The Adaptation of License-plate Readers for Investigative Purposes: Police Technology and Innovation Re-invention

Scholarship has focused on the use of license plate readers by patrol officers as a rational instrument for accomplishing key policing goals, including recovering stolen vehicles. In contrast, this paper applies the theoretical framework of innovation reinvention to explain how license plate readers are being used by criminal investigators in more novel ways. This perspective provides insights into the practical benefits of an enhanced version of this technology. More significantly, it helps illuminate the innovation attributes and the organizational determinants that contribute to its adaptation. In our case study of an agency with extensive deployment of license plate readers, we found that factors contributing to their reinvention included their widespread availability and compatibility with other information systems, their lack of complexity, the characteristics of their users, and the role of leadership in promoting their use. These findings have implications for advancing knowledge about the complex nature of the innovation process.

多重买卖实际履行顺序研究——评我国相关司法解释之规定

我国多重买卖的实际履行顺序规则主要由三条司法解释构成。其不仅适用条件严苛,脱离司法实践,而且与传统民法理论和现行民法规范均存在严重矛盾,可以说根本无法有效地发挥确定履行顺序之作用,应当及时修订。司法实践中,办案人员需要综合考虑案件的具体情形,依据现行民事实体法和程序法之规定确定实际履行的位次,绝非僵化适用司法解释。

试析科技与道德的价值背离

科学技术的进步诱发了一系列的道德伦理问题。对于科学价值与伦理价值的冲突与分离 ,需要辩证地分析 ,而把社会道德败坏的原因完全归咎于科技进步的观点是不客观的。只有努力提升整个社会的道德水平 ,进一步强调科技工作者的伦理责任 ,严格把持科技运用的伦理尺度 ,最大限度地降低科技进步可能付出的道德代价和伦理牺牲 ,制约不良科技行为 ,才能使科学技术更好地造福于人类。     

论“未预见的发展“作为启动保障措施的条件

保障措施作为一种进口紧急措施,具有严格的实施要件.由于GATT第19条的"未预见的发展"在<保障措施协议>中并没有规定,因此,就保障措施的实施条件形成了"肯定说"和"否定说"两种主张.在近年的案例里,WTO趋向采取"肯定说".但"未预见的发展"作为主观要件不仅自身存在缺陷,而且从国际法、国内法、判例法三个角度来看,也应不再作为启动保障措施的条件.它的适用不仅和WTO<保障措施协议>的发展方向相悖,而且也会给WTO的稳定性带来更大的隐患.     

关于我院刑事技术专业教学改革的思考

依照公安部提出“科技强警”的战略发展目标 ,针对目前我院刑事技术专业教学存在的思想观念比较落后、教学体制过于陈旧、运行机制不够畅通、教学资金不保障、器材设备偏落后、专业教师队伍不够稳定等突出问题 ,提出要把刑事技术专业教学改革放在战略高度上认识 ,明确培养的目标和任务 ,把教学纳入全区刑事技术发展的轨道 ,加强教学的宏观规划 ,稳定完善教师队伍 ,积极解决装备不足的问题。适应二十一世纪刑事技术工作的需要。
