Domestic violence cuts across all demographic groups. The factors related to why police officers arrest in some domestic violence situations but not others have been often studied. Little research, however, has been conducted on the arrest views of rural police officers. One hundred seventy line officers in six rural Midwestern counties were surveyed to determine the impact of officer personal characteristics and agency type on arrest decisions in various hypothetical domestic violence scenarios. First, the same situational factors appeared to be important in shaping the arrest decision in domestic violence calls of rural officers as have previously been found with urban officers. Second, the characteristics of officers and the type of agency had some impact on the likelihood of arrest, particularly if there was evidence of a physical assault. Third, the presence of evidence of a physical assault helped shape the arrest decisions of rural officers. Fourth, situational factors were more important than officer characteristics and the type of agency. Nancy Hogan and Shannon Barton contributed equally to the paper. Gunshot residues (GSR) are an important forensic trace in firearm-related events. Currently, routine GSR analyses focus on the detection and characterisation of the inorganic components (IGSR). The increasing prevalence of heavy metal-free ammunition challenges these current protocols and there is an increasing interest in how the organic components of GSR (OGSR) can provide complementary information. Similar to the situation with IGSR, OGSR compounds originally deposited on the shooter during the firing process may further be transferred onto another individual or surface. Hence, the aim of this study was to provide additional information regarding the risk of a secondary transfer of OGSR. Two scenarios were investigated, the first one related to the arrest process and the possibilities of a secondary transfer arising between a shooter onto a non-shooter (e.g. between a police officer and a person of interest (POI)). The second scenario concerned the transfer of OGSR onto the non-shooter after handling a firearm for few minutes without discharging it. One calibre was chosen, the .40 S&W calibre, used by several Australian State police forces. A secondary transfer was observed in all cases for the two scenarios investigated, for three compounds of interest: ethylcentralite (EC), diphenylamine (DPA), N-nitrosodiphenylamine (N-nDPA). The firearm handling scenario resulted in a larger secondary transfer to that of the arrest scenario. Overall, the amounts of OGSR detected on the non-shooter were generally lower than that detected on the shooter and controls after the arrest scenario. The results of this study provide complementary knowledge about OGSR, which can be further used to improve the current practice and the interpretation of OGSR evidence. In particular, it highlights that the secondary transfer proposition must be considered during the interpretation of forensic findings, especially when small amounts of OGSR target compounds are detected.  相似文献

Public policy is often concerned with the size and characteristics of special populations that are difficult to reach in household surveys. Chronic drug users, who often live outside conventional households, provide the illustration motivating this paper. An alternative to household surveys is to question chronic drug users where they congregate—jails, treatment programs, and shelters, for example. Using such opportunistic data for prevalence estimation raises difficult problems for statistical inference: Study subjects who arrive at the collection points cannot be deemed a random sample of the general population. However, if we could estimate the rates at which chronic drug users arrive at the collection points, then we could use those estimates to weight the sample to represent the population. This paper presents a modified Poisson mixture model used to estimate the stochastic process that accounts for how chronic drug users get arrested. It uses that model to estimate arrest rates for 38 counties using up to sixteen quarters of data from the Arrestee Drug Abuse Monitoring survey.

At the closing of the 20th century, Europe decided the time was ripe to take bold steps towards the creation of a truly integrated European judicial space. Of its overall goals for the new millennium, judicial integration ranked at the top as this reflected shifting global challenges in an increasingly diversified world. After more than a decade, the reality is still that of a policy area in which multiple practices of cooperation coexist. Indeed, political and cultural factors matter in explaining how judicial decisions and practices are harmonised and integrated by EU member states. The article focuses on a number of socialisation mechanisms adopted by the EU to build mutual trust among national authorities and also looks at the European Arrest Warrant as an important test bed of the strengths and weaknesses of European judicial cooperation.  相似文献

Research Summary: Mandatory and pro‐arrest policies in domestic violence incidents have increased strains on prosecutorial and court resources. They have also brought to prosecutors many cases in which victims never wanted batterers charged and prosecuted. Prosecutors are faced with the dilemma of (a) screening out difficult cases up front and expending resources on fewer but more winnable case or (b) prosecuting a larger number of cases as adequately as resources will allow. We studied a natural experiment that resulted when the Milwaukee prosecutor liberalized his screening policy to double the number of domestic violence case filings. After the new screening policy was implemented, time to disposition doubled, convictions decreased, the prevalence of pretrial crime increased, and victim satisfaction declined. Policy Implications: The results do not support the idea that domestic violence cases can be readily prosecuted without regard for victim desires. To commit to such a policy would require a substantial commitment of additional staff, resources to collect additional types of evidence, and a willingness to try a substantially larger number of cases.  相似文献

通过对2018年和2014年基层法院审理的有争议刑事案件判决书的抽样调查,并在一系列核心指标上进行对比研究,发现以审判为中心的刑事诉讼制度改革启动四年来,除了在辩护指标上有明显好转外,在证人、鉴定人出庭率等核心指标上,2018年的数据与2014年的数据相比并未观察到明显变化。以审判为中心改革的实际效果有限。究其原因,在以"案卷"为中心的审判认知结构和"副卷"集中反映的判决权威结构未发生根本性改变的情况下,改革的实际空间十分有限。深化以审判为中心改革,需要解决好以"两卷"问题为代表的审判认知结构和判决权威结构的问题。为重塑审判认知结构,需要弱化案卷在审判中的作用,强化被告人的对质权;为重塑判决权威结构,需要合理确定院庭长的"审判监督"与法官依法独立公正履行审判职责之间的界线。以审判为中心改革的深入推进,会引发审前阶段的连锁反应,客观上强化检察机关指导和控制侦查人员取证行为的合理需要。目前检察机关内部的"捕诉一体"化改革是这种诉求的反映。然而,满足这种需要的正确路径应当是加强"侦诉一体"化。  相似文献
