森林公安情报信息体系建设初探

研究森林公安情报信息体系建设有利于整合森林公安情报信息资源，有利于加强对森林公安情报信息工作的指导和监督。为更好地维护林区社会治安秩序，保护森林资源，森林公安情报信息体系建设应区分森林公安与地方公安的不同特点。并围绕这一特点开展这一体系建设的内容研究。     

Kein Insichgeschäft bei bloß mittelbarem Vorteil des Vertretergeschäfts für den Machthaber selbst

Dass ein Machthaber durch ein zwischen ihm als Vertreter eines Machtgebers und einem Dritten abgeschlossenes Rechtsgesch?ft und dessen Durchführung dem Vertretenen unmittelbar Nachteile und sich selbst mittelbar wirtschaftliche Vorteile verschafft, bedeutet noch nicht, dass eine einem Insichgesch?ft gleichartige Interessenlage zu bejahen w?re. Dass damit eine Interessenkollision verbunden ist, reicht zur Bejahung der Unwirksamkeit des Rechtsgesch?fts nicht aus. Ein Grundbuchsgesuch des Vertreters des Liegenschaftseigentümers auf Einverleibung eines Pfandrechts zur Besicherung einer eigenen Schuld leidet daher nicht notwendig an einem Vollmachtsmangel, und auch die Zustellung des Grundbuchsbeschlusses an den Machthaber ist wirksam.     

Féminiser les noms de profession dans la langue judiciaire

Résumé  L’évolution de la société se traduit dans le langage. Au Moyen ?ge, notairesse, tutorresse et défenderesse rendaient visibles, dans les textes, l’épouse et la femme agissant dans la société. à notre époque s’emploient des noms, tels infirmière, institutrice et vendeuse, qui ne sont pas neufs. Simultanément, comme la femme accède à des professions réservées aux hommes, s’installent des appellations féminines nouvelles telles que (la) juge, (la) pénaliste, présidente, consœur, avocate, magistrate, huissière, enquêtrice. Au Québec, en Suisse, en Belgique et en France, des textes officiels recommandent la féminisation. Celle-ci suscite les passions parce qu’elle touche aux traditions, au savoir-vivre, aux préjugés, au souci d’égalité et surtout à l’identité de la personne. Même si des raisons culturelles et sociales freinent l’évolution des mentalités, la progression de la féminisation dans l’usage constitue un fait linguistique remarquable.     

The Revised German Raw Materials Strategy in the Light of Global Political and Market Developments

Raw material markets have proven to be challenging in recent years. The so‐called critical raw materials (CRMs), which are required for green technology, have particularly high environmental and supply risks. The revised German raw materials strategy attempts to address challenges of production and supply of CRMs and other mineral‐based raw materials. This contribution analyzes the motivation, measures, goals, and challenges of the German raw materials strategy in the light of global economic and political developments, applying the qualitative method GABEK®. Results show that the revised strategy is more ambitious and reaches farther than the initial strategy of 2010. Challenges that remain include the lack of willingness of the German industry to engage in mine production and the more pro‐active political approaches demonstrated elsewhere. As all major economic powerhouses outside of Europe pursue a hands‐on approach, it remains questionable if the revised German raw materials strategy will fundamentally be able to sustainably secure raw material supply for the German industry.

Freedom and Sovereignty a Fatal Relationship Outlined with Jean-Luc Nancy and Marquis De Sade

Sovereignty and freedom are interlinked in a manner of both ambivalence and interdependence. Neither can sovereignty confirm itself without presupposing for itself a pure state of freedom; nor can freedom conceive and realise itself without interweaving with sovereignty. Both concepts collide with each other as sovereignty usually signifies a certain social or cultural power or order; and freedom regularly is related to a sovereign subjectivity. Therefore, the question is: how far might sovereignty serve as a source of freedom that, at the same time, has to be limited by this freedom itself. When the sovereign (subject) defines where the limits of freedom are, he will mostly define the limits of experiencing such freedom for all those who have to follow his decision on the limit. Further, if the free (sovereign) subject itself defines its own limits, it will supposedly end up rejecting its interweaving with any other subjectivity beyond its own. The problem remains: both sovereignty and freedom cannot be realised if they are already limited.

在资源配置效益之外从个人自由的角度论证行政许可的本质 ,运用分析法学的方法解析许可和行政许可的法律意义 ,则行政许可就是通过行政程序创设个人自由或财产性权利的构成性事实。行政许可权的合理性与正当限度即在于个人自由与公共利益的平衡。公共利益概念存在不确定性和“羊皮化”倾向 ,而对治理的实质理性的追求是不可靠的 ,应该注重程序制度的建设和程序权利的维护。     

刍议少数民族地区事实婚姻的法律效力

在少数民族自治地区应根据实际情况分别承认事实婚姻的法律效力 ,才能更好地维护少数民族地区的婚姻家庭秩序 ,保护事实婚姻当事人的合法权益。     

Deaths Related to Tractor Accidents in Eskişehir,Turkey: A 25‐Year Analysis

This study aimed to analyze deaths related to tractor accidents in Eski?ehir Province and characteristics of these cases to provide data and suggestions along with the literature. The cases involved individuals died due to tractor‐related accidents were retrospectively examined between 1992 and 2016 (25‐year period). Demographic data related to the cases and crime scenes, characteristics of events, and autopsy findings were evaluated. In the 25‐year period, 61 individuals (88.5% males, average age: 48.7 years) died due to tractor accidents in Eski?ehir Province, and approximately 45.9% of these accidents most commonly involved tractor rollover. Deaths due to tractor accidents will be decreased by raising awareness among tractor drivers, preventing young individuals from driving tractors, not allowing individuals to drive without license, making mechanical and physical features of tractors suitable for agricultural activity to be performed, ensuring their safety for travel and use, and avoiding carrying passengers on tractors.     

Speaking the Language of Friendship: Partnerships in the Political Construction of the Late Sixteenth-Century South-East Charcas Frontier

The present article discusses the importance of partnerships in the political construction of the south-east frontier of late sixteenth-century Charcas, focused on foundation and destruction of San Miguel de la Laguna. In a challenge to the narrative of ‘constant war zone’, the events are here framed as part of a process described as territorialisation, which transformed geographies into territories of the polycentric Catholic Monarchy, politically equipping the land with relations that were expressed through institutions. San Miguel was the product of the ‘friendship’ between its founder and the Chiriguanaes who inhabited the area. Its fate was not the result of untrustworthy natives.
