试论联合国框架下空间物体造成损害的赔偿责任法律制度

联合国框架下的国际空间条约、国际文件及相关国家实践和国际司法裁决共同构成了空间物体损害赔偿制度。现行的空间物体损害赔偿制度不仅明确了责任主体、求偿主体和求偿途径,也规定了空间物体损害赔偿的范围和赔偿标准及归责原则。但该制度自形成以来一直没有随着空间技术和空间活动的发展而进一步发展,因此亟待完善。     

修正辩论主义与武器平等的证明责任

修正辩论主义为证明责任理论中武器平等原则的实现提供了新的契机。法官对双方当事人的主观证明责任进行干预在公益诉讼等现代型诉讼中具有相当的必要性,有利于平衡双方利益。为实现武器平等原则,在证据事实提出方面,强调法官的释明权和当事人证据协力义务的合理运用。另外,非讼法理和自由证明方式向诉讼程序的扩张,也是构建武器平等的证明责任理论与制度有效路径。     

美国建立反导系统的若干国际法问题研究

美国建立反导系统 (NMD)不仅违反了《反导条约》 (ABM)对其国防建设权的限制规定和对条约继承的规定 ,而且违反了外空非军事化原则 ,尤其违反了《联合国宪章》规定的避免危及国际和平和安全的义务。这一严重违背国际法的行为理应受到国际社会的批判和制裁。     

土地分层利用中的法律问题研究

《物权法》第136条规定:“建设用地使用权可以在土地的地表、地上、地下分别设立.新设立的建设用地使用权,不得损害已设立的用益物权.”由此创造出了建设用地使用权分层出让制度.如何保证该制度顺利实施,涉及到诸多法律问题.通过对地下、地表、地上空间的范围的界定、空间建设用地使用权的设定、登记公示制度构建以及土地立体空间的不同用益物权之间的权利冲突如何协调等问题的全面研究,试图构筑科学的土地分层利用制度,使得我国土地的空间利用成为可能.     

Uneven space of everyday modernity: the colonial logic of the suburb in Tanizaki Jun'ichiro's A Fool's Love

Tanizaki Jun'ichiro's A Fool's Love (1924–1925) has been widely studied as a representative text of the modern popular culture of the Taisho period. This article treats the work as a key text that reveals the colonial relations embedded in everyday modernity of Japan's interwar years, and examines the articulations of colonial relations in three registers of the text. It first investigates the protagonists' unrestrained embrace of cosmopolitan culture as a manifestation of Japan's ambiguous imperialist consciousness, shaped in the interstices between Western and Asian others. The second and third registers concern a particular kind of space dominant in the story: the modern suburb, which became a major symbol of Japan's modernity in the 1920s. In its subordinate relationship with the city, the suburb exemplifies colonial relations. The second register explored in the article is the overlap between the text's exoticism and suburban topography. A key scene on a resort beach is examined for its reference to Hawai'i and the setting's suburban nature in relation to Tokyo. The last register is the suppression of the story's suburban setting. The article analyzes the disappearance as a manifestation of the anxiety about the unevenness of capitalist development that the suburb represents.     

开放经济条件下东北地区出口敏感度比较分析

在"十二五"规划中,我国提出了"全面振兴东北地区等老工业基地"的战略,但是作为东北地区经济助推动力之一的出口发展较为薄弱,敏感度不甚相同。所以,基于开放的经济环境,东北地区发挥出口增长的拉动效应、促进经济增长是当务之急。随着与国外地区经济往来的不断深入,汇率因素发挥了越来越重要的作用,协整检验和状态空间模型表明,汇率对东北地区出口的影响程度不断增强,为了应对汇率变动所带来的压力,东北地区应加强传统出口农产品的科技研究,改善出口结构,提升出口竞争力。     

浅析盗窃罪的客观方面

盗窃罪是普遍的犯罪现象和司法机关的打击重点。《刑法修正案（八）》对盗窃罪的客观方面及相应的刑罚措施作了修改完善和补充,增加了＂入户盗窃＂、＂携带凶器＂和＂扒窃＂三种行为,赋予了盗窃罪新的丰富内涵。文章主要对以上三种行为进行分析,指出了司法实践的难题及处理对策。     

Men in Skirts

There are signs that the wearing of skirts by men appears to be on the increase in the West. Connor's essay provides a series of historical reflections on the signification and cultural phenomenology of male and female apparel. The first appearance of bifurcated dress in the late mediaeval period is considered, along with the struggle between men and women for command of lateral space during the seventeenth century in Europe, as attested to by commentators like John Bulwer and John Evelyn. Explications are offered of the thematics of the fringe and the pocket, as they are dramatized in trousers and skirts, as well as of the logic of lightness and of the pendant. Trousers, Connors concludes, have never lost their fanciful associations with utility, practicality and rationality; they are the signs of occupation, of being taken up in what you do, rather than consumed in what you are. The political victory of the trousered over the untrousered races (Romans, Scots, Indians etc.) is confirmed by its inversion in male masochist fantasies of 'petticoat government', from the late nineteenth century onwards.

Nuclear crisis on the Korean peninsula: strategic adaptation,the Abe administration and extended deterrence in the face of uncertainty

Abstract

In the wake of two nuclear tests in 2016, an additional test in 2017 and a series of missile launches by North Korea in 2016–17, Japan's government is facing a critical set of security challenges. These require adaptation and careful planning by the Abe administration and raise important questions about the future of Japanese defence policy, alliance relations with the United States, and cooperation between Japan and the Republic of Korea. The following article considers both the history and current state of relations between Tokyo, Washington and Seoul, the relationship between elite and public opinion within Japan, and the character of Prime Minister Abe's leadership at a time of acute strategic risk. While the danger of conflict in northeast Asia should not be minimized, the gravity of the current crisis potentially offers an important opportunity for policy innovation for the governing Liberal Democratic Party (LDP).
