颠覆与“承接”——关于福柯与马克思

福柯与马克思的关系是颠覆与"承接"关系.他对马克思历史唯物主义的颠覆,是通过知识考古学对历史规律和历史主体的否定达到的.知识考古学以历史先天取代了历史规律,以作为空的功能的陈述主体虚化了历史主体.同时,他对马克思的承接是一种批判性的承接,主要表现在批判哲学方面.知识/权利模式扩大了意识形态批判的范围,而系谱学分析对阶级斗争的替代则在某种程度上把斗争泛化和细化了.     

费用推动程序

以律师费为主要构成内容的费用机制是群体诉讼作用得以发挥的结构性条件,各种群体诉讼制度都有与自身相匹配的费用机制,费用对群体诉讼程序的促进有诉讼内与诉讼外两种机制。群体诉讼费用的负担既要符合合法性原则,也要允许法院对费用负担进行适当的自由裁量,方法包括诉讼费用转移给被告、诉讼外第三人、代理律师和代表人等。为促进并规制群体诉讼制度的发展,我国可考虑建立以法院裁量为保障的当事人分摊费用制度和律师胜诉取酬制度。

社会主义市场经济的建立和完善,多样化趋势促使我国工人阶级内部结构演化成不同的阶层,由此不能否定工人阶级的先进性,中国工人阶级始终是推动先进生产力的基本力量。

中共"三大"提出建立"强大的群众共产党之基础"的任务,并作出采取了相应的决议和措施,尤其是主张要"努力从各工人团体中,从国民党左派中,吸取具有阶级觉悟的革命分子,渐渐扩大我们的组织"的思想,具有历史特点和时代特色,对"三大"之后党的队伍的发展和政治影响的扩大具有十分重要的意义,体现了中国共产党十分注意与时俱进地巩固阶级基础和扩大群众基础的思想与实践.     

计算机设计模式在Java语言中的体现

目前OO界有几个原则:“开-闭”原则(OpenClosedPrincipal)、里氏代换原则、合成复用原则,循此原则,又提出了许多设计模式。本研究利用“抽象工厂”模式思想,结合案例分析了使用接口的本质,指出了“什么时候该使用接口”;定义了一个用于创建对象的类,使一个类的实例化延迟;指出了“如何使用接口”;用“开-闭”原则分析了继承的本质,继续结合该案例,提供一个抽象工厂用于继承,解决代码的“开放”。     

大鼠急性CO中毒的超微病理学研究

大鼠吸入 CO(1500～4500PPM,2小时)急性中毒后,观察其心、肝、脾、肺、肾、脑的病理改变。光镜下可见心肌细胞浊肿,水性变,肌浆凝聚,间质水肿;肝细胞浊肿,轻度脂肪变;肺淤血、水肿;肾曲管上皮细胞浊肿,神经细胞急性肿胀,尼氏小体减少或消失。电镜下,心肌原纤维过度收缩,肌节交短,质膜部分破坏,肌原纤维断裂、坏死;线粒体肿胀,肌浆网扩张;神经细胞内粗面内质网呈囊状扩张;神经细胞固缩;星形细胞突起水肿。     

论中产阶层行为的法律规制

随着现代市场经济的发展,我国的中产阶层正在发展壮大,有利于社会和谐稳定的"橄榄型"社会阶层结构正在形成。但是,我国中产阶层的理性行为方式还没有完全形成,存在着缺乏社会责任感、行为缺乏有效的社会制约和自我约束、对国家权力的依附性等问题,因此,必须对中产阶层的行为进行有效的法律规制。加强对中产阶层行为的法律规制,主要是进一步加强现代市场经济法制建设,包括加强物权法制建设、加强市场交易法制建设、完善公平的资源配置机制和社会流动机制、加强廉政制度建设、加强社会组织法制建设等。因此,依法规制中产阶层的行为还应当注意处理好几个关系。     

Identification of some factors influencing soil transfer on shoes

In criminal activities, soil can be transferred from a crime scene to items linked with a perpetrator; for example, shoes, cars or tools. Several parameters will influence the quantity of soil transferred in a given scenario. The knowledge of the most influential factors can help the expert to assess the evidence using a logical approach at the activity level or to predict the amount of soil that can be expected in a given scenario. The influence of five chosen parameters, namely the shoe profile, shoe size, walker's weight, soil type and soil humidity were assessed using Design of Experiment (DOE) in order to understand their influence on soil quantity transferred on shoes.The Faced Central Composite Design (FCCD) using a quadratic model was found to be highly significant, thus they could be adequately used to model and to interpret the amount of soil recovered from one shoe.These designs demonstrate that the characteristics of the donor (soil type and soil humidity), as well as a combination of these two factors have a very significant impact on the soil transfer. The characteristics of the receptor (shoe profile, shoe size and walker's weight) also have an impact on the transfer but to a lesser extent.Globally, this research provides valuable information for the forensic scientist both in investigative mode: evaluation of the soil quantity possibly transferred on shoes, and in the evaluative steps: is the quantity of soil found on the suspect shoes in accordance to the proposition/scenario given by the prosecution and the defence?     

时尚杂志的女性论述——以《世界时装之苑——ELLE》为个案

20世纪90年代中期以来,伴随着中国的新一轮市场开放、经济增长以及中国社会的分化分层,与西方合作的女性时尚杂志迅速而广泛地吸引了一大批年轻白领女性,成为她们以形象、时尚、消费获致女性性别认同和阶层认同的教科书。时尚杂志对女性角色的呈现,对女性气质、服装与身体的形塑与改造,是通过女性性别技术和中产阶级身份的教科书两个关键隐喻进行的;时尚杂志通过服装等身体技术,本质化了男女的性别人格,掩蔽并再生产社会不平等、性别不平等。     

Scholars and Radicals: Writing and Re-thinking Class Structure in Australian History

We wrote Class Structure in Australian History in a period of heightened social struggle. It grew out of collaborative research projects at Sydney's Free U in the late 1960s. The book was distinctive in both emphasising the socialist tradition of class analysis and trying to find new paths for it. Its first edition was ignored by mass media, and often mis-interpreted in professional journals. Nevertheless it circulated widely and has continued to be a point of reference for progressive scholarship. Its method tried to carry forward the Free U project of democratic knowledge making, linking documents with analysis and inviting shared interpretation. Its theory emphasised the reality of classes as historical formations, and the importance of understanding class structure as a whole, on both points reacting against influential frameworks of the time. Looking back, CSAH appears uncertain in its approach to race and gender, and inadequate in its handling of coloniality; it was written in isolation from similar projects in other parts of the postcolonial world. Yet its approach still has value in understanding the changing dynamics of class on a world scale, the class relations of the neoliberal era in Australia, and the current configuration of power in Australia.
