King Charls His Case: The Intended Prosecution of Charles I

Charles I was put to death without having pleaded to the charges preferred against him during his trial. This article examines the case that his prosecutor later said he would have opened, had the king entered a plea. John Cook's case was predictably forthright in its denunciation of the accused. On the other hand, it has some highly significant omissions; some of it was legally and factually hopeless, and much of the rest invited fairly obvious responses; whilst its exposition was much more contentious than one might expect from a case for the prosecution of a man whose guilt had already been pronounced ‘notorious’. Rather than simply setting out a wholly unsatisfactory indictment of the king's alleged ‘guilt’, as a mere prelude to the shedding of his blood, Cook's true aim appears to have been to goad the king into making, before the eyes of the watching world, a case in his own defence sufficient to enable the king's judges, having heard what he might have to say, and subject to ‘the merit of the Cause’, to hand down some sentence other than death - all as the Act erecting the high court of justice authorized them to do.

采用定量的研究方法,通过问卷方式,调查了高职院校大学英语教师的职业倦怠现状。发现高职院校大学英语教师的总体职业倦怠程度并不严重,但个人成就感较低;女教师的职业倦怠程度比男教师严重,情绪衰竭程度显著较高;同年龄和教龄的教师分别在情绪衰竭和个人成就感两个维度上有显著差异;双肩挑教师的情绪衰竭和个人成就感均显著高于专职英语教师;双师型和非双师型教师在个人成就感和情绪衰竭方面没有显著性差。

Mapping School Geographies

Abstract

Uncovering issues of school safety, both perceived and real, requires research that probes students' perspectives. This paper tells the story of a comparative research project initiated in an English education methods course. The study was conducted in two high schools and utilized mapping and surveying to determine students' perceptions of school safety within the context of their own campuses. The findings, with relevant strategies for using critical literacy to involve students more directly in the conversation, have implications for classroom teachers and other school-related personnel who seek site-based interventions.     

The United States — Japan relationship: A post‐cold war future

Abstract

In the introduction, the editors discuss the emergence of a new body of literature on Southeast Asia's regional relations that is both theoretically informed and stimulating. One element of this literature features a constructivist challenge to realism, traditionally the dominant perspective on Southeast Asian International Relations. Constructivist writings have helped to broaden the understanding of Southeast Asia's regional order by capturing its ideational determinants (norms and identity), the agency role of local actors, and the possibility of transformation through socialization and institution building. But constructivism itself has been challenged by other perspectives, including neo-liberal, English School and critical approaches. The essays in this special issue of The Pacific Review capture this emerging debate. The editors argue that the articles in this special issue are a good indicator of the theoretical pluralism that marks the study of Southeast Asia's regional relations today. Southeast Asian studies need not be dominated by either realism or constructivism, but can accommodate a diversity that vastly enriches our understanding of regional conflict and order.

Reconstructing Insurance Law: The Law Commissions' Consultation Paper

In July 2007 the English and Scottish Law Commissions published the consultation paper Insurance Law – Non-disclosure and Breach of Warranty (hereafter LCCP) which sets out in detail the Commissions' provisional proposals for the reform of insurance contract law with particular reference to the key areas of utmost good faith, warranties and agency. This article analyses, from a critical standpoint, the LCCP's principal conclusions and recommendations. It begins by noting, as a means of demonstrating that the current reform process should be informed by modern industry practices, that the ways in which modern insurance contracts are concluded differ significantly from those when insurance law was last reviewed by the Law Commission in 1980. The article then discusses the dichotomy between consumer and business insurance given that this distinction underpins the LCCP and its approach towards reforming the pre-contractual duty of good faith. By way of backdrop to the analysis, we consider the approach taken towards reforming the law governing intermediaries acting for prospective assureds during the disclosure process. Finally, the proposed rules for warranties and similar terms are examined. It is argued that the proposal to retain continuing warranties in business insurance contracts will, if implemented, represent a missed opportunity to rid insurance contracts of terms long criticised as draconian and disproportionate in their effect.

在英国人没有组织起有计划的大规模的西伯利亚殖民活动之前，俄国凭地利之便和哥萨克之勇，抢先占领了西伯利亚。近代以来，直到1917年俄国十月革命之前，英国人在西伯利亚地区的活动可大致划分为两个阶段。第一阶段是从1555年“俄罗斯公司”在伦敦成立到19世纪三四十年代俄国发生工业革命，在这一阶段，英国人活动规模小，赴西伯利亚动因之一是为了商业利益，二是受沙皇政府聘用出访或途经西伯利亚，三是出于传教或慈善事业的目的。第二阶段从俄国工业革命到1917年十月革命，英国实业家和资本家伴随大规模的对俄商品输出和资本输出来到了西伯利亚，从事各种经营活动。     

Martin Wight's Thought on Diplomacy

Martin Wight was a founding member and one of the most influential thinkers of the 'English School' of International Relations. His thought on diplomacy is at the heart of his international theory. He portrays diplomacy as a defining activity of international relations; it marks the international sphere. His diplomatic thought is shaped by, more than anything else, a traditional Christian outlook that can be characterized as Augustian. Unless one comprehends that religious disposition of Martin Wight's thought one will not properly understand it.
