我国“准入前国民待遇”制度研究——以上海自贸区为视角

上海自由贸易实验区的成立有一个重要突破,即推行准入前国民待遇制度.但上海自贸区“准入前国民待遇”制度还存在一定问题.应当从明晰概念、完善“负面清单”、提供公平开放的外部环境、借鉴双边或区域投资协定的做法等方面进一步完善.     

无线定位技术在公安业务中的应用

无线定位技术包括卫星定位、蜂窝网定位、局域网WiFi定位、UWB定位等,对它们进行比较研究后,可以归纳出它们在公安业务中的七大应用。当前的热点问题——伪基站的治理也需要应用到该技术。     

环境法体系中的自然保护地立法

作为正在制定过程中的新兴环境立法,自然保护地法、国家公园法等自然保护地立法与环境法体系中的其他法律存在发生规范冲突和赘余的可能,有必要明确其价值定位以及相应的规范表达。在生态文明入宪、入环境基本法的背景下,环境基本法的保护优先原则和综合治理原则内含对优先保护生态整体性的价值期待,需要自然保护地立法予以表达。相较于污染防治法与资源保护法,自然保护地立法以生态环境保护为根本调整目标,且具有调整对象的系统性和调整方式的调适性,契合优先保护生态整体性的需要。为落实这一价值期待,自然保护地立法需构建以分区定保护级别制度、总行为控制制度为核心的制度体系,并采用“自然保护地基本法+各类自然保护地特别法”的总分结构。     

Illegal Dealings: The Impact of Low-Level Police Enforcement on Drug Markets

This article examines the impact of low-level police enforcement on two British drug markets, and the adaptations to enforcement made by sellers and buyers. The two markets took very different forms. One was tightly controlled by a small number of middle-level dealers, and highly structured. The structure and control worked effectively to minimise risks posed by law enforcement. The other market was very loosely structured, with little control exercised on retail sellers by middle-level dealers. This lack of organisation posed different sets of problems for law enforcement. The article examines the potential for developing the role of police sources (informants) in disrupting drug markets of both sorts. It also argues the need for provision in parallel of local treatment facilities for drug users.     

Chapter 10. Patterns of Career Development in Child and Youth Care

Abstract

Patterns of career development in the field of child and youth care are reexamined in relation to roles that involve working directly with children in specific settings as well as in relation to roles that involve working indirectly in support of children through working with other adults, be these parents, other caregivers or professionals. Other career roles involve working in support of human service systems that impact on the care of children and young people and influence family welfare. Finally, some career roles involve working at the macro level to formulate policies that shape the culture of caring communities to support the health and well-being of children. Each career role presents important challenges and offers valuable opportunities for influencing the lives of children, young people and their families.     

群体性事件的心理原因及预防处置对策探析

当前,群体性事件已成为影响社会和谐稳定的突出问题。如何正确认识、积极预防、妥善处置群体性事件,是政法战线乃至各级党委、政府必须认真面对的重要课题。本文从群体性事件的社会心理原因着手进行分析,进而提出相应的预防和处置对策,以增强相关部门有效预防处置群体性事件的能力。     

A Framework for the Judicious Use of the Polygraph for Youth Who Have Committed a Sexual Crime

Among professionals working with youth who commit sexual crimes, there is a clear chasm between proponents and opponents of postadjudication polygraph testing. Polygraph use for juveniles is an issue at the forefront of conversation in the state of Colorado, as the Sex Offender Management Board has evolved on positions. Drawing on extant research base, they have conducted a state-level evaluation in Colorado to inform further determinations. Using probation files of youth adjudicated of a sexual crime (N = 62), regression models were run. Youths’ significant reactions on a polygraph test were statistically significantly associated with more disclosures. Nonsignificant reactions, significant reactions, inconclusive results, and more disclosures were statistically, significantly associated with more polygraph testing. Finally, youth with nonsignificant reactions were five times more likely to successfully complete treatment, but test results and number of tests were not associated with recidivism outcomes. A framework for the judicious use of the polygraph is proposed.
