论合同治理和关系治理的互补性与有效性   总被引:3,自引:1,他引:2  
正式的合同治理与非正式的关系治理是互补性的。相关研究通常将关系治理和合同治理看作是可替代性的,因为信任能降低交易成本,也能够替代正式合同的刹手闸作用。研究表明:合同治理不仅不会阻止关系治理的发展或者成为关系性治理的替代者,相反,良好的、详尽的合同实际上会提升交易各方间长期的、合作性的信任关系;良好的合同缩小了与交易相关的风险范畴,并降低了其严重性,因而会鼓励和促进合作与信任关系的发展;良好的合同通过强化对有关交易的风险,如道德风险的惩罚,有助于长期交易关系的发展;关系治理也有助于合作者间发展出有关处理不确定性的柔性规则和程序,当不可预见的事件发生后,有助于合作伙伴间的相互调适,从而维持双方的交易关系,并因此提高交易效率。  相似文献

匿名评审、年龄界限和一刀切三种现象看似毫不相关,但是其内涵却存在着一种共性,即凭借一种貌似客观的技术、数字和理性规则来实行管理,希望以此来克服管理过程中个人主观因素和其他不确定因素的影响.这种管理模式可以称之为非人格化管理,它产生于不信任文化的背景之上,相信技术而不相信个人的能动判断.这种管理模式落后于民主化和人性化的社会进程,必须用一种信任管理模式来替代它,重构和谐、创造、能动的管理关系.信任管理以人为中心,强调负责任的个人对公共政策的主动执行;信任管理是充分授权的管理,并不是完全依赖技术的控制力来实现集权化从上到下的管制;信任管理也是开放的管理机制,吸收环境中的支持力和压力要素,与环境展开积极的互动.信任管理是和谐社会的管理机制.  相似文献

Law students prepare for a legal career and it is therefore of general interest, how much trust they have in the police and the courts. Their views may be influenced by their studies, media consumption, direct experience and other factors. In a previous study it appears as if law students are becoming more critical over the course of their studies. This explorative questionnaire study compares the views of 2012 final year undergraduate law students with the answers the same cohort gave in 2010, when starting their studies, and with final year law students 2010. Contrary to our expectation, the final year law students of 2012 showed more trust in courts and police than their predecessors 2010. The data suggest that the study of law, personal experiences and those of family and friends, as well as media effects are among the factors forming trust in the institutions.  相似文献

可追溯机制在食品质量和药品安全的公共治理中逐渐浮出水面,成为2007年流行的治理模式创新.这一机制主要是一个信息记录的体系,包括了生产者、流通者、消费者和政府监管者四方面要素在内.形成了一个产品循环的网络图.这一机制就是要建立全方位的信息跟踪机制,以产品质量电子监管网为基本栽体,及时追溯每个产品的产地、时间以及其他各方面的信息,一旦出现质量和安全问题, 可以及时追溯主要责任人,让该责任人来承担相关责任.该机制的逻辑是以信息、风险和信任三大要素为基础,并根据这三大要素建立起相应的信息风险责任机制.这一机制对地下市场的治理也有着重要作用.  相似文献

Ethics constrains us. But ethics can also act as an ‘enabler’, helping to secure compliance with public policies. Basing policies on ethical principles helps the public know what is required of them by public policies. Framing policies in those ways also primes people to think in terms of their own ethically based reasons for action. Basing policies on ethical principles can assist in securing the cooperation of potential veto players by creating cooperative norms and a culture of trust.  相似文献

This article examines the relationship between the trust in leadership of political leaders and citizen participation by analysing data on Tokyo residents. Among the four variables we used to designate types of, or attitudes towards, public participation, only actual participation has a positive influence on trust. The normative recognition of participation is associated with a critical attitude towards the government. As the unclear needs of citizens have the greatest impact on trust, citizens’ trust is built through relationships between citizens and not between citizens and their government. The importance of positive actions from the local government such as public officials and political leaders that stimulate citizen awareness to the point where citizens take interest in public administration, practice participation, and enlarge participation opportunities, is increasing. We also need to consider the limitations of citizen ability to understand public issues and reflection of their needs, and the limitations of participatory governance on the decision-making process.  相似文献

This article puts forward a comprehensive framework for explaining the complex and dynamic relationship between trust in the domestic government and trust in the EU, considering time, country and individual-level variation. Using longitudinal comparative data from 32 Eurobarometer survey waves (2004–2018), we first establish that the link between attitude formation at the national and the EU supranational levels is present over time. Second, we show that during ‘extraordinary’ times of crisis the strength of that relationship intensifies. Third, we posit that the European sovereign debt crisis changed the mechanism for this relationship in two ways: during ‘extraordinary’ times, the link is much stronger in countries hardest hit by the crisis, and the relationship holds independent of individuals' political sophistication across all countries. Our findings have implications for understanding the drivers of EU support and theories of institutional trust.  相似文献

For decades, research on democracy has produced evidence that the peoples of countries in Central Europe are less satisfied with the way democracy works in their countries than people in Western Europe. Using the data from the European Social Survey (ESS) I explore, how satisfaction with the way democracy works (SWD) changed in these countries between 2004 and 2014 and test the impact of satisfaction with the present state of the economy and trust in parliament on SWD. Results of the analysis reveal that people in Central Europe are still less satisfied with the democratic performance on average than people in Western Europe, but their satisfaction is on the rise especially in countries where the economy performs well, economic performance brings better standard of living, and people share a sense of economic optimism. Results also suggest that in countries where economic optimism is low, political evaluations of “crises in democracy” may play a larger role in explaining satisfaction with democratic performance.  相似文献

This article explores the relationship between Internet use and the individual-level production of social capital. To do so, the authors adopt a motivational perspective to distinguish among types of Internet use when examining the factors predicting civic engagement, interpersonal trust, and life contentment. The predictive power of new media use is then analyzed relative to key demographic, contextual, and traditional media use variables using the 1999 DDB Life Style Study. Although the size of associations is generally small, the data suggest that informational uses of the Internet are positively related to individual differences in the production of social capital, whereas social-recreational uses are negatively related to these civic indicators. Analyses within subsamples defined by generational age breaks further suggest that social capital production is related to Internet use among Generation X, while it is tied to television use among Baby Boomers and newspaper use among members of the Civic Generation. The possibility of life cycle and cohort effects is discussed.  相似文献
