从社群主义拯救罪错少年——恢复性少年司法及其社区参与

少年司法固有的福利模式和刑事模式均无法单一地解决少年犯罪的问题,因而受到学界的批评.同时,以恢复社会关系,促进罪错少年回归社会为目标的恢复性少年司法似乎正在成为少年司法的“第三条道路”.从社会变迁的角度看,社会、社群和社区的发展变化对少年司法制度的发展具有巨大的影响力.我国的城市化和市民社会正处于迅速发展的阶段,社会、社群、社区的发展驱动了具有恢复性少年司法因素的少年司法的发展,这体现了社群主义的价值底蕴.我国不少地方的司法机关进行了恢复性少年司法的探索,其各个阶段均具有社区参与的因素.从社会发展的趋势看,城市化和市民社会的发展使恢复性少年司法的社区参与具有广阔的前景.     

经济扩张与社会保护——从波兰尼的“双向运动”看美国霸权体系

波兰尼提出了"双向运动"的概念,他认为,国家政策摇摆于经济扩张收益与社会保护成本的制衡之间;资本扩张与秩序维护形成了体系层面的"双向运动",霸权国则扮演了"体系中的政府"这一角色。国际体系的"双向运动"的矛盾焦点,在于经济扩张的同时如何维护国际层面及国内层面的秩序。美国霸权在这个问题上表现出相当娴熟的策略与技巧,利用国际多边机制使其成本外部化且将收益内部化,但美国的霸权也未能彻底克服"双向运动"带来的冲击与影响,存在着软肋与局限性。     

Small Business’ Place in the South Korean State–Society Relations

Korean small businesses have come a long way as sources of industrial power more important than heretofore credited. The nation's undemocratic dirigisme had largely slighted small businesses to the country's disadvantage. Although the government's policy bias against them started to change in the early 1980s, its support of them remained less than fully-fledged. Despite tough socio-economic conditions, however, both the first and second generation small entrepreneurs have strived to prove their self-worth as viable business enterprises and constantly—and increasingly over time—contributed to the incremental improvement of the economy. By shedding light on the little-known motivations, perceptions, and performances of the small business people, this article offers a more balanced and nuanced account of the past and present state of small businesses in the country, which provides a tentative basis for considering alternative vision for future development.

The Hi-jacking of Global Society? An Essay

Abstract

Globalization is producing a global society of some sort. Three leading forms are on offer: Global Civil Society, Global Islam and Global America. This essay presents an analysis of globalization as a process, and then a discussion of each of the three possible forms, while recognizing that contingency prevails in history. With this said, the odds are against Global Islam succeeding. Rather, the most likely outcome seems to be the ‘hijacking’ of Global Civil Society by the US. The reasons for this are given, plus a glance at alternative possibilities.     

Involvement in voluntary associations in North America and Western Europe: Trends and correlates 1981–2000

Abstract

There is no lack of studies that point at discomforting trends in community life and citizens' social and political involvement in contemporary society. According to various indicators, Americans have become increasingly disconnected from their families, friends, neighbours and associations, leading to a decline of civic community and social trust and to more individual unhappiness. Similar developments are supposed to take place elsewhere. In this article we use data from the European and World Values Studies to address, for North America and Western Europe, (1) trends regarding voluntary associations, social trust, political involvement and happiness in the 1981–2000 period; (2) changing patterns and types of involvement in associations; and (3) macro and micro relationships between this involvement and political involvement, social trust and happiness. We find no general decline in these traits, no trend towards more passive membership, and only mixed evidence for positive connections between involvement, trust and happiness.

全球化本质上是一种新的人类文明跨地域、超国家进行扩张的现象。当今所谓“全球化时代”并非全球化的始点,而是全球化进程中一个新的历史阶段,它是跨国公司主导下资本与人才在发展中国家和发达国家之间相互流动的结果。随着影响全球化的要素在世界范围内的进一步流动与均衡化分布,全球化将导致民族国家内部的社会结构出现真正意义上的“趋同化”,南北矛盾大大缓解,而资本家集团与一般大众之间的矛盾将再次突出出来。在这个未来的全球化阶段,马克思的幽灵可能重回人间,世界大同的理想将再次成为人类的追求。     

黑社会犯罪论纲

黑社会是指以获取非法暴利为主要目的 ,公然蔑视任何法律秩序 ,拉帮结伙 ,称霸一方 ,以使用暴力强取豪夺或者以提供非法物品及不正当服务为惯用手段 ,有组织地实施多种犯罪的社会邪恶势力 ,但与具有政治目的的党派或其他行帮、社团等有明显的区别。从历史的角度看 ,中国存在产生黑社会的肥沃土壤 ;港澳台黑社会势力的渗透是大陆黑社会形成的催化剂 ;多种经济成分并存 ,经济和政治的不正常结合必然产生黑社会“怪胎” ;老板与雇员之间的人身依附关系 ,是黑社会产生的组织基础 ;一些弱势群体寻求保护 ,也成为黑恶势力滋生、壮大的温床 ;对罪犯的改造效果减弱 ,也是滋生黑社会犯罪的重要原因 ;官场腐败进一步促使黑社会犯罪恶性膨胀。为此 ,应提高对治理黑社会犯罪紧迫性的认识 ,做好长期作战的准备 ;大力开展调查研究 ,进一步摸清底数 ;改革公安体制 ,加强组织建设 ;改进“打黑”办法 ,注重长期经营 ;整顿、纯洁公安司法队伍 ;改善执法环境 ,增强改造效果 ;健全有关反黑立法 ;认真搞好党的自身建设和政府的廉政建设。
