Over the last 20 years, sex offender policies, specifically in terms of community corrections, have increased in scope. One of the most controversial and pervasive sex offender policies is that of registration. In response to the consumption of already limited resources, jurisdictions have imposed increasingly higher community supervision fees onto the offenders, requiring them to pay for their own re-entry. However, to date no research study has examined the statutory language associated with registration fees collected post release from formal community sanctions. Using a statutory analysis within the United States, this research finds and quantifies the imposition of a registration fee on offenders who are legally compelled to pay these registration costs, regardless of whether they are still currently under community supervision. Results show that more than half of U.S. states (n?=?28) incorporate statutory language authorizing registration fees, ranging anywhere from $5 per registration to up to $250 per year. These findings, as well as suggestions for future research and policy recommendations, are discussed.  相似文献

This article begins by commenting on an analysis undertaken by the late Stephen Livingstone of 13 cases relating to the troubles in Northern Ireland decided by the House of Lords between 1969 and 1993. It then attempts to repeat the analysis in respect of 12 such cases decided between 1994 and 2005. Areas of law arising for consideration during both periods include the rules on the use of lethal force, aspects of substantive criminal law and criminal procedure and the rights of persons arrested or imprisoned. The more recent cases also raise fundamental questions concerning the status and meaning of the Good Friday Agreement of 1998. The article concludes that there has been a sea-change in the way the Law Lords have handled the Northern Irish cases. From treating them in a way which might have suggested a built-in bias in favour of police, army and government perspectives, they have moved to analysing the competing arguments in the light of more modern approaches to statutory interpretation, the rule of law and human rights.  相似文献

This essay is about the United States Supreme Court's discursive creation of two kinds of persons, one corporate the other criminal, during its 1886 term. The aim is to contrast the Supreme Court's construction of corporate personhood in County of Santa Clara v. Southern Pacific Railroad with its view of the criminal's body in Ex parte Royall, a habeas corpus case. The Court's purpose in deciding these two cases was to design a way to disperse newly emergent and conflicting interests in particular directions within the judicial apparatus. The result is that both criminal and corporate bodies come to be understood through discourse, not outside of it. So the body which is being introduced can be described as a discursive body, not as an anatomical given. 作为市场经济制度的两种基本经济调节力量,自由市场与政府干预二者关系问题一直是经济学界和经济法学界争论的焦点。市场缺陷导致市场失灵,使政府干预有其合理性;政府干预并非完美无缺,也有其局限性。鉴于我国社会主义市场经济体制下的政府干预不能很好地适应市场经济发展的需要,以法为市场经济提供制度保障,保护市场免受任意的政府行为的干涉,需要规制政府干预,有效匡正政府失灵。经济法作为“干预政府之法”理所当然应做出相应的法律规制。  相似文献

This article examines the creation and legacy of the 1957 Wolfenden Report, arguing that current trends to simplistically address the Report, along with a long standing academic focus on Foucault and the nineteenth century, have disregarded the productive and revolutionary nature of its recommendations enacted in the Sexual Offences Act 1967. Contrary to the common emphasis placed on Victorian medical discourse, and the 1895 trials of Oscar Wilde, it was the Wolfenden Report and the twentieth century that created the homosexual identity in law – an identity created not with a view to freedom, as is regularly assumed, but with the objective of the control of recalcitrant bodies in the forms of men's homosexual sex, and women's prostitution. 《刑法修正案(十一)》共调整了18项个罪的自由刑以及9项个罪的财产刑。落实产权平等保护精神并不意味着刑法一定要将非国家工作人员受贿罪、职务侵占罪、挪用资金罪与受贿罪、贪污罪、挪用公款罪的法定刑配置保持一致或均衡。对非法集资犯罪法定刑的加重并不可取。相较无限额罚金制,倍比罚金制是更优的立法选择。将集资诈骗罪的三档法定刑压缩为二档是囿于立法技术的无奈之举,原刑法规定的第三档量刑幅度并未被取消,而是并入修正后刑法规定第二档法定刑中。追诉时效制度属于实体法规定,应当根据刑法从旧兼从轻的溯及力原则,结合具体犯罪的法定刑变化情况确定追诉时效期限。  相似文献

国家所有权的行使,是国家所有权的权利主体通过代表人的积极行为,支配特定的客体,从而使所有权的利益得到实现的行为。国家所有权的行使是有权主体代表国家行使所有权,经济学界的委托—代理理论不适合大陆法传统的当代中国。国有财产有多种类型,应当根据其性质和功能确立国有财产所有权行使的多元机制。国务院以外的机构代表国家行使所有权,尤其是地方政府代表国家行使土地、矿产资源所有权,应当有法律的明文授权。国家所有权的行使者必须接受人民的监督。  相似文献
