公民参与公共政策制定是民主政治发展的必然趋势,是确保社会价值公平分配的重要途径。随着我国社会主义市场经济体制的完善和民主法制建设进程的推进,公民作为公共政策制定主体的重要组成部分,其参与的意识和要求也随之增强。因此,构建完善的公民参与机制已成为政府迫切需要解决的问题。本文采用SWOT分析法对公共政策制定中公民参与的优势、劣势、机会及威胁等四个方面进行分析,并在此基础上提出其完善的路径。 相似文献

投资基金组织一体化程度弱,基金持有人权益易受侵害。本文尝试将公司法中的股东派生诉讼制度移植到投资基金领域,构建投资基金持有人派生诉讼制度,为保护基金投资者合法权益另辟一条蹊径。美国特拉华州于1998年率先在企业信托中创建了派生诉讼制度,契约型投资基金就是企业信托的主要组织形式。从比较法角度出发,借鉴关国特拉华州立法先例,同时辩证借鉴公司股东派生诉讼制度的立法经验,将有利于构建符合我国国情的投资基金持有人派生诉讼制度。 相似文献

Traditional food supply systems, like municipal public markets (MPM), are in crisis. Nevertheless, MPMs continue to demonstrate importance in the lives of the cities. In this article we discuss the case of Mexico City and the importance of the public markets for its neighbourhoods. We present the results of two research projects, completed in Mexico City at two different historical times and interpreted longitudinally. The results demonstrate the importance of socio-economic relationships for MPM's survival and potential. The article concludes with public policy recommendations to permit conservation, given the MPM's importance for the city's social cohesion. 相似文献

School clusters have been adopted as an education policy by most Asian countries since the 1960s. In Cambodia, primary schools have been organised in clusters since 1993. Clusters were considered a mechanism for quality improvements of education and a way to facilitate sharing and interaction between schools. Primary school clusters have been partially successful. Today there is a growing interest among Cambodian policymakers for integrating primary schools (Grades 1–6) and lower secondary schools (Grades 7–9). This article provides a policy suggestion by arguing for extending the cluster mechanism to these integrated basic education schools with all grades from 1 to 9. 相似文献

Despite the 1994 genocide there has been annual growth in Rwanda every year since 2000. Poverty has decreased; while the MDG target of 23.8% is unlikely to be met by 2015, the future looks hopeful. The goal of reducing hunger is measured by underweight children – already down to target – and extreme poverty – likely to hit the target. Key to success is reducing dependency on the land, but a majority of the population still depend on their farm or plot. However, hitting targets for reducing poverty is not the same thing as abolishing it, and achieving targets does not necessarily solve problems. 相似文献

A multiplicity of legal and political arrangements regulate the European Union's external borders. With borders representing the intersection between national and international law and politics, the EU also acquired some legal competences in this realm. The resulting triple set of rules coincides with the growing disaggregation of the classical functions of borders. This state of affairs generates legal and procedural uncertainties and results in a growing ambiguity and lack of transparency, in terms of competences and accountability. Due to the EU's concerns with transnational terrorism, and the growing securitization of migration, the EU's borders with the states of the Middle East and North Africa are particularly relevant in this regard, with the resulting uncertainties touching upon fundamental rights. This article analyses the role of narratives in European Union (EU) external relations in the revised European Neighbourhood Policy (ENP) and systematically explores how they operate in practice in the context of the EU's border management practices vis-à-vis the “southern borderlands”, in particular with respect to their inclusionary and exclusionary potential. Key EU documents and statements by EU agents, released throughout the first three years of Arab uprisings and pertaining to the revised ENP, will be subjected to a thorough examination which highlights four observations: first, in spite of the fact that the revised ENP is rooted in several narratives, some nevertheless dominate over others; second, the simultaneous presence of and recourse to different narratives contribute to an increase, rather than a decrease, of uncertainty in the EU's southern borderlands; third, despite a multitude of narratives which serve to legitimize EU action in the framework of the revised ENP, the latter perpetuates the logics of its predecessor by generating benefits mainly for the EU itself; fourth, that the first three years of the revised ENP have in practice demonstrated that an imbalance exists between on the one hand the original acceptance of the narratives by EU stakeholders and on the other hand their willingness to abide by them and fill them with life. 相似文献

The growth of European Union (EU) competences in the field of external security in the last decade has produced a substantial increase in the number of EU institutions and bureaucratic actors engaged in the planning and management of these policies. Moreover, the expansion of competences in such a sovereign sensitive area comes up against the persistent intergovernmental nature of the security sector. This has resulted, on the one hand, in a complex institutional architecture with heavy demands in terms of coordination, and on the other hand, in a stark differentiation and stratification of the legal regimes with a potential to impact on policy outcomes. This state of uncertainty is particularly relevant when looking at relations with countries bordering the Union, as the long-standing web of interactions there has developed a more complex institutional environment. While most of the scholarly literature focuses on single institutional sectors or policies (Common Security and Defence Policy, European Neighbourhood Policy, or the external side of the Area of Freedom, Security and Justice), this study seeks to address the issue with a comprehensive analysis of the institutional framework that has emerged in the last decade, more notably, since the entry into force of the Treaty of Lisbon. The article provides, first, an overview of the EU’s institutional actors responsible for security policies in the regions bordering the EU, and second, an examination of the different mechanisms established to address the coordination issue. Finally, this study will argue that the traditional military dimension is but one, and certainly not the most developed, of the security instruments employed by the EU. At another level, it will be argued that the shift of focus from the military to other security tools has altered the institutional balance in the security sector, substantially adding to the relative influential weight of the Commission. 相似文献

我国对吸毒人员一贯采取治病救人、教育改造的刑事政策,惩罚色彩很弱。至今为止,我国法律对吸毒行为的最严厉措施仅限于劳动教养。然而,走私、贩卖毒品等犯罪的愈演愈烈与对吸毒行为的控制不力是有密切关系的。鉴于吸毒行为本身的社会危害性以及现有保安措施的缺陷,《刑法》应对某些严重的吸毒行为增设吸毒罪予以刑罚规制。与此同时,其他法律法规中对吸毒人员所制定的保安处分措施也应加以完善。只有打防并举、多管齐下,才能遏制日益严重的毒品违法犯罪。 相似文献
