The probation service has showed a remarkable facility to reinvent itself over a century of turbulent, but sustained, history. This 16th Bill McWilliams Memorial Lecture will explore the ethos underpinning that survival as the service faces its potential fragmentation, and even dismantling, given the government commitment to privatise much of its current business. If the institution of probation collapses, is there still an important place for probation skills and in what institutional forms will this be reconstructed? Can a hopeful scenario for the future be garnered from the current policy imperatives? Does it matter? And if it matters, how can a vision be created which builds on that history in concert with partners from all sectors? This lecture will reflect on these themes in a policy framework which is fluid, uncertain, and deeply challenging.  相似文献

Do natural disasters prolong civil conflict? Or are disasters more likely to encourage peace as hostilities diminish when confronting shared hardship or as shifts in the balance of power between insurgents and the state hasten cessation? To address these questions, this study performs an event history analysis of disasters’ impact on the duration of 224 armed intrastate conflicts occurring in 86 states between 1946 and 2005. I contend that natural disasters increase conflict duration by decreasing the state’s capacity to suppress insurgency, while reinforcing insurgent groups’ ability to evade capture and avoid defeat. First, disasters’ economic impact coupled with state financial outlays for disaster relief and reconstruction, reduce resources available for counterinsurgency and nation building in conflict zones. Second, the military’s role in administering humanitarian assistance can reduce the availability of troops and military hardware for counterinsurgency, prompt temporary ceasefires with insurgents, or both. Third, natural disasters can cause infrastructural damages that disproportionately hinder the state’s capacity to execute counterinsurgency missions, thereby making insurgent forces more difficult to capture and overcome. The combination of these dynamics should encourage longer conflicts in states with higher incidence of disaster. Empirical evidence strongly supports this contention, indicating that states with greater disaster vulnerability fight longer wars.  相似文献

Abstract

Intentional destruction of cultural heritage is a well-known phenomenon which has been particularly exacerbated in recent times. Its common denominator is represented by the intent to persecute the communities for which that heritage represents an essential element of their cultural identity and distinctiveness. In legal terms, it produces different implications, to the point that – depending on the circumstances in which it is perpetrated – it may be qualified as a war crime, crime against humanity, violation of internationally recognised human rights, or evidence of the existence of the intent to commit genocide. Since the whole international community is seriously affected by the destruction of cultural heritage, it is indispensable that the doctrine of responsibility to protect (R2P) be put into practice seriously and effectively with the purpose of protecting humanity against the irreplaceable loss of its heritage.  相似文献

This research evaluates secular change in Phenice's (Am J Phys Anthropol, 30, 1969 and 297) three morphological traits of the pubis, as described by Klales et al. (Am J Phys Anthropol, 149, 2012 and 104): medial aspect of the ischio‐pubic ramus, subpubic contour, and ventral arc. Ordinal scores were collected for these traits and compared between a sample of innominates from the historical Hamann–Todd Collection (n = 170) and modern Bass Donated Collection (n = 129). Using the Freeman–Halton test, significant differences between temporal sample score frequencies were found for all traits in females and for the subpubic contour and ventral arc in males. Despite these findings, classification accuracy using logistic regression between the temporal periods remained low (68.7%). These results suggest that secular changes in trait expression are occurring; however, sex estimation methods using these traits and created with historical samples are still applicable to modern forensic cases. In fact, the secular changes occurring in these traits contribute to better classification accuracy between sexes in modern populations.  相似文献

Abstract

Despite an overall decrease in residential mobility after the 2007 housing crisis, many households, particularly those that are low income, continue to move in pursuit of a better life. Traditional theories of residential mobility suggest that mobility will occur when housing and transportation costs are cumulatively greater than the cost of moving to a new location. At the same time, the influence of these factors is not likely to be uniform across geographic contexts or for moves up or down the metropolitan hierarchy. Our analysis examines how well affordability measures explain patterns of county-level residential mobility. Specifically, we contrast conventional measures of affordability focused on the ratio of income to housing expense with measures of location affordability that factor in both housing and transportation costs. We find that whereas households tend to move from lower to higher cost locations, transit affordability at the destination plays an important role in mobility decisions.  相似文献

Political parties in parliamentary democracies have increasingly democratized their leadership selection processes, incorporating the votes of party members. Despite generating numerous headlines, there has been a relative dearth of cross-national scholarly work on the electoral effects of selectorate expansion and the causal mechanisms behind them. This study fills this gap in the literature. Using observational data from eleven parliamentary democracies, we show that parties using membership selection can expect a polling boost when compared to those using more exclusive mechanisms. However, membership selection does not affect electoral performance. Nevertheless, our crossnational analyses and results from a survey experiment from Australia suggest that incorporating members generates excitement, demonstrates an openness to new ideas, and can be a signal of leader work ethic and a commitment to the democratic process, increasing leader legitimacy. We discuss the disconnect between these positive evaluations and the lack of electoral effects, and suggest possible strategies for parties to improve their electoral standing.  相似文献

Private law enforcement of the right to be forgotten should be considered in light of the general characteristics of private law. This highlights advantages and limitations, and underlines the need to explicate the actual interests involved in the right to be forgotten. As case law and real-life examples show, enforcement is mostly feasible but may be costly. The right to be forgotten is most effective against large, bona fide corporations. This analysis provides a more realistic view of the possibilities of private law enforcement of newly proclaimed rights.  相似文献

Public authorities process personal data. In most cases these data are processed because there is a legal obligation to do so, or because processing is necessary for the performance of a task carried out in the public interest. The right to be forgotten or to erasure will, in this situation, play a limited role in the protection of the rights of the individual. There is even a public interest in maintaining archives, thus in not forgetting. At the same time, the possibility exists that not forgetting might be more valuable for the protection of rights of data subjects then forgetting. In the case of data processing by public authorities, it is important that the processing is based on a law. A close watch should be held on the grounds that public authorities use to justify the processing. As the right to be forgotten will play a limited role in the protection of the rights of data subjects in the case of data processed by public authorities, it is important to emphasize the right of access and rectification of data. It is therefore essential that the controller is transparent to the public with regard to the processing of data.  相似文献

For almost four decades, the reform of the state has been a recurrent and relevant topic for social sciences. Has the s.c. positive state been replaced by a regulatory state, or have hybrid configurations emerged? Based on a comparative analysis of German and Italian railway policies, this article aims to contribute to the literature on regulation, considering the possibility of policy mixes in which elements of the positive and the regulatory state are interrelated. Such hybridization is the result of multiple-actor policy arenas, where regulatory tools are used to restructure state’s direct intervention rather than to bring about its retreat.  相似文献
