反商业贿赂:在缺失中寻求完善——从"进场费"事件说起

商业贿赂是依附于市场经济的顽疾。随着我国经济的发展,商业贿赂在各行各业逐渐呈现出蔓延的趋势,成为了制约我国经济发展、吞噬改革开放成果的一颗毒瘤。近年来,我国政府也加大了对商业贿赂的打击力度,采取各种措施惩防并举,取得了一定的成效。但在复杂多变的商业贿赂形式面前,反商业贿赂的手段略显薄弱。本文从分析反商业贿赂中存在的弊端入手,对如何更好地惩治商业贿赂提出一些见解和对策,以期推动我国反腐败斗争更加深入地开展。     

抗衰延寿液延缓黑腹果蝇衰老的实验研究

目的:探讨补肾活血法延缓衰老的作用.方法:抗衰延寿液分为大、中、小剂量组,含药量分别为40,20,10 ml/kg,加入基础培养基中,并以基础培养基为对照组,观察其对果蝇寿命、生殖力、飞翔能力、耐寒能力的影响.结果:抗衰延寿液能够延长果蝇寿命,提高果蝇生殖能力、飞翔能力和耐寒能力.结论:抗衰延寿液能够延缓果蝇的衰老.     

When finding nothing may be evidence of something: Anti-forensics and digital tool marks

There are an abundance of measures available to the standard digital device users which provide the opportunity to act in an anti-forensic manner and conceal any potential digital evidence denoting a criminal act. Whilst there is a lack of empirical evidence which evaluates the scale of this threat to digital forensic investigations leaving the true extent of engagement with such tools unknown, arguably the field should take proactive steps to examine and record the capabilities of these measures. Whilst forensic science has long accepted the concept of toolmark analysis as part of criminal investigations, ‘digital tool marks’ (DTMs) are a notion rarely acknowledged and considered in digital investigations. DTMs are the traces left behind by a tool or process on a suspect system which can help to determine what malicious behaviour has occurred on a device. This article discusses and champions the need for DTM research in digital forensics highlighting the benefits of doing so.     

浅析我国的反垄断法

反垄断既是一个法律问题,也是一个复杂的经济学问题。而反垄断法作为规制有关垄断问题的基本法律规范,既蕴含着普遍的法价值,也包含着特有的经济学价值。文章以此为思路对我国反垄断法的若干问题进行初步的分析,包括反垄断法的历史实践、基本概念、本质特征、经济学理论基础、现状等。     

论中国共产党对阎锡山集团的统战策略

中国共产党与阎锡山集团的抗日民族统一战线,在全国抗日民族统一战线中成立时间最早、存续时间最长、影响最大、成果最丰硕。这个统一战线之所以会取得如此大的成绩,原因固然是多方面的,但其根本原因就在于中国共产党运用了正确合理、灵活多样的统战策略：一是“内方外圆”的统战策略、二是“旧瓶装新酒”的统战策略、三是公开工作与秘密工作相结合的统战策略。本文就这三个策略作一较全面、深入、科学的分析和研究,使人们从中充分领略到中国共产党在统战工作中的高度智慧和卓越艺术。     

关于反规避措施合法性的几点思考

国内学普遍对反规避措施的合法性持否定观点。但本以为,面对规避反销措施的行为,反倾销法律需要也应该作出及时和恰当的反应,以捍卫贸易自然化所取得的成果。因此,从本质上看,反规避措施不仅符合ＧＡＴＴ和ＴＷＯ所确立的公平竞争原则,而且也符合其;宗旨。     

恐怖主义犯罪调查程序与人权保障研究--基于我国《反恐怖主义法》相关问题的探讨

对恐怖主义犯罪的调查程序面临着保障国家安全与保障公民个人权利、行政权与司法权、实体正义与程序正义的价值冲突，在立法和司法实践中必须对以上三种冲突予以平衡。尤其要重视为过度构建保障国家安全而导致行政调查权力的扩张滥用、实体正义凌驾于程序正义之上，以及忽略司法权对人权保障的救济机制等问题的出现。     

Anti-forensic resilient memory acquisition

Memory analysis has gained popularity in recent years proving to be an effective technique for uncovering malware in compromised computer systems. The process of memory acquisition presents unique evidentiary challenges since many acquisition techniques require code to be run on a potential compromised system, presenting an avenue for anti-forensic subversion. In this paper, we examine a number of simple anti-forensic techniques and test a representative sample of current commercial and free memory acquisition tools. We find that current tools are not resilient to very simple anti-forensic measures. We present a novel memory acquisition technique, based on direct page table manipulation and PCI hardware introspection, without relying on operating system facilities - making it more difficult to subvert. We then evaluate this technique's further vulnerability to subversion by considering more advanced anti-forensic attacks.     

Dispossession and disalienation: The fulfillment of life in Ursula LeGuin's The Dispossessed

In The Dispossessed, Ursula LeGuin imagines a non‐authoritarian society that privileges freedom and centers the individual's realization of her creative potentials in social context as the means to achieve the highest functioning, least repressive society. The concept central to this imagination of freedom and the ‘good life’ as expressed in her anarchic vision is that of disalienation, in the Marxist sense. In theorizing an anarchic society, whether or not a particular aspect of social organization is disalienating becomes for LeGuin the key criterion for assessing and determining the human efficacy of, in particular: the organization of work; the relationship between self, society, and nature; and the distribution of both social responsibilities and resources. This paper explores how LeGuin measures the alienating effects of a range of socio‐economic institutions, practices, and bodies of knowledge—from how we organize work, to how we establish the state and its governing power, to how we think about time—highlighting her critique of the alienating structures of our culture and the way they curtail human creativity and disarm individuals from developing freely and fully, that is, in a way that would benefit society as a whole and promote individual happiness.
