Why ‘Uganda’s anti-homosexuality bill’? Rethinking the ‘coherent’ state

How we understand the state is important when addressing issues of human rights. During the debate on the Anti-Homosexuality Bill in Uganda, the country was, at times, presented as nearly uniformly homophobic, exemplified by references to ‘Uganda’s Anti-Homosexuality Bill’. The state, which does discriminate against gender and sexual minorities, is comprised of different institutions and people, holding, at times, conflicting positions. This paper documents these differing positions that parts of the state adopted, along with how those positions changed over time in response to political changes and lobbying from civil society. Uncovering gaps in the coherence of the state by identifying these opposing views is useful both for how we understand and study the state, and for activism against political homophobias. Strategies against legislation similar to the Anti-Homosexuality Bill can target those within most likely to oppose such laws.

论刑事程序法定原则

刑事程序法定原则是现代法治国家刑事诉讼普遍遵循的基本原则。然而在我国的程序法制化进程中这个原则发挥的作用却不尽如人意,存在大量违背程序法定原则基本要求的情况。本文提出刑事程序法定原则的实现途径,以期对解决现代我国程序法制化中存在的问题的解决有所帮助。     

人民警察“见危应救”浅探

我国人民警察的“见危应救”是指人民警察基于其法定职责和义务对人身、财产处于危险或灾难的公民应当立即给予拯救和援助。“见危应救”是《人民警察法》规定的人民警察应履行的法定义务之一。“见危应救”的警察主体范围是所有在职在编的人民警察,“见危应救”的时限要求民警迅速前往救助。同时人民警察还应不断提高服务助民的技能。人民警察“见危不救”应承刑事、行政和赔偿费用的法律责任。不属于人民警察危难救助义务范围事项等情形的,人民警察不要承担法律责任。警察“见危应救”与公民“见危应救”不同。     

结果加重犯内在关系及法定刑配置之思考

结果加重犯是以基本犯为前提的一种犯罪形态。从基本犯与结果加重犯以及结果加重犯的基本犯罪行为与加重结果之间的联系科学认识结果加重犯的内在关系,并以此为基础客观分析其具体法定刑配置,可以看出,结果加重犯的法定刑配置所追求的一个重要的基本目标是应大致遵循一定的基本标准,符合罪刑相适应的基本原则。     

论区间测速的法律完善

传统监测地点车速的执法方式容易被机动车驾驶人躲避,并且覆盖范围有限,因而在制止超速行驶方面效果有限。区间测速以道路的某一段区间为测速的对象,有效地克服了定点测速的弊端。区间测速的实施应在＂以人为本,具有一定容错率＂的原则指导下,注意分段进行测速,认定违法时应以区间平均速度而不能以区间平均行驶时间为依据,同时应完善相应的执法程序,保障相对人的知情权,违反法定执法程序尤其是违反处理时限的执法无效。

The Role of Image-Makers in the Greek Political Scene

Abstract

The paper will address the role of image-makers (political consultants) in the Greek political scene. First, it is argued the growth of political consulting in Greece in the 1990s is intimately linked to the deregulation of the Greek TV scene. Second, the national elections of April 2000 will provide the context for documenting the crucial role that image-makers play in the development of image management strategy and techniques. The convergence of Greek campaigning with communication practices which have been developed and used in American elections renders support to the adaptation version of the “Americanization thesis.”

Abstract

In recent years electoral politics worldwide have become more firmly based on professional advice and labor. In developing democracies, the influx of advice and consultants from the West initially resulted in an “Americanization” of electoral techniques. As electoral systems have developed, the political consulting market in each country has evolved down a route more suited to the specifics of its electoral conditions. The present paper examines the development of political consulting in post-communist Russia. It places the electoral market in comparative context, looking at the scope, structure and activities of political consulting firms, and examining some of the controversies arising from the professionalization of politics in the country.
