,共创两岸人民双赢的局面。     

广西边境旅游发展战略研究

边境旅游作为一种特殊的旅游形式,是依托相邻国家边境线上的自然、人文资源发展起来的一种新兴旅游方式,是国内旅游的延伸。它不仅可以繁荣边境地区的经济,还可以促进边境地区人民之间的友谊,巩固边疆的稳定,而且对整个国家的对外开放和国际经贸合作都起着非常重要的作用。广西作为全国少有的沿边、沿海省区,旅游资源得天独厚。但与其他边境地区相比,广西边境旅游发展仍然落后。文章在借鉴国内外发展边境旅游经验的基础上,结合广西边境地区旅游发展现状和存在问题,提出了广西边境旅游的发展对策。

Yue Xiang: Peacock Dance King

Yue Xiang was born in Ruili in Southwest China’s Yunnan Province in 1948.He fell in love with the peacock dance,a popular folk dance of the Dai ethnic group,at an early age and later studied it under the tutelage of Gensabu and Mao Xiang,well-known masters of the style.By tirelessly observing the living habits of this magnif icent bird and imitating their movements,Yue Xiang has become a famous folk artisan in the China-Myanmar border areas,promoting the Dai heritage.He has won prizes in dance competitions held by China’s Ministry of Culture and attended the National Traditional Games of Ethnic Minorities twice to perform a peacock boxing display.Moreover,he has been invited to perform around China and abroad.In 2007,Yue Xiang was named a custodian of the national intangible cultural heritage of the peacock dance.     

对公安边防派出所人性化执法的思考

人性化执法是人本理念和服务精神在公安边防执法实践中的必然要求和体现,是蕴涵了价值尊重和人文关怀为表征的社会主义新型法治精神。公安边防派出所人性化执法的提出有利于实现法律工具理性与价值理性双重价值目标的统一,有利于实现公安边防行政执法合法性与合理性双重原则的统一,有利于实现公安边防派出所管理者和服务者双重角色的统一。因此,要积极树立公安边防干警人性化执法意识,不断提高公安边防干警人性化执法艺术,不断加强公安边防干警人性化执法监督。同时,必须明确公安边防派出所实施人性化执法需要注意的几个问题。     

陕甘宁边区的农村文艺建设及其历史启示

延安时期,陕甘宁边区政府高度重视农村文艺工作。边区农村文艺的繁荣,主要借助于专业艺术团体的文化下乡和发动农民自办群众性的文艺活动两种途径而展开。边区农村文艺建设的成功实践,为我们当前进行社会主义新农村文化建设提供了重要启示。     

柬泰边境柏威夏地区紧张局势的由来和发展

2008年7月因佛教古寺柏威夏寺归属引发的柬埔寨一泰国边界紧张局势终于出现了缓和的迹象。由于历史原因,柬泰关系特别是边界问题极其敏感和复杂,熟悉这方面的柬埔寨学者认为柏威夏问题无法单独彻底解决。本文就这一问题作些述评。     

Public administration in smart city: A bibliometric analysis

The role of the public administration is crucial for the development of smart cities. Several scholars have highlighted the need for greater contributions focused on the relationship between public administration and smart cities. This work aims to map the contributions on the topic highlighting the status of the field in the recent years. A bibliometric analysis was performed on a sample of articles published in business and management journals. The analysis was carried out using the R-studio Bibliometrics package. Results show that research on the topic is still in an initial stage and has several gaps that future studies could fill. The study is useful for scholars because it identifies the topics analyzed by previous research and highlights future research questions that could be investigated. The analysis highlighted the areas studied by scholars on the topic: urban planning, sustainable development, governance approach, Internet of Things and information and communication technologies.     

陕甘宁边区的民事立法及其对当代民法典编纂的启示

发轫于战争特殊时代的陕甘宁边区民事法律,是边区法律制度的重要组成部分。民国六法全书、中共的政策、边区民事立法、民事习惯构成了边区民事法律的主要渊源。中共领导了边区民事立法,体现出民主立法、与时更进、因地制宜等特征,深入分析边区民事立法的基本经验,有助于推动当代中国民法典的编纂。     

The maquiladora electronics industry on Mexico’s northern border and the environment

The electronic sector, in particular, the computing industry, has become an increasing concern because of the environmental impact of its products throughout their life cycle. The United States, Europe and Japan as the greatest consumers of electronic goods have given special attention to this issue. The fast computer obsolescence and its difficult confinement, because of the hazardous substances contained, have required a special effort of technical innovation. Nevertheless, this effort seems to respond mainly to the standards required by the countries in which these goods are produced, consumed and confined, which are radically different in developed and developing countries. Though an important part of the production process (assembling) is done in developing countries, little attention has been paid to the environmental quality at this production stage. This study examines the environmental problems and strategy of the electronic assembly industry in the three northern border cities of Mexico. Almost half of 200 electronic maquiladora enterprises surveyed had not undertaken any active environmental policy and there was a limited environmental standards enforcement. Evidence was found that the firms that had operated for a longer period of time had better chances of taking better care of the environment. Environmental firm policies became weaker as one descended from the head office to the subsidiaries and then to their suppliers. It is also found that some transnational corporations operate with double standards in Mexico and thus strong national policies on environmental standards in Mexico are required to change this practice.
