Towards a New Ireland

Despite all the contemporary difficulties that we face on the island of Ireland, twenty-four years on from the signing of the Good Friday Agreement, there is a clear sense of hope for a better future. We should be optimistic for our shared future, even if we do not agree on what form that should take. We cannot discuss Northern Ireland or its future without acknowledging that Brexit has significantly shifted the conversation. Not only has it brought Anglo-Irish relations to a low not seen in the past twenty-five years, but it has also damaged the reputation of the UK internationally and brought the topic of Irish unity back to the fore of our political discourse.     

信用证欺诈例外原则研究--从加拿大一起案例看我国司法实践中应注意的问题

为抑制信用证欺诈、维护诚实信用的国际贸易环境 ,信用证欺诈例外原则的运用需突破信用证的独立性 ,将信用证交易与基础合同交易联系起来考查。这是对信用证独立原则的例外。加拿大最高法院于 1 987年审结一起有关信用证欺诈例外原则的著名案例BankofNovaScodiaappellantv .Angelica -WhitewearLTD .andAngelicaCorpo rationRespondents,成功地总结了英美法国家处理信用证欺诈问题的立法、判例。本文从介绍该案入手 ,结合国际公约和现有立法、判例、法学理论 ,分析信用证欺诈例外原则确立的必要性及适用条件 ,以期为我国在新形势下完善有关信用证欺诈的立法、司法作理论上的探讨     

村庄公共品供给中的“好混混”

1990年代以后,两湖平原村庄中出现了好混混。好混混的出现源于村庄公共品供给的困境。乡村组织难以抑制公共品供给中的搭便车行为,村庄公共品合作常常因此难以达成。好混混则可以依靠暴力和暴力威胁遏制搭便车行为,维系村庄公共品合作和供给,他们的好由此体现出来。取消农业税后,乡村组织的公共品供给能力更加弱化,农民因此对好混混的需求更甚。好混混这一怪异现象,反映了国家权力在基层社会存在局部不足。     

民法中诚信原则的立法旨意及其实现路径

民法中贯彻诚信原则是道德法律化以及弥补诚信在适用过程中不确定性的内在要求,也是限制法官自由裁量权的要求。其实现路径可从制度约束、审判监督、法官素质提升以及全民诚信意识的养成等方面着手。     

善治视角下的政府体制改革

善治作为一种全新的治理理念,已经逐步地打入中国市场,不断被学者及当局研究并予以尝试。从1949年建国之初开始至今,为适应新时代各个方面的发展,我国进行了多次政府体制改革。本文立意从政府治理的角度出发,把善治的理论运用于政府体制改革的研究过程中来,力图寻求一种基于善的视角下,更具有现实性、科学性和中国特色的政治体制。     

Examining the good lives model and antisocial behaviour

This study examined the utility of the Good Lives Model (GLM) (Ward, T., &; Stewart, C. A. (2003). The treatment of sex offenders: Risk management and good lives. Professional Psychology: Research and Practice, 34(4), 353–360. doi:10.1037/0735-7028.34.4.353) in understanding offending behaviour in students. Two hypotheses were made, consistent with the assumptions of the GLM. First, that participants would endorse the importance of the primary goods set out in the GLM. Second, that reports of antisocial behaviour would relate to a lack of effective strategies, or use of maladaptive strategies, to achieve primary goods. Participants (n?=?340, M age?=?20 years) completed a questionnaire (Measure of Life Priorities) assessing their pursuit, valuation, and achievement of the primary human goods as set out in the GLM and a Self-Report of Offending questionnaire. Results supported our hypotheses, and subsequently the assumptions of the GLM. Our findings support the continued use of the GLM as a theoretical and treatment oriented framework in diverse groups engaged in offending behaviour. Future research should continue to ground the GLM in empirical support.     

The US and the Asian Development Bank: Origins,structure and lending operations

The dominant discourse related to the establishment of the Asian Development Bank revolves around its structure, functions and lending operation. But the self-serving role played by the US during its formative years has been largely neglected. This article focuses on the early years of the Bank (1967–1972) and American efforts to make it a subservient tool of American foreign policy. A close examination of American role and influence within the Bank during its formative stage illustrates how multilateral institutions, funded by rich countries, can be used to force poor nations adopt methods for dealing with their problems, at odds with their own interest.     

'Good Governance': The Rise and Decline of a Policy Metaphor?

This study aims to explore the conditions under which the criterion of 'good governance' first became adopted as a donor policy metaphor and now seems likely to get eclipsed. Why did it emerge at the time it did, and what, since then, has been its track record? Particular attention will be given in this regard to successive shifts in the relevant policy thinking within the World Bank. Moreover, the study discusses whether good governance is likely to keep drawing the same level of attention as it has done hitherto.     

Civil Society and Good Governance in Bangladesh

Many of the recent ideas and concepts of ‘good governance’ and ‘civil society’ in Bangladesh have been generated by the international aid agencies and their ‘good governance’ policy agenda in the 1990s, but there are also local meanings to the terms derived from the independence struggle and the construction of a Bangladeshi state. This article aims to obtain a clearer analytical understanding of the processes and institutions of civil society in Bangladesh that can develop workable strategy to improve governance for helping the poor and moving beyond the patron–client relationships on which they have depended historically. It also focuses attention and debate on those aspects of civil society which can enhance the quality of governance and democracy by overcoming the western top-down approach; and can strengthen the role of civil society organisations to further enhance their impact on better governance for fair distribution of public goods and ensuring social justice for the poor.
