新世纪社会思潮对我国青年影响的特点

进入21世纪以来,改革的不断深入带来了人们生活方式、思维方式的巨大变化,新的社会思潮对人们特别是青年产生重要的影响,表现出新的特点:从形式看更显露时尚性;从内容上看更关注主体性;从层次上看更趋于一致性;从性质上看更具有隐蔽性的新特点。

对青少年进行社会主义荣辱观教育,必须注重从中华民族传统文化中汲取营养,增强文化底蕴。当代青少年对中华民族传统文化知之甚少,亟待加强国学修养;社会主义荣辱观深深地根植于中华民族传统文化的沃土之中。树立正确的荣辱观,需要认真学习、了解、掌握中华民族的优秀传统文化,懂得以中华民族传统文化修养自己,提高青少年道德自律能力的水平。

关于青年学生马克思主义人权观教育的思考

社会文明的进步客观上要求加强对青年学生进行马克思主义人权观教育。各级政府和组织必须把它切实纳入重要议事日程,高校也应把它纳入思想政治教育体系之中,多方力量采取多样的教育途径,对学生进行宣传和教育,从而使他们树立起科学的马克思主义人权观。     

The Enjoyment of Rights and Freedoms: A New Conception of the 'Ambit' under Article 14 ECHR

Article 14 of the European Convention on Human Rights, as applied by the UK judiciary under the Human Rights Act 1998, is in danger of becoming as 'parasitic' as it is often described. Judges have inappropriately narrowed the scope of the 'ambit' of other Convention articles, and thus limited the number of claims to which Article 14 can apply, by defining it according to considerations more properly weighed in a justification analysis incorporating proportionality. The emerging approach departs from Strasbourg jurisprudence, and fails to give full effect to the language and intent of Article 14. This trend need not continue. This article begins the process of fashioning a new conception of the ambit of Convention articles: one that could change the fortunes of Article 14 cases in the UK, but that flows naturally from the precedents of the European Court of Human Rights, and gives effect to the spirit of the HRA.     

欧共体法中的相称性原则

相称性原则是欧共体法中的一项一般法律原则。其适用范围不仅包括共同体措施 ,而且包括成员国国内措施 ;不仅适用于行政行为 ,也适用于立法行为。适当性、必需性和最小限制性是相称性原则的三个构成要素。相称性原则与从属原则既有密切联系 ,也有本质区别。就其功能而言 ,相称性原则是欧共体法院司法审查的基础 ,是支配共同体行使权能的原则 ,是建立内部市场的指导原则     

The Dissemination of Detainees Awaiting Trial Before International and Internationalized Criminal Tribunals

This paper will focus on the rights attributed to detainees who are facing charges before international and internationalized criminal courts. The question is whether their position merits a different approach compared to the position of detainees who are confronted with domestic criminal trials. In particular, this paper will address the question whether, and to what extent, international human rights have a direct effect on the position of the former detainees. Attention will focus on case law of the European Court of Human Rights vis-a-vis the rights of detainees and the impact thereof on the position of detainees who are held in custody on behalf of international and internationalized criminal courts. The author is Professor of International Criminal Law at Utrecht University (The Netherlands), defence counsel acting before the ICTY, ICTR and SCSL, and a partner of the law firm Knoops & Partners Advocaten in Amsterdam, the Netherlands.     

欧洲宪法法院给我国违宪审查制度建构的启示

违宪审查制度是人类政治与法治史上最重要的制度之一,也是现代国家限制国家权力、保护公民权利最有效的手段。我国应借鉴欧洲宪法法院违宪审查的经验,逐步建构我国的违宪审查制度,设立专门的宪法救济机构,规定公民个人作为启动宪法救济的主体,规定具体的宪法救济方法与程序,并在时机成熟时将那些侵害公民宪法权利的案件逐步交给普通法院解决。     

Theoretical Connotation and Practical Direction of the Chinese Youth’s Historical Mission in the New Era

Since modern times, in the historical process of national liberation, Chinese youths have dared to shoulder the historical mission and made outstanding contributions in the history of modern China. Inheriting the historical mission entrusted by the predecessors and carrying the ideal of the Chinese people in pursuit of a better life, the contemporary Chinese youth is becoming a force that cannot be ignored in the practice of socialism with Chinese characteristics. Under the unprecedented material conditions and institutional advantages, only through “establishing lofty ideals”, “raising courage to struggle” and “practicing excellent skills” can the unity of ideality and reality be realized. Only by “loving the great motherland”, “taking the responsibility of the times”,and “refining moral character” can the unification of personal and social values be realized. Since the 18th National Congress of the CPC, with the continuous improvement of China's educational system, under the guidance of the socialist core value system, Chinese youths in the new era have begun to show patriotism, determination, diligence, moral cultivation, innovation, and pragmatism.This will certainly promote the contemporary youth to gradually grow into talents who can adhere to their ideals and keep pace with the times.
