This article assesses the utility of impact assessments (IAs) as an effective tool for mainstreaming. Specifically, it analyses whether the European Union's (EU's) system of integrated impact assessments (IIAs) contributes to the realization of six mainstreaming objectives defined in the EU treaties. The article first studies whether the legal framework for the EU's system of IIAs makes it a viable tool for mainstreaming. It then proceeds with an empirical analysis of 35 IAs to assess the extent to which mainstreaming objectives are taken into account in practice. The analysis shows that all six mainstreaming objectives have a place within the IIA system, but the system does not ensure systematic consideration of them. There is considerable variation across mainstreaming agendas, as well as across Directorates‐General. The article concludes that the IIA system is no panacea for mainstreaming, and proposes changes to the institutional framework to improve its mainstreaming potential.  相似文献

This article examines how the defence component of the Common Security and Defence Policy (CSDP) has been revisited over the last few years. It argues that while the CSDP has grown predominantly as a security – rather than defence – policy, the latest developments that include the creation of a military headquarter, the launching of a Permanent Structured Cooperation (PESCO) and the new role for the European Commission in defence funding, attest to an evolution towards a more central EU defence policy. In the meantime, the article points to some structural impediments to the materialisation of European defence. The momentum says little about the form and finality of military operations that EU states will have to conduct so as to give a meaning to defence in a European context. Moreover, persisting divergences in the EU member states’ respective strategic cultures and institutional preferences – notably vis-à-vis NATO – are likely to continue to constrain European defence self-assertion.  相似文献

This article reviews recent advances in the study of the European Court of Justice (ECJ) and its political impact at the European and member state levels. New quantitative as well as qualitative analyses show with great empirical precision that member state preferences guide the Court. The article summarises these findings, but argues that greater attention needs to be given to the (over-)constitutionalisation of EU law in order to fully capture the political impact of ECJ jurisprudence. Even if European judges are less activist than is often assumed and individual decisions are more restrained in the face of member state opposition, incrementally, case law evolves in a highly expansive fashion. And, exercising caution regarding unrealistic expectations about quasi-deterministic judicial law-making, it is found that the Court’s constitutionalised jurisprudence impacts heavily on European and member state policy-making.  相似文献

Following an ambiguous constitutional compromise for democratization, the territorial decentralization of the Spanish state developed by means of political party competition, exchanges, and bargaining. Hence, the so-called state of autonomies was characterized as “non-institutional federalism” [Colomer, Josep M. 1998. “The Spanish ‘State of Autonomies’: Non-institutional Federalism.” West European Politics 21 (4): 40–52]. In the most recent period, competition and instability have intensified. New developments include, on one side, attempts at recentralizating the state and, on the other side, demands and mobilizations for Catexit, that is, the independence of Catalonia from Spain, which resulted in sustained inter-territorial conflict. This article addresses these recent changes with a focus on the relations between the Spanish and the Catalan governments. The political changes were analyzed as a result of opportunities and incentives offered by a loose institutional framework and the subsequent competitive strategies of extreme party leaders.  相似文献

The European Parliament (EP) adopted, between 2004 and 2009, a series of resolutions calling for recognition of Communist crimes and commemoration of their victims. This article focuses on an overlooked aspect of anti-Communist activism, the awareness-raising activities carried out by some Central European Members of the European Parliament (MEPs) to perpetuate the cause through networks that enable them to exchange institutional credibility, scientific legitimacy, and policy-oriented knowledge with Institutes of National Memory, parts of academia, and victims associations. Although they use the techniques of expertise and scandalization that are often effective in European institutions, these memory entrepreneurs have largely failed to further their claims in the European Union (EU) after 2009. In line with the turn toward “practice” in EU studies and the increased attention paid to agency in memory politics, this article contends that the conditions of production of their narrative of indictment of Communism accounts for this relative lack of success. Because their demands produced a strong polarization inside the EP while colliding with established Western patterns of remembrance, these MEPs’ reach remains limited to their Conservative peers from the former Eastern bloc. This weak national and ideological representativeness hinders their capacity to impose their vision of the socialist period in the European political space.  相似文献

