中国-东盟自由贸易区投资制度安排模式探讨

建立投资领域的制度安排对中国-东盟贸易区的建设意义重大。中国和东盟相互投资日益增长,各国的投资政策相应改善,但投资环境仍不理想。CAFTA下现有的投资制度包括中国与东盟各国的双边投资协定,CAFTA的协议和各国共同参加的世界性投资公约,但对构建CAFTA的投资法律体系远远不够。CAFTA的投资制度安排的模式可以采取多边协议、分层次的双边协议、各投资专题的多边协议的叠加等模式,各种模式都具有一定的可行性和障碍,中国应当积极推进CAFTA投资法律制度的建立,并做好前期准备工作。     

社会资本办医：准入政策和投资建议

社会资本办医是新医改的重要内容之一,国务院、卫生部、各地政府先后出台了相关政策,为社会资本办医铺平了道路。通过对全国20个省区市近年来出台的鼓励和支持社会资本办医政策的梳理与对比分析,可以发现各地鼓励发展的非公立医院大致可分为高端医疗机构、特色专科医疗机构、特需性医疗机构三种类型,鼓励社会资本办医的领域呈现＂扶弱＂和＂做强＂的两极化特点,今后社会资本办医投资应着眼高端、因地制宜。     

Sudpolitik: the political economy of Taiwan's trade with Southeast Asia

Abstract

In December 1993 the Taiwan government adopted a policy called nanjin zhengce or sudpolitik, a policy aimed at diverting part of Taiwan's trade and investment flows from China to Southeast Asia. This paper addresses the following questions: what is sudpolitik? why adopt such a policy? what are the economic, political, and strategic considerations in the pursuit of this policy? which countries are its specific targets? how do the countries directly affected by this policy respond to it? The paper also discusses the issue of Taiwan's aid in connection with sudpolitik. While the effectiveness of the policy is far from clear at present, the paper concludes with four observations: Taiwan's trade and aid are beginning to intertwine; Taiwan's diplomacy is largely economically or commercially led; Taiwan has achieved some positive results in improving its relations with Southeast Asian countries; and, Taiwan has reached a new stage in its economic development whereby it needs to invest overseas in order to sustain its economic growth. Overall, sudpolitik represents a novel step in Taiwan's diplomatic practice.     

对金融危机后我国社保基金运作策略的思考

本文收集并分析了2000-2009期间我国社保基金理事会的资金运营状况,认为社保基金的运作要平衡谨慎投资和扩大赢利能力的关系,在分析金融危机影响的基础上,对我国社保基金的运作模式提出相关建议。     

私募股权投资基金管理人准入机制研究

私募股权投资基金的隐秘性不应成为弱化其监管的理由,宽松监管必然诱发非法集资,将私募股权投资基金纳入法律规制势在必行。但其＂入法＂的切入点何在？鉴于基金管理人在私募股权投资基金主体四元结构中居于主导地位,规制基金管理人是监管基金的要害所在,其中基金管理人准入机制又是整个监管体系的前置门槛与成败关键。私募股权投资基金的二元化监管模式符合我国监管机构权力配置格局,基金管理人自愿监管应向强制注册转变,作为受托人角色的基金管理人准入标准必须趋严,披露监管主导之下应辅以实质核查,上述策略四管齐下,或许是整顿当下＂PE乱象＂,实现私募股权投资基金全面＂入法＂的可行路径。     

我国内地企业境外投资的法律风险及保护对策

境外投资面临的法律风险日益突出。文章在分析内地企业境外投资的国内外法律环境基础上,梳理了境外投资面临的三方面主要法律风险,针对现状,提出政府应及时出台《境外投资管理条例》,建立健全境外投资的法律保护体系,并阐述了企业法律风险管理模式和机制。     

Patterns of agrarian transformation in Ethiopia: State-mediated commercialisation and the ‘land grab’

Much of the literature on the ‘land grab’ has thus far focused on the international drivers of foreign agricultural investment, with far less attention paid to the roles of developing country states and domestic political economy in changing forms of agrarian production. This paper analyses how global and domestic processes combine to produce patterns of agrarian transformation in Ethiopia, one of the main targets of foreign agricultural investment. The paper presents a typology of changes in land use and examines in detail three case studies of investments in Ethiopia drawn from this typology. The paper concludes that the most dramatic changes are taking place in lowland, peripheral regions where large-scale, capital-intensive farms employing wage labour pose a serious risk to pastoralists whose ‘use’ of land is contested by the state. Although the government has been careful to avoid mass displacement of settled smallholders, there are also important changes taking place in highland areas, with the government encouraging investments that combine the resources of investors with the labour and land of smallholders. These investments have resulted in exposure to new forms of market risk.     

日本研究开发投资现状与存在问题及启示

本文研究发现，在“科技立国”政策背景下，日本研发投资居发达国家首位，但全要素生产率增长率有所下降。其根本的原因是日本研发投资成果没有得到有效利用，最终造成研发投资成果质量水平较低、专利市场的占有率有下降趋势、高科技产业附加价值收益、国际市场份额及贸易收支比下降等问题。应采取强化基础研究、充实对服务业的研究开发、发挥大学和政府的作用、推进企业、大学及政府协作、强化国际合作、确立和保护知识产权和强化知识管理等措施才有可能改变其被动局面。
