Gender and general strain theory: A preliminary test of Broidy and Agnew's gender/GST hypotheses

Some scholars argue for sex-specific explanations of criminal behavior, while others opt for more general theories of crime. In this article, we elaborate on recent explorations of gender differences in general strain theory (GST). Using data obtained from self-report interviews of delinquent youths, we implemented measures of strain, negative emotions, and coping resources to examine sex differences in GST-related processes across both interpersonal and property offending. The results offer some support for Broidy and Agnew's gender/general strain hypotheses and, at the same time, offer modifications and extensions for future research on GST.

社会流动中农村外出务工女性的阶层分化研究——以河南省为例

在我国工业化、城市化和市场化的进程中,农村外出务工女性群体成为了一个非常值得关注的新型群体。在社会流动过程中,绝大多数农村女性通过外出务工,实现了社会阶层的向上流动。她们的层次分化已经初步显现,但层次分布很不合理。为了促进农村外出务工女性合理进行阶层分化,需要从以下几方面进行努力：大力宣传社会性别平等文化,努力培育社会性别平等意识;加大对农村女性劳动力的教育培训力度,提高农村女性劳动力的就业能力;积极在农村发展多元化的托幼养老组织,解决农村已婚女性外出务工的后顾之忧;继续深化户籍制度改革,着力提升城市社会对务工女性的公共服务水平。     

关于工会应对“劳资突发事件”的思考

我国近年劳资冲突事件频繁发生,但应对处理能力明显不足。工会身处协调劳动关系第一线,有必要对劳资群体事件的主要原因、自身应扮演何种角色、该注意哪些问题作些分析与探索。     

中产阶层社会态度流变、异化与历史作用——以西方学者视野的考量

社会态度的社会性、价值性决定了中产阶层的社会态度不是一成不变的,而是流变的、多样的,甚至同一时空中产阶层不同群体的社会态度也不一样。当代西方中产阶层的社会态度是一种自我人格异化,其典型的论述当数米尔斯的"渴望中间过程论"、福塞尔的"驼鸟心态论"和贝尔的"人格分裂论"。西方中产阶层社会态度影响着西方社会的发展,中产阶层早期的革命性态度是现代转型的思想引擎;工业化时期的批判性态度是阻扼工业社会腐败的精神力量;而后工业时期的异化态度则是西方社会精神衰变的心理因素。     

The Recognition,and Res Judicata Effect,of a United States Class Actions Judgment in England: A Rebuttal of V ivendi

United States' courts have proven willing to certify multi‐jurisdictional class actions which purport to adjudicate the claims of both American and foreign (i.e., non‐US‐domiciled) class members. This article contends, however, that a class actions judgment/settlement issued by a US court would not be recognised, and would not be given preclusive effect, in England, should absent English class members wish to re‐litigate the same grievance before an English court. Specifically, it is argued that two separate preconditions for such recognition and preclusive effect would fail, viz, a US court would usually lack the requisite ‘personal jurisdiction’ over absent English class members; and the necessary ‘identity of parties’ would be absent. The article seeks to anticipate the appropriate answer to a conundrum which is certain to arise for future English judicial consideration, whilst acknowledging the uneasy fit which currently exists between English private international law and multi‐jurisdictional class actions.

当代中国产业工人的阶级意识问题研究

工人阶级的阶级意识可以有多种表现形态,如有马克思主义的工人阶级阶级意识,也有工联主义的工人阶级意识等。社会主义市场经济中的产业工人阶级意识既不是阶级斗争的、无产阶级革命式的阶级意识,也不是计划经济中,缺乏主体性,缺乏权利的主人翁阶级意识。而是主体、自主、权利、法治意识,提高自身素质、互利合作意识,即权利基础上的合作意识。调查数据验证,现实中的中国产业工人已经逐步形成这种新型的社会主义市场经济产业工人阶级意识。     

Dynamischer Erhaltungsbegriff und Verbesserungspflicht des Vermieters im MRG

Im Bereich voller Anwendbarkeit des MRG hat der Vermieter für eine Erhaltung des Mietgegenstandes "im jeweils ortsüblichen Standard" zu sorgen. Der vorliegende Beitrag versucht, dem unbestimmten Gesetzesbegriff der Ortsüblichkeit anhand der bisherigen Rechtsprechung Konturen zu verleihen sowie Kriterien für die bisher unklare Abgrenzung zwischen dem dynamischen Erhaltungsbegriff des § 3 MRG und der Verbesserung nach § 4 MRG herauszuarbeiten.