Research on European identity focuses mainly on majority populations in Western European countries without differentiating among specific population groups and generations, and, above all, disregarding ethnic minority groups living in Central and Eastern Europe. This paper addresses this gap by investigating the development of European identity among three ethnic minority groups in Lithuania: Belarusians, Poles, and Russians. Theoretically, the project is based on the instrumental approach, which argues that European identity is closely related to perceived benefits from “being European,” and on the cultural approach, which holds a common history, ancestry, and culture responsible for the development of European identity. Existing research has, above all, emphasized the importance of instrumental considerations. Analyzing qualitative interviews collected in the FP7 research project “ENRI-East,” the paper compares how young and adult members of ethnic minority groups construct European identity due to “instrumental” and “cultural” considerations. The results show that both instrumental and cultural considerations are relevant and further development of European identity depends on which age group or ethnic minority group an individual belongs to.  相似文献

ABSTRACT

The article highlights the rationale of the special issue in terms of its objectives and guiding principles. It maps different evolutions and challenges within three analytical streams (1) regarding the field of policy analysis, (2) concerning the interaction between domestic and international affairs, and (3) with regards to the transformation of European Union governance in troubled times. These three research avenues highlight how not only European governance itself has evolved in a changing world, but also how the analysis of interests, institutions, and policy-making has morphed, oftentimes transgressing disciplinary and methodological boundaries.  相似文献

Following fierce campaigning by victims’ groups, the European Commission has entered into a process of legislative and policy reforms with the aim of repositioning the victim in criminal proceedings. By November 2015, member states will need to have demonstrated that they have modified their domestic laws to give effect to the Directive 2012/29/EU establishing minimum standards on the rights, support, and protection of victims of crime. For the first time, restorative justice is explicitly regulated at EU legal level, as the Directive aims to establish a baseline for its safe implementation across member states. With this EU-wide policy backdrop and using original data, the article posits evidence-based recommendations for the implementation of the Directive. The research was carried out in 2013–14 as part of the “Restorative Justice in Europe” project co-financed by the European Commission. The research took place in the United Kingdom and combined desk research and qualitative research strategies with victims, while it triangulated its findings with follow-up surveys with offenders and professionals.  相似文献

This article examines the rise of resilience discourses in EU foreign policy. The European Union Global Strategy (EUGS) refers to building state and societal resilience in its neighbourhood as one of the key strategic priorities of the EU. This article argues that the discourse of resilience that permeates the EUGS chimes well with a pragmatist turn in social sciences and global governance. The EUGS introduces resilience-building alongside an emphasis on flexibility, tailor-made approaches and the need for local ownership, capacity-building and comprehensiveness. More importantly, the new EUGS proposes “principled pragmatism” as a new operating principle in its foreign policy. While this might suggest a more pragmatic EU foreign policy, a closer examination of the EUGS discourse reveals significant tensions between a pragmatic and a principled foreign policy, which undermine the added value of resilience-building as a new foreign policy paradigm.  相似文献

The European Commission launched the “Smart Borders” policy process in 2011 to enhance border security in the European Union (EU) using technologisation and harmonisation. This includes the use of automated border control (ABC) systems. The Member States crucially shape the process, weighing security technologies and costs, privacy and rights, and further institutional choices. We examine the views of political stakeholders in four Member States by conducting a systematic empirical and comparative study unprecedented in the existing, political-theory-inspired research. In our Q methodological experiments, political stakeholders in Finland, Romania, Spain and the UK rank-ordered a sample of statements on Smart Borders, ABC and harmonisation. The factor analysis of the results yielded three main views: the first criticising ABC as a security technology, the second welcoming the security gains of automation and the third opposing harmonised border control. While impeding harmonisation, the results offer a consensus facilitating common policy.  相似文献
