城市群租者的居住权保护问题分析

"群租"现象已引起社会的广泛关注。有关政府部门对群租行为的强行整治活动无论从执法主体、执法依据,还是在执法程序和救济权的保护方面都不具有合法性。政府对群租行为不能仅仅依靠"整治",而是应当以积极解决低收入群体的居住问题、完善公共服务为宗旨。通过发展公共租赁住房解决低收入者的居住问题,是政府保障低收入者居住权的重要举措。     

宪法架构下的地方政府

主流的行政主体理论认为,地方政府是我国行政主体的重要组成部分之一。然而,从宪法的角度上分析,无论是从处理中央与地方关系的宪法原则,还是宪法确立的地方政府与中央政府的关系与领导体制、地方政府的事务管理权,乃至于地方政府的组织机构设置、公务员管理,还是从其所归属的地方国家权力机关的宪法地位,与其说地方政府属于一级独立行政主体,不如说它更多地是作为中央政府的执行体而存在的。     

Political Trust and Distrust in Switzerland: A Normative Analysis

Abstract: Based on data from a Swiss survey study (N = 769), this research investigated individual‐level determinants of trust in political authorities from a social psychological perspective. The study demonstrates that individuals with a low level of education who feel materially at risk and politically powerlessness expressed the lowest levels of political trust. This relationship was explained with differential endorsement of normative beliefs. A mediation analysis reveals that normative perceptions of Swiss society as being threatened by immorality and growing social inequalities accounted for the effect of perceived material risk on political distrust. The rejection of a duty‐based citizenship norm (voting), in turn, mediated the impact of political powerlessness on distrust. Political orientation was unrelated to political trust. These findings illustrate the cognitive underpinnings of political alienation and suggest that perceived lack of political agency and perceived risk of social declassification are key factors in understanding political distrust.     

重生与毁灭——辛亥百年对晚清改革的透视

清政府在对待改革的态度上先是昧于世界大势,顽固不化,没有改革的主动意识;继而迫不得已改革,寄希望于学习西方的军事技术和兴办现代企业来挽救和维护专制统治;等到所有问题的解决都取决于政体改革的紧要关头,统治集团仍然不肯放弃专制权力,触动自身的权力和利益,在众叛亲离中轰然倒塌。     

中国“高储蓄现象”的部门分析:1952～2008

本文测算了1952～2008年中国居民、政府与企业三部门的储蓄率并分析了各部门储蓄率的变化及其原因。本文的研究发现:(1)经历了一个较长的下降周期后政府储蓄率在国民储蓄中的地位已经居于居民储蓄与企业储蓄之后。政府储蓄率的下降一方面源自政府在国民收入中的比重下降,另一方面源自政府储蓄倾向降低,这与市场化改革导致的国民收入分配结构变化与政府的职能变化密切相连。(2)上世纪80年代中期后随着企业体制改革的深化,预算软约束逐步硬化,买方市场逐步形成,企业的效益有了明显改善,企业可支配收入在国民可支配收入中所占比重加大,因而企业储蓄在国民储蓄中的比重不断提高。(3)改革开放后,居民收入迅速增长与储蓄倾向上升推动中国居民储蓄率走高。企业与居民储蓄率的上升是中国储蓄在高位持续的原因。     

Edem v. The Information Commissioner and The Financial Services Authority [2014] EWCA Civ 92

From time to time the Court of Appeal feels the need to steer inferior courts and tribunals away from an over-enthusiastic application of a particular direction of travel signposted by its own previous decisions. In the Edem judgment, published on 7 February 2014, the court has taken the opportunity to restrict significantly the application of its decision more than a decade ago in Durant v. Financial Services Authority, ¹ a case that has been relied on by many commercial data protection practitioners to deny subject access or the wider application of the Data Protection Act 1998 on the grounds that the data were not personal in that they did not relate to the individual in question even though the individual's name appeared as part of the data.     

抗战时期国民政府侨团政策探究

抗战爆发后,国民政府为争取更大的社会资源,更好地利用海外侨社的力量,迅速调整侨务政策,包括侨团政策在内。除了继续进行海外侨团登记外,还积极地整合侨团,要求党员渗透入侨团组织,掌握侨团领导权,同时也赋予侨团更大的权力,且更为突出的手段则是积极拉拢侨领,通过侨领来控制侨团,从而达到控制侨社的目的。从政策绩效角度而言,国民政府的侨团政策取得一定的成绩,但由于将党务纳入侨务的做法,也加剧了海外侨社的矛盾,致成海外侨社陷入党内纠纷。     

The European Union Faced With the Challenges of Food Safety： Solutions Proposed in the Framework of the Common Agricultural Policy （CAP） and Strategies of the Actors Concerned

Within the framework of Common Agricultural Policy （CAP）, how has the European Union （EU） responded to new challenges emerging at the end of the last century？ The overall picture shows that the process of improving health conditions includes various players. The overall objectives of the CAP are specified in Article 39 of the Treaty of Rome： to increase agricultural productivity and ensure a fair standard of living for the agricultural community. The word ＂security＂ here refers to the stability of supply. The first major reform came in 1992, linked to the Uruguay Round Cycle of initial responses to consumes expectations regarding food safety and the prevention of health risks. The centrepiece of EU food policy, European Food Safety Authority （EFSA） is consumed with all maters effecting food safety, nutrition, animal health and welfare, and plant health. The controversy around the need for reforms and their implementation has featured prominently in the public debate. The paper analyzes these debates by drawing on scientific studies carried out by multidisciplinary laboratories.

政府在医疗广告监管中的角色及对策分析

随着我国医疗市场的开放,医疗行业竞争加剧,虚假违法医疗广告屡禁不止,对社会造成了很大的危害和不良影响。本文拟对政府部门在医疗广告监管中承担何种角色以及当前医疗广告政府监管体系存在的问题进行分析讨论,并提出相应的对策建议,以供商讨。
