对法律人才素质教育的思考

时代的发展,知识经济的到来,使素质教育成为当今各国教育界关注 的热点问题。素质教育的目标是培养具有创新能力、全面和谐发展的人。法律工作 者特殊的工作性质要求法律人才必须具备较常人更高的综合素质,而这首先依赖于 教育工作者自身素质的提高。为此,应改革我国法律高等教育的现状,以适应２１世 纪社会对法律人才的需要。     

论德国法律保留原则的要义

１９世纪末德国行政法学者奥托·梅耶首创法律保留原则,意指一些特定事项必须由法律予以规定,行政行为若无法律依据,不得为之。这一原则是建立在民主原则和法治国原则的基础上的。它在德国宪法上具有重要地位。法律保留原则旨在限制行政权、保护人民的基本权利,它是依法行政原则的一个重要的次原则。

高等教育国际化以一种不可抗拒的力量骤然兴起,要求大学重新审视自己的定位。大学综合实力由多重因素构成,而大学软环境作为大学的内在品质,更是推动大学持续、深入发展的根本性力量,也是高校竞争中更具有决定性的核心因素,对大学的生存和发展起着至关重要的作用。建设一流大学,不仅需要加大硬件投入,更需要采取切实可行的有效措施,精心培育一流的软环境。     

Cultural Orientations, Daily Activities, and Adjustment in Mexican American Youth

The links between youth’s daily activities and adjustment and the role of cultural practices and values in these links were studied in 469 youth from 237 Mexican American families. In home interviews, data on mothers’, fathers’, and two adolescent-age siblings’ cultural practices (language use, social contacts) and values (for familism, for education achievement) were collected, along with data on youth risky behavior and depressive symptoms. In 7 nightly phone calls, youth reported on their day’s free time activities (i.e., sports, academics, religious activities, television viewing, and hanging out). Analyses revealed that youth who spent more time in unsupervised hanging out reported more depressive symptoms and risky behavior, and those who spent more time in academic activities reported less risky behavior. Results also indicated that more Anglo-oriented youth spent more time in sports, that more Mexican-oriented youth spent more time watching television, that fathers’ familism values were related to youth’s time in religious activities, and that parents’ educational values were linked to youth’s time in academic activities. Some evidence indicated that parents’ cultural practices and values, particularly fathers’, moderated the links between daily activities and youth adjustment.

African American Adolescent Engagement in the Classroom and Beyond: The Roles of Mother’s Racial Socialization and Democratic-Involved Parenting

Previous research has explored how differential youth outcomes are associated with racial socialization and parenting style individually, but very little work has examined whether democratic-involved parenting style bolsters the positive link between racial messages and adolescent outcomes. The purpose of this study was to examine mothers’ use of democratic-involved parenting as a moderator of the association between racial socialization (e.g., racial pride, racial barrier, and self-worth messages) and youth engagement. The types of engagement explored were attitudes toward class work and persistence on task. Ninety-four African American youth (ages 11–14) reported on maternal style and socialization. As predicted, racial barrier socialization was positively associated with engagement among adolescents who perceived their mothers to provide more involvement coupled with opportunities for their teens to make decisions. In contrast, barrier socialization and engagement were negatively associated among adolescents who viewed their mothers as low in democratic-involved parenting. Implications for adolescent engagement and for research on racial socialization and democratic-involved parenting style are discussed.

"两个转换"是高校思想政治课教学的基本矛盾

“教材体系”与“教学体系”、“教学体系”与“学生能力——素质体系”之间的矛盾是高校思想政治理论课教学的基本矛盾。要解决这一基本矛盾,提高高校思想政治课教师的教学能力与教学效果,就需要创新教学体系,实现从“教材体系”向“教学体系”的转换以及从“教学体系”向“学生能力——素质体系”的转换,即实现“两个转换”。     

Performing the Filipina “mail-order bride”: Queer neoliberalism,affective labor,and homonationalism

The 2005 video/performance art piece, Always a Bridesmaid, Never a Bride, by the Filipina American performance-art ensemble, the Mail Order Brides, examines the role of affective labor in constituting gay marriage as a form of US homonational belonging. In a contemporary context of capitalist globalization, Always a Bridesmaid, Never a Bride critiques the subjugation of the third-world woman worker within a queer neoliberal logic, highlighting the inability of the mainstream US LGBT movement to address issues of race, migration, and labor. The Mail Order Brides enact forms of feminist camp and ethnic drag to denaturalize the affective labor that is embodied within the figure of the Filipina “mail-order bride.” In doing so, Always a Bridesmaid, Never a Bride links an analysis of transnational Filipina labor with a critique of queer cultural politics in the US In its critique of queer neoliberalism, Always a Bridesmaid, Never a Bride builds on and contributes to queer of color social movements committed to racial and economic justice.     

Constructing “Hmong American Youth”: A Critical Discourse Analysis of 25 Years of Academic Literature on Hmong American Youth

Hmong American youth have been in the United States for 40 years, and yet research still suggests a binary portrayal of their experiences—model minorities or struggling delinquents. In this study, we use critical discourse analysis to examine academic literature and the construction of “Hmong American youth.” We examine academic literature discursive practices and power in controlling the discourse on Hmong American youth and shaping practices and policies. Using critical discourse analysis, we call attention to academic literature and its power, and challenge researchers to reconstruct a more complex discourse of Hmong American youth that captures their histories, possibilities, and desires.
