德国国际私法渊源的新发展

在传统上,德国国际私法的渊源包括制定法、德国缔结或者参加的各种国际私法条约、习惯法和判例法,但是随着欧盟国际私法统一化的深入发展,尤其是欧洲共同体在公司法、合同法、物权法、知识产权法、破产法和国际民事诉讼程序法等领域的立法不断加强,欧盟法中的国际私法规范逐渐渗入德国国际私法,从而使德国国际私法的渊源突破了传统的范围,越来越多地打上了欧盟法的烙印,呈现出“欧盟化”倾向。     

经济全球化对现代国际法的影响

经济全球化使国际法的主体增加了 ,也使国际法的调整领域进一步扩大 ,从而推动了法律的全球化。欧洲联盟法所形成的一种特殊的国际法律秩序对现代国际法的影响日趋突出。经济全球化和国际秩序的法制化进一步充实了国家主权学说、国家主权原则的内容。     

欧洲一体化对英国国际私法的影响

随着 1973年英国步入欧洲共同体 ,英国国际私法不应再被孤立地看待 ,它与欧洲联盟统一国际私法及欧洲联盟成员国中的大陆法系国家的国际私法紧密地联系在一起。它们相互影响、相互渗透、相互作用、相互促进。作为欧洲联盟 15个成员国中仅有的两个普通法法系国家之一 ,而且是普通法发源地的英国 ,其国际私法受到了欧洲一体化空前的、巨大的影响。这种影响主要体现在 :推动了英国国际私法制定法的新发展 ;开拓了英国国际私法的新法源 ;创立了英国冲突法案件的新类型 ;提供了英国解决冲突案件的新方法     

透明原则在欧盟宪政中的发展和制度解读

透明原则随着信息社会的逐渐发展,越来越成为现代民主社会一个重要的基本特征,在越来越多的国家被确立为宪法性原则。这一原则在具体的制度设计上则体现为政府信息公开制度。欧洲从其20世纪50年代开始的从经济共同体逐步向政治一体化过渡的过程中,也在不断地探索与完善有关共同体或者是欧盟层面的信息公开制度。欧盟通过一系列立法逐渐将政府信息公开制度确立为其宪法性条约中的透明原则以及相关的一系列制度设计。欧盟的信息公开制度对我国刚刚起步的政府信息公开建设具有非常有益的参考和借鉴价值。     

The Future of the EU and Sino-EU Relations

Since the end of 2009,sovereign debt crises have erupted one after the other in Greece,Ireland,Portugal and Spain.Until now,the EU has not been able to keep this run of debt crises in check.Anxieties over the future of the European Union and the eurozone are mounting.American historian Walter Laquer has argued that economic decline,diplomatic weakness,and internal tensions could lead to the collapse of the EU.1 Philip Stephens,columnist for the Financial Times,wrote:"At the opening of the millennium the European Union seemed a confident role model.The assumption was that the postmodern multilateralism symbolized by the euro would be exported to rising nations and regions.Now there are questions as to whether Europe itself can hold together."2 This paper aims to understand the current situation and the future of the EU by examining the European sovereign debt crisis and its socio-political impact on European integration.It also analyzes the reasons behind the worsening of the debt crisis,the future of European integration,and China's policy toward Europe.     

欧洲联盟及其法律体系特征初探

欧洲联盟是当今世界极具特色和代表性的一个国际组织,其在宗旨、原则、法律地位、组织机构、职能及法律体系等方面都具有自身的独特性。从最初的经济一体化,到后来的经济货币联盟、政治联盟,欧盟已成为林林总总的各类国际组织的楷模,而其在法制方面的成就更是令其他国际组织难以望其项背,从立法机关、立法程序到规范性文件的执行和实施,整个欧盟法已形成了一个庞大的体系,而随着《欧洲宪法条约》的出台,欧盟又出现了新的发展趋势——法律一体化。     

Insurances as a Method of Reducing the Financial Consequences of Environmental Disasters

On the market of industrial customers in the European Union （EU） as well in Poland have not yet been disseminated information related to environmental threats. The purpose of this study is seeking understanding and analyzing the functioning of business insurance as a method of financing the effects of environmental disasters, potential environmental threats, the costs of restoring the polluted environment to its original form. The design of the article was subordinated to the thesis according to which business insurance can be a method of financing the risk of environmental damages and prevention for protecting against the effects of these disasters. According to the subject of discussion it used： elemental analysis--if the object of study requires the distribution of the elements without looking for mutual dependence between them; casual analysis--when there was a need of looking for the cause-effect relationships between the elements of the object of the study.     

欧洲联盟反倾销法上非市场经济制度本质探究

市场经济"地位"与市场经济"待遇"是欧盟反倾销法上非市场经济制度的两个基本概念。目前人们对这两个概念的理解混淆已经造成了对欧盟这一重要制度本质认识的片面性和肤浅性。欧盟反倾销二级立法中缺乏明确的市场经济或者非市场经济地位认定标准,其反倾销机构实际执行的非市场经济地位隐性规则存在着很大程度上的不确定性和歧视性。"反倾销基本条例"关于市场经济待遇与单独待遇的现行立法和执法亦相当武断、不合理。在当前全球经济普遍低迷、特别是欧洲深陷债务危机的大背景下,欧盟反倾销法中的非市场经济制度日益暴露出其贸易保护主义的本质目的与天然属性。
