高职院校“基础”课教学考核与评价方式改革研究

《思想道德修养与法律基础》作为高职院校思想政治理论课的入门课程,承担着对大学生进行思想政治教育的重任。目前,该课程在教学实践中存在着教学形式僵化、考核评价方式死板等问题。为改变这一现状,可以在推行课堂教学改革、落实课程实践环节的基础上,通过完善考核内容、调整分数比例、设置教学评价等级等方式,进行考核与评价方式的改革。     

哈耶克自由主义法哲学思想研究

法哲学是法治时代政治文明精华的体现,法治时代是一个迈向权利的时代,更是一个迈向自由的时代,自由当是我们时代精神最为集中的体现。哈耶克批判地继承了前述理论家们对法律与自由关系的论述,总结前人的思想,艰苦钻研得出了自由就是法律的目的的精辟结论,哈耶克坚信法就是作为理念的自由。他的所有的对于法治理论的论述都是为了"自由"这个目的而准备的。虽然哈耶克是以一个资本主义制度顽固的捍卫者身份登上历史的舞台,但是他对待学术所表现出来的鞠躬尽瘁的态度和为现代法治研究探索做出的努力还是值得所有学者肯定和赞赏的,并且为我国正处于改革时期的法治建设提供了理论依据,深入研究哈耶克的自由主义法哲学思想,无论在理论上还是实践上、无论是对全世界的公民们还是对法哲学思想家们,这都是意义重大的。     

多式联运：关于当代法律的评论

德国运输法的改革法案于 1998年 7月 1日生效。新法最主要的变化是为国内的各种货物运输方式 ,包括公路、铁路、内水和航空运输 ,制定了一套相同的法律规则 ,同时第一次为多式联运制定了规则。本文主要以德国法为对象 ,同时比较中国、荷兰和法国法 ,论述多式联运合同的定义 ,适用法律 ,责任限制等问题。     

Finding the missing and unknown: Novel educational approaches to warming up cold cases

In recent years, students in police academies and higher education institutions around the world have worked together to analyse cold cases including long-term missing persons cases in collaboration with investigators and prosecutors. In 2020, three European organisations, the Police Expert Network on Missing Persons (PEN-MP), AMBER Alert Europe and Locate International, succeeded in connecting these educational organisations enabling them to work collectively on cases and conduct cold case analyses (CCA) across international borders. The International Cold Case Analysis Project (ICCAP) learning objectives were to 1) collect the necessary information about the victim, 2) reconstruct the crime, and 3) investigate trace control.In a learning objective-based evaluation using Computer-Assisted Web Interviewing, 76 participating students from the German and International ICCAP teams were asked to complete a pre- and post-review questionnaire to self-assess their personal competence development. Participants reported significant increases in competence in all evaluated areas, thus demonstrating that authentic and relevant collaborations can enrich the learning environment, promote the use of professional skills, and provide significant knowledge exchange opportunities between academia and industry.Drawing on case studies of cold case missing persons' investigations and unidentified found remains, this article shares how university academics, students and community volunteers can work together nationally and internationally to find out what has happened to missing people and how we can more effectively identify the previously unidentified. In so doing, we share the expertise required to progress these cold cases and provide recommendations to support other institutions and organisations in adopting this innovative approach.     

中日经济立法与理论研究之比较

中日两国都是当今世界上经济法最为繁盛的国家。两国的经济都经历三个非常相似的阶段,两国的经济法立法相应地分为三个阶段。纵观中日两国经济法立法史,中、日两国都十分重视经济法立法,强调政府对经济发展的主导作用,立法赋予了政府较多市场规制权限,“强政府”形象凸显于市场。但是,二者之间的差异也是十分明显的。中国的经济法学研究在短短的二十年之内经历了模仿、引进阶段,逐步形成了独具特色、成熟的经济法理论体系,流派纷呈。在日本,经济法学界的分歧较小,普遍认为反垄断法是经济法的核心和基本内容。     

Concordance Between the AmpFℓSTR® MiniFiler™ and AmpFℓSTR® Identifiler® PCR Amplification Kits in the Kuwaiti Population

Abstract:  The AmpFℓSTR^® MiniFiler™ polymerase chain reaction amplification kit, developed and supplied by Applied Biosystems, complements the AmpFℓSTR^® Identifiler^® polymerase chain reaction amplification kit (Applied Biosystems, Warrington, U.K.) by improving the success rate when profiling DNA that is degraded or contains inhibitors. Before applying the MiniFiler™ kit to casework, the profiles from 200 unrelated Kuwaitis were compared to Identifiler^® profiles. Concordance was observed for 99.875% (1598 of 1600) of the compared STR loci. The two discordant profiles displayed allelic dropout: one at the D13S317 locus due to nonamplification of allele 10 in the MiniFiler™ profile, and one at the D18S51 locus due to nonamplification of allele 18 in the Identifiler^® profile.     

Validation of the AMPFℓSTR® MiniFilerTM PCR Amplification Kit for Use in Forensic Casework*

Abstract: The AmpF?STR^® MiniFiler^TM PCR Amplification Kit is designed to genotype degraded and/or inhibited DNA samples when the AmpF?STR^® Identifiler^TM PCR Amplification Kit is incapable of generating a complete genetic profile. Validation experiments, following the SWGDAM guidelines, were designed to evaluate the performance of MiniFiler. Data obtained demonstrated that MiniFiler, when used in conjunction with Identifiler, provided an increased ability to obtain genetic profiles from challenged samples. The optimum template range was found to be between 0.2 and 0.6 ng, with 0.3 ng yielding the best results. Full concordance was achieved between the MiniFiler kit and Identifiler kit except in a single case of a null allele at locus D21S11. Numerous instances of severe heterozygous peak imbalance (<50%) were observed in single source samples amplified within the optimum range of input DNA suggesting that caution be taken when attempting to deduce component genotypes in a mixture.

§11 Abs3 NAG schafftkeine M?glichkeit der Antragstellung auf Erteilung eines humanit?ren Aufenthaltstitels. Auf Grund der Art 8 iVm 13 MRK und aus rechtsstaatlichen Erw?gungen muss neben einer Erteilung von Amts wegen auch ein Antragsrecht des in seinen subjektiven Rechten Betroffenen auf Erteilung eines humanit?ren Aufenthaltstitels vorgesehen sein.     

Wirksamkeit der Bestellung eines Verfahrenssachwalters

Die Bestellung eines Verfahrenssachwalters wird wie jene des einstweiligen Sachwalters bereits mit der Zustellung des Bestellungsbeschlusses und nicht erst mit dessen Rechtskraft wirksam. Hinsichtlich des Fehlens einer klarstellenden Regelung über den Eintritt der Wirksamkeit des Bestellungsbeschlusses ist insofern von einer planwidrigen Unvollst?ndigkeit des § 119 Au?StrG auszugehen, die durch analoge Anwendung des § 120 Au?StrG geschlossen werden kann.
