新世纪中国西部发展与公共管理学的使命

研究领域和范围偏狭,西部发展问题公共管理研究的缺席,是我国公共管理学存在的严重缺陷。拓展公共管理学的研究视角,关注西部地区的发展问题,探索适合西部地区的公共管理模式,在西部地区现代化进程中发挥应有的作用,是21世纪中国公共管理学的重要历史使命。公共管理学应该在与其他学科进行对话的基础上,立足于西部地区公共管理环境,研究以政府为核心的公共部门如何对该地区多民族传统文化的保护与管理,对自然生态环境的保护与管理,对公共产品的提供与管理,对民族关系的协调与管理,以及加强危机管理研究,为西部地区经济建设与政治体制改革创造良好的公共管理环境发挥独特作用。     

The use of seclusion in the Netherlands compared to countries in and outside Europe

The use of seclusion in psychiatric practice is a contentious issue in the Netherlands as well as other countries in and outside Europe. The aim of this study is to describe Dutch seclusion data and compare these with data on other countries, derived from the literature. An extensive search revealed only 11 articles containing seclusion rates of regions or whole countries either in Europe, Australia or the United States. Dutch seclusion rates were calculated from a governmental database and from a database covering twelve General Psychiatric Hospitals in the Netherlands. According to the hospitals database, on average one in four hospitalized patients experienced a seclusion episode. The mean duration according to the governmental database is a staggering 16 days. Both numbers seem much higher than comparable numbers in other countries. However, different definitions, inconsistent methods of registration, different methods of data collection and an inconsistent expression of the seclusion use in rates limit comparisons of the rates found in the reviewed studies with the data gathered in the current study. Suggestions are made to improve data collection, to enable better comparisons.

Culture and Negotiation: The Pedagogical Dispute Regarding Cross-Cultural Simulations

This article examines one especially challenging aspect of active-learning international studies courses—the use of cross-cultural simulations. What is the significance of culture for negotiation? What difficulties might cross-cultural negotiations pose, and how might negotiators work with cultural differences to achieve successful outcomes? Is it possible to model the effects of cultures on negotiators in a classroom role-play? What are the advantages to using cross-cultural simulations, and what difficulties do they entail? How might an instructor make best use of materials that focus on cultural issues and their effect on negotiation? When teaching students of different cultures by active-learning methods, what ought an instructor to bear in mind? What cross-cultural simulations are available, and what readings might be assigned to accompany them?

Issues and crisis management in a convergent environment

Increasingly issues and crisis management are occurring in an interactive environment in which activists use online communications and networks to attack organisations and promote campaigns. This paper outlines examples of such developments and suggests that there is a still a need to consider them within the context of the overall social and economic environment as well as from a technological viewpoint. 无担保国际融资基本法律问题研究——兼评我国策略选择

无担保国际融资因缺乏担保而具有特殊性。投资者保护、信用控制、风险管理是无担保国际融资法律调整中的重要法律问题,其中对欧洲债券尚有一些误解需要澄清。针对立法明显滞后的现状,我国宜从市场与监管两方面着手,多角度防范风险,充分肯定无担保国际融资积极作用、谨慎而适度地借鉴国外经验以完善法制、提高监管者素质,从而分步骤、有侧重地推进无担保国际融资在我国的健康发展,避免中航油事件等类似情况发生。     

当前社区警务工作存在的问题及对策

当前,我国社区警务工作存在一些问题。其主要原因是:社区警务固守传统观念,缺乏创新;社区警务、社会治安综合治理和社会治安防控体系三者之间在理解、运作中存在一些矛盾;社区警察职责权限范围和参与社会管理范围较小,不利于社区警务的运行。社区警务的核心价值是:提高社区公众的生活质量,减少犯罪对社区公众生活的影响,警察与社区公众相互协作、配合,共同化解产生犯罪和影响社区生活质量的各种不利因素。应改革和强化社区警务,摆正社区警务在公安工作中的位置,加强社区警务培训,社区警务与社区自治相结合,完善社区警务执法手段。     

关于人民警察使用警械若干问题的反思

文章总结了当前人民警察在执法实践中使用警械存在的滥用、误用以及被动甚至放弃使用等各种问题,对产生这些问题的成因进行了深入分析,并给出了解决问题的相关对策。     

中国劳动关系研究70年回顾与展望

中国劳动关系研究植根于本国历史经验、道路实践和国情社情,经过70年来五个阶段的发展,已经形成了中国特色的劳动关系理论体系,即借鉴西方的劳动关系制度,但摈弃了把劳动关系看成是纯粹的经济关系、单纯用产权规则解决纠纷的思维。该理论体系认为,劳动关系中包含了政治关系,劳动关系双方在根本利益上是一致的。因此,劳动关系领域的矛盾,是根本利益一致基础上的具体利益差别的矛盾,属于人民内部矛盾。由此形成了国家主导的中国劳动关系治理体系的"四梁八柱"。当前,劳动力市场结构发生了基础性转变,经济发展已经由高速增长阶段转向高质量发展阶段,互联网平台经济的快速发展促进了各种新就业形态不断涌现,这些变化必然会带来劳动关系的变化和劳动关系研究的新议题。
