加拿大外国银行分行准入制度及其对我国的启示

加拿大对外国银行分行准入曾经是采取禁止的态度,到1999年6月28日加拿大联邦立法机构通过了《第C-67法令》。该法令试图修改《银行法》、《清算与重组法》以及其它金融机构相关法令,从而允许合格的外国银行在加拿大设立分行。外国银行分行可以采取全能分行或者贷款分行的形式来运作。尽管加拿大外国银行分行制度的历史并不悠久,但其新近制度的构建确实比较系统全面。本文在评介加拿大外国银行分行准入的标准、申请程序及相关信息要求的基础上,对我国相关制度的完善进行一些思考。

A Tale of Two Councils. Explaining the Weakness of the SVP in the Upper House of the Federal Parliament

The SVP is the strongest party in the National Council, but the weakest among governmental parties in the Council of States. This article analyses possible explanations for this surprising difference by combining macro‐level information on electoral results and data from recent election studies. The results presented show that the weakness of the SVP in the Council of States is due neither to its decision to compete only in selected constituencies, nor to “mechanical” effects of the electoral system. Rather, this weakness is explained both by the strategic behaviour of voters, who avoid “wasting” their vote in the majoritarian election of the Council of States, and by incumbency effects. The SVP is further disadvantaged by its ideological position, as its candidates have more difficulty gathering the majority of votes required for election in the Council of States than do, for instance, those of the centre‐right parties.     

关于农村集体建设用地直接入市问题的思考

农村集体建设用地直接入市有深刻的利益动因。在实践中已经形成了一些基本的农村集体建设用地直接入市的方式,也形成以试点地区为代表的典型模式。当然,农村集体建设用地直接入市还存在着很多问题。然而,针对这些问题可以发现一些进一步创新的方向。     

物权法下的农村宅基地使用权探析

宅基地使用权是农村村民依法享有的,为建造自有房屋在集体所有的土地上占有、使用,以及建造、保有房屋及附属设施的一种具有中国特色的用益物权,带有成员性色彩的福利性的集体权利。物权法对于宅基地使用权的规定具有重要的意义,但是,其规定过于简单,并且存在着多种不周延之处。我们应当完善宅基地使用权登记制度,肯定有限制的流转,并规定在取得宅基地使用权后,应当在一定期限内投入使用,以加快宅基地的利用,发挥其价值。     

关于铁路公安机关查处“三非”外国人的思考与建议

依法查处“三非”外国人,既有利于提高公安机关的涉外管控和服务能力,又有利于保障我国正常的出入境管理秩序.群众舆论基础良好、法律法规日趋完善、铁路口岸外籍人员流动频繁为铁路公安机关查处“三非”外国人提供了有效保障.铁路公安机关查处“三非”外国人要从强化思想意识入手,健全激励机制,提升民警综合素质,实现路地警务资源共享,共创良好涉外治安环境.     

Community＇s Benefits From the Tourism Growth and Tourism Site Development in Vang Vieng District of Vientiane Province,Lao PDR

This study attempts to measure benefits of the local residents of Vang Vieng from tourism growth and tourism site development. Here, community benefits involve not only economic benefits but include also social, cultural, and environmental benefits. The data used in this analysis are primary data provided through a questionnaire by the residents of Vang Vieng district, a famous tourist spot in Lao PDR. The results are mixed results. On the negative side, the community faces some risks as a result of tourism development. On the positive side, tourism growth and tourism site development bring about improvements in living conditions and conservations of residents＇ attitudes toward tourism improvement development.

2012年以来,灵渠“申遗”备受广西特别是兴安人民的关注,经过共同努力,已经取得了重新进入《中国世界文化遗产预备名单》的阶段性重大成果。《桂林国际旅游胜地建设发展规划纲要》得到国家发改委批复,标志着桂林发展已经上升到国家战略,灵渠申遗也迎来了千载难逢的大好机遇。灵渠“申遗”与桂林国际旅游胜地建设可谓密不可分,相互促进,将会取得多赢效应。     

Scanning Electron Microscope Analysis of Gunshot Defects to Bone: An Underutilized Source of Information on Ballistic Trauma

Recent years have seen increasing involvement by forensic anthropologists in the interpretation of skeletal trauma. With regard to ballistic injuries, there is now a large literature detailing gross features of such trauma; however, less attention has been given to microscopic characteristics. This article presents analysis of experimentally induced gunshot trauma in animal bone (Bos taurus scapulae) using full metal jacket (FMJ), soft point (SP), and captive bolt projectiles. The results were examined using scanning electron microscopy (SEM). Additional analysis was conducted on a purported parietal gunshot lesion in a human cranial specimen. A range of features was observed in these samples suggesting that fibrolamellar bone response to projectile impact is analogous to that observed in synthetic composite laminates. The results indicate that direction of bullet travel can be discerned microscopically even when it is ambiguous on gross examination. It was also possible to distinguish SP from FMJ lesions. SEM analysis is therefore recommended as a previously underexploited tool in the analysis of ballistic trauma.
