Managerialism Meets Regime: A Distinctively Singaporean Marriage?

Managerial reforms were once assumed to be apolitical, and hence universally applied to various political settings. This assumption has been widely contested; some argue that managerial reforms are not applicable to countries outside what are termed Western liberal democracies, due to differing political contexts. The case of Singapore offers a counter-argument to these claims—managerial reforms were well-received in the state and its bureaucracy; both of which were vastly different from those of liberal democracies. The article further argues that this was not a coincidence; there seem to be salient reasons why managerial reforms were able to ‘marry’ Singapore's regime. This case study offers insights vis-à-vis a broader question: whether and how managerial reforms can be justified within and received in differing political contexts. It seems imperative to address this question, given the implications for future scholarship and how managerialism is a significant matter of concern to many governments worldwide.

中日两国都是当今世界上经济法最为繁盛的国家。两国的经济都经历三个非常相似的阶段,两国的经济法立法相应地分为三个阶段。纵观中日两国经济法立法史,中、日两国都十分重视经济法立法,强调政府对经济发展的主导作用,立法赋予了政府较多市场规制权限,“强政府”形象凸显于市场。但是,二者之间的差异也是十分明显的。中国的经济法学研究在短短的二十年之内经历了模仿、引进阶段,逐步形成了独具特色、成熟的经济法理论体系,流派纷呈。在日本,经济法学界的分歧较小,普遍认为反垄断法是经济法的核心和基本内容。     

A Study of the Predictors of Persistence in Stalking Situations

Stalkers engaging in persistent campaigns of harassment have the potential to cause immense harm to their victims and themselves. Being able to estimate which stalkers are likely to persist longest is important to clinicians dealing with both perpetrators and victims. This study of 200 stalkers investigated characteristics of the stalkers and their behaviour that were associated with increased persistence. Logistic regression models were developed to predict low, moderate, and highly persistent stalking. The results supported previous research indicating that the type of prior relationship between stalker and victim is strongly associated with persistence, with prior acquaintances the most persistent, and strangers least. Being aged over 30, sending the victim unsolicited materials, and having an intimacy seeking or resentful motivation was also associated with greater persistence, as was the presence of psychosis.

Relativierung des Rechts durch Digitalisierung

Das Recht ist in modernen Gesellschaften ein wichtiges Steuerungsmittel. Schon bisher ist es allerdings nicht das einzige Instrument gewesen, um gesellschaftliche Entwicklungen und individuelles Verhalten zu beeinflussen. Es gab und gibt Bereiche, die sich selbst organisieren und in denen staatliches Recht aus unterschiedlichen Gründen nicht das entscheidende Steuerungsmittel ist. Dieser Beitrag untersucht, wie sich die zunehmende Digitalisierung der modernen Gesellschaften auf die Steuerungsfähigkeit des Rechts auswirkt. Er kommt dabei zu dem Ergebnis, dass die Bedeutung des Rechts in der digitalisierten und hoch fragmentierten Welt abnimmt. Das Recht muss sich deshalb Verbündete in anderen Bereichen der Gesellschaft suchen, um weiterhin Steuerungsfunktionen für die Gesellschaft wahrnehmen zu können. Der Beitrag skizziert, wer als Verbündeter des Rechts in Frage kommt und wie die notwendigen transrechtlichen Kooperationen aussehen könnten.     

Business to the rescue: private sector actors and global environmental regimes’ legitimacy

In 2006, Parties to the Convention on Biological Diversity (CBD) adopted decision VIII/17 to further involve the private sector in the activities of the Convention. This initiative mainly aims at improving the current regime’s legitimacy. By increasing business involvement, decision VIII/17 can be viewed within the context of the current academic debate on the ‘privatisation’ of environmental governance, which refers to the growing importance of private actors in the formulation of environmental policies. Against this background, this article aims at: (1) assessing the extent to which decision VIII/17 might reverse the CBD’s legitimacy crisis and (2) analysing the issues at stake when private sector actors are involved in environmental regimes. In order to do so, the article analyses the consequences of decision VIII/17 in terms of internal—representation and transparency—and external—institutional efficiency and implementation—legitimacy. The study is based on an extended empirical scrutiny of the negotiations linked to decision VIII/17. While adopting a general conceptualisation of legitimacy, the value added by the study is to broaden the usual understanding of business strategies towards environmental issues. In particular, this article shows how decision VIII/17 has generated several reactions—defensive as well as proactive—among the business community. At the practical level, the article proposes several recommendations to secure a constructive participation of all categories of business actors in biodiversity governance. At the theoretical level, it calls for a change in deterministic visions of economic actors’ interests.
