中国宪政之路的反思

近代中国 ,宪政运动伴随着中华民族争取独立、民主、富强的斗争而展开。回顾百年来中国宪政与宪法的历史 ,可以帮助我们在总结历史经验的同时 ,深入研究社会主义民主宪政的理论 ,提高全民的宪法观念和法律意识 ,使依法治国进入一个新的发展阶段。     

欧盟法的基本自由与劳工权利保护

欧盟法规定的基本自由包括共同市场内的商品流通自由、劳动力迁徙自由、服务业流通自由和资本流动自由四个部分,可以直接适用于欧盟国家的公民。这种规定为欧盟范围内劳工权的保护提供了全面、深入的法律保障,并赋予国际人权保护新的思想内涵。同时,对劳工权的保护促进了基本自由的完善。欧盟法基本自由对中国劳工权利保护也有一定的借鉴意义。     

Strategic or Principled? The Engagement of Civil Society Organizations with the EU

This article links the literature on the Europeanization of civil society organizations (CSOs) with the literature on the contribution CSOs can make to democracy in the EU. To do so, it asks which are the pull factors that support CSOs’ Europeanization: are they mostly strategic and linked to where law-making and the money are? Or are they likewise linked to a desire to contribute to EU democracy? To explore this question, the article looks at agricultural, environmental and anti-poverty groups and combines fresh qualitative with quantitative data. The findings suggest that we need to distinguish strategic Europeanization, on the one hand, from the identification with supranational democracy, on the other. They also show that the most Europeanized organizations need not be the most interested in EU democracy, whereas organizations with a comparatively low degree of Europeanization can still be interested in EU democracy.     

Banking supervision and the politics of verification: the 2014 stress test in the European Banking Union

The statistical methodology known in financial terminology as ‘stress testing’ was used by the European Central Bank in 2014 in order to assess the solidity of the banks in the eurozone. This audit process is analysed here as a problem of truth production or ‘veridiction’ in the sense developed by Michel Foucault in his 1978–1979 lectures at the Collège de France. In order to prove effective, the stress test had to deliver knowledge on banks, objectified and actionable at once, but also controlled by the idea of avoiding ‘market panic’. This epistemological dilemma is at the core of the politics of verification, which consists in the distribution of restraint and responsibility between non-risky and risky banks. This qualitative investigation is focused on France and is based on interviews with relevant policy actors and documentary analysis.

欧盟过境货物知识产权保护最新态势——兼评欧洲法院“NOKIA”案和“PHILLIPS”案

自2008年10月以来,在欧盟一些海关屡屡发生过境货物遭到扣押的事件,尤其是荷兰海关屡次扣押印度等国的过境药品,引起国际社会的极大关注.英国和比利时法院分别在审理“NOKIA”案和“PHIILIPS”案过程中对过境货物是否扣押产生疑问,并向欧洲法院提出咨询.近期欧洲法院对两案合并审理,做出一项里程碑意义的判决,厘清了过境货物、 “虚拟制造”理论等基本问题,对欧盟海关的知识产权执法和法院司法都有很好的指导作用,对于我国政府和企业也不无裨益.     

论我国农村土地征用程序的法治化

土地是我国最为宝贵的稀缺资源,也是农民最基本的生产资料,是农村发展和稳定的基础.在我国当前的农村土地征用过程中,行政主体具有极大的自由裁量权.公正的程序是防止权力专横和权力滥用的屏障,也是保障农村、农民土地所有权和使用权的基本要求.当前我国应当从公开性、公正性入手,构建一个科学、合理的土地征用程序,以平衡公共利益和个人利益,实现社会公平正义,带动农村经济和社会稳定、健康发展.     

欧盟非正规就业对工会的挑战

欧盟国家非正规就业的迅速发展,使工会面临着严峻的挑战。非正规就业的增加直接冲击了传统工会的基础,使工会会员的绝对和相对人数都有很大降低;同时,工会领导的劳工运动长期忽略对非正规就业的权利保护,非正规就业工人难以获得与正规就业平等的待遇。因此,欧盟国家工会需要在增加非正规就业会员和就业监管策略两方面做战略性调整,以应对非正规就业的挑战。     

The Implementation of European Anti‐Discrimination Directives: Converging towards a Common Model?

This article examines the impact on national law and policy of two Directives on combating discrimination adopted by the EU in 2000. It considers the extent to which their transposition has resulted in the 'Europeanisation' of anti-discrimination law and whether this implies convergence in the direction of a common model. Two themes are examined: the list of protected grounds of discrimination and the creation of equality institutions. All 27 states have introduced legal reforms in response to the Directives and a loose level of convergence can be identified. Nevertheless, specific national traditions have proved resilient, for example, shaping the meaning attached to terms such as 'disability' or the structure and powers of equality bodies.     

The Contribution of Donor Support Programs to Decentralized Development: Learning from the District Level in Ghana

Donor aid has over the years turned out to be a very decisive development component for most developing nations, but aid is often criticized for ineffectiveness. This article seeks to share perspectives on the relevance of direct project or program support and the need to refrain from homogeneity in aid research by assessing the contribution of the Government of Ghana/European Union (GoG/EU) Micro-Projects Programme in the Nadowli District of Ghana from 1997–2009. The findings acknowledge positive impacts of the program in the district. There are sector consistencies between the donor interest and local development priorities in health, education and the water and sanitation sectors. However, selectivity of project within and among sectors brings potential conflicts of interest and tradeoffs between the program and local community needs. The results imply a reexamination of decentralized development through a lens of new partnership between donors’ interest and local needs. Stepping up community awareness to ensure full participation in project design, execution, operation, and maintenance could serve as a start-up platform for new partnerships. It is imperative to align donor interest with local realities, which prompts a rethinking of adoption of new project approaches such as co-development, design, and implementation.
