Private Security: Enforcing Corporate Security Policy Using Private Investigators

This article focuses on the use of private investigators as external agents, commissioned to enforce internal corporate security policy. After describing the sorts of services private investigators provide to industry and commerce and the legal contexts within which they operate, it considers private investigators as a form of secret police within private justice systems defined by companies. It considers the relationship between notions of public good and commercial expediency and raises important questions about the problem of controlling activities which are purposefully kept from legal scrutiny.

制度运行伦理作为制度伦理的一个重要方面,与制度设计伦理是有所不同的。它本身包含着的价值原则和道德基础与和谐社会具有同构性与一致性。作为和谐社会构建的主要组成方面,和谐社会对制度运行伦理的价值诉求体现在三个方面：社会结构层面——合理、政治层面——民主、经济层面——公平正义。     

The Subject May have Disappeared but its Sufferings Remain

Today there is no sophisticated theory, which continues to rely on subjectivist premises. It is important, however, that anti-humanism theory's disinterestedness in the (imaginary) subject of voluntarism does not lead to an indifference towards being's constitutive non-essence and passivity in the manner of the worst kind of humanism. Emmanuel Levinas' places ‘absurd’ suffering in the place of essence as the knot of subjectivity; his view of the quiddity of suffering as mode of being passively rather than as psychological content and of the modality of disinterested compassion are used in order to formulate the question `who comes after the subject' in ways which allow us to continue thinking of what it means to be affected in an individuated manner without returning us to the subject of self-presence and autonomy. 制度伦理教育的合法性审视

制度伦理教育是指致力于使人认可、内化并践行契约伦理的教育.在我国,随着市场经济的发展,罗尔斯正义理论在教育界的影响日益深远等,它已经悄然兴起.合法性判断是对事物是否符合社会、时代发展的一个最基本的判断,所以对制度伦理教育进行合法性判断是非常必要的.道德教育合法性判断的依据包括道德伦理合法性判断的依据和道德教育方式方法合法性判断的依据.前者具体可分为民意、文化传统和超越三重依据;后者具体可分为尊重常识道德、教育者"言行一致"、旨在于使人向善、有效性四重依据.以这些依据作为评判的标准,不难发现制度伦理教育尽管有很多地方值得我们去借鉴,但它并不具有很强的合法性基础,它的兴起不能实现其已有的承诺.     

Predicting Competitive‐Unethical Negotiating Behavior and Its Consequences

This study examines the relationships between negotiators' attitudes toward competitive and unethical tactics, their actual use of those tactics, and their subsequent perceptions of performance and reputation in two‐party, e‐mail‐based negotiations. The results indicate several predictors of competitive‐unethical behavior, including a negotiator's attitude toward competitive‐unethical tactics, early use of competitive‐unethical tactics, and the behavior of a negotiating counterpart. Furthermore, it was the perceived honesty of one's counterpart rather than the actual use of competitive‐unethical behaviors that was associated with a negotiator's perceptions of the collective or joint outcome. The implications of these findings are discussed, along with suggestions for future research.

对改变道德成本逆向走势倾向的探讨

改革开放以来,我国公民道德建设取得了巨大的成绩,但也存在着不少问题。其中最根本的原因就在于道德生活领域存在着道德成本逆向走势的倾向,导致人们对践履道德心存疑虑,甚至敬而远之。必须采取有力的措施改变道德成本逆向走势的倾向,公民才会自觉践履道德行为,公民道德建设才能真正取得实效。
