认真学习宣传《职业病防治法》努力做好职工劳动保护工作

《中华人民共和国职业病防治法》的颁布和即将实施 ,是关系亿万劳动者身体健康和切身利益的一件大事。各级工会组织要从认真实践“三个代表”重要思想的高度 ,认真学习宣传这一法律 ,充分认识职业病的危害 ,努力做好职工的劳动保护工作 ,进一步履行工会维护职工合法权益的基本职责。     

违反《工会法》的法律责任

违反《工会法》应当承担相应的法律责任。修改后的《工会法》对阻挠职工依法参加和组织工会 ,打击报复工会工作人员 ,侵占工会经费、财产 ,妨碍工会依法履行职责以及工会工作人员损害职工和工会权益等行为 ,规定了责任人应负的行政责任、民事责任和刑事责任。对《工会法》和党的工运方针政策的落实 ,对职工和工会相关权利的实现 ,将起到重要的法律保障作用     

The Legal Protection for China's Flexible Workers during the Covid-19 Pandemic

The COVID-19 pandemic has caused a chain of socioeconomic effects worldwide. China’s social and economic operations and labor market have also been suffered because of this global crisis. During hard times, flexible employment becomes an important means for stabilizing employment. However, the pandemic also exposed the problems ensuing from insufficient legal protection for flexible workers. First, there are some gaps and defects in the labor and social security laws in terms of their scope and applicability to flexible workers. Second, there were limitations in the support and protection policies for flexible workers at the early stages of the pandemic. Although the government implemented measures soon after the outbreak of COVID-19, their role is still constrained by the legal lacunae in protecting flexible workers. As flexible employment will continue to play a significant role in China’s labor market, the State Council issued a far-reaching official document in July 28, 2020 to support it. This document indicates the directions for providing better legal protection for flexible workers, which contains expanding the legal scope and enriching the legal protection. Based on the realities and latest policies, the legal protection for flexible workers should be systemically improved in the future.     

Conclusion: agency,context and emergent post-uprising regimes

This conclusion summarizes the evidence explaining the divergent trajectories taken by post Arab uprising states in terms of multiple variables, each illustrated by an iconic case, namely: State Failure and Competitive governance (Syria), Regime Restoration and Hybrid Governance (Egypt) and Polyarchic Governance (Tunisia). Factors include the starting point: levels of opposition mobilization and regimes' resilience – a function of their patrimonial-bureaucratic balance; whether or not a transition coalition forms is crucial for democratization prospects. Context also matters for democratization, particularly political economic factors, such as a balance of class power and a productive economy; political culture (level of societal identity cleavages) and a minimum of international intervention. Finally, the balance of agency between democracy movements, Islamists, the military and workers shapes democratization prospects.

家政工生存状况研究:基于北京、济南被访者驱动抽样调查

市场化照料在满足中国家庭照料需求方面发挥着日益重要的作用。然而,由于对女性再生产劳动的忽视和对家政工进行抽样的困难,既有研究缺乏对家政工群体的全面呈现。本文基于2019年在北京、济南开展的家政工被访者驱动抽样调查数据发现,以农村进城务工女性和城市下岗女工为主体的家政工群体的工作条件、劳动过程、劳动保障与权益、工作—家庭责任平衡及身心健康状况不容乐观,尤其是住家家政工群体。本文提出加强对有偿照料劳动的社会嵌入性和价值、照料劳动进程和工作—家庭冲突对照料劳动者的影响等议题的研究,并推进倡导性别平等的照料政策的制定。
