迁徙自由入宪与户籍制度问题探讨

迁徙自由是公民的一项基本人权,为国际社会普遍确认。它在我国曾经明文载入宪法,但由于社会历史条件所限,以后未加以明确。在新的历史条件下,第四次修宪首次将"人权"概念引入宪法。明确规定:"国家尊重和保障人权",这为迁徙自由入宪提供了前提。在此背景下,应积极推进户籍制度改革,以充分实现身份平等和迁徙自由。

人类共同继承财产原则虽然在国际社会获得了广泛的一致性,但对其具体内容,仍是莫衷一是,本文以“区域”及其资源为切入点,从人类共同利益出发,探讨了该原则的本质、内容及实践,并结合我国国情,简要阐述了人类共同继承财产原则与我国的关系。     

邓小平对马克思人的全面发展理论的独特贡献

邓小平没有提出系统的人的全面发展理论,但他明确地把社会主义社会广大人民的共同发展纳入社会主义本质的内容,并把它作为社会主义的基本原则和终极价值目标.邓小平思考的重点是如何在社会主义初级阶段给中国人的发展提供现实条件,明确提出社会主义初级阶段人的全面发展的具体目标是培养"四有"新人,这就进一步强化了实现人的全面发展的具体性和可操作性.     

论精神病患者强制收治程序的法律规制

随着精神病患者违法肇事案件的不断增多,强制收治患者行为越来越受到人们的关注。作为一种特殊入院方式,强制入院的实行,对于部分丧失意识能力,且对自己及他人构成潜在危险的精神病患者,无疑显得极为必要。可令人感到遗憾的是,由于我国立法尚未对此作出明确、统一规定,致使该措施在实际实行中,明显缺乏规范性。因此,应当对精神病患者强制收治程序予以法律规制。     

从实施人权公约的视角看我国行政判例对人权的保护

从1987年至2006年底,20年间各级人民法院共审结了120余万件行政诉讼案件。与之基本同时,最高人民法院通过创刊于1985年的《最高人民法院公报》,并依据2000年6月发布的《裁判文书公布管理办法》,至2006年底,总共发表了75件具有代表性的行政裁判。这些以公报案例、法公布文书和裁判文书选登等形式发表的行政裁判,已经成为人民共和国的最初行政判例。它们是被誉为重要的人权保障法的《行政诉讼法》正在得以有效实施的证明,不仅代表着中国努力建设社会主义法治国家的切实努力和中国大陆的行政审判水平与行政审判中的人权保护水平,而且展现了中国大陆正在以日益发展的司法手段,努力促进联合国人权两公约中规定的诸项人权的实施,在某些方面甚至正在拓展出新的人权保护范围和规范。同时,也面临着如何把人权保护范围,从主要限于人身权与财产权,平稳迅速地扩展到也受到人权公约保护的诸项社会权利和政治权利的问题。发展人权保障事业与建设和谐社会与和谐世界的新目标具有内在的同一性。行政判例,正在为我国实施经社文公约(CESCR),加入《公民权利和政治权利公约》(CCPR)作出积极的贡献。     

Human Rights and Unfair Dismissal: Private Acts in Public Spaces

This article addresses the termination of employment because of the conduct of the employee in her leisure time, in the light of the right to private life. It explores the impact on the retention of employment of activities taking place outside the workplace and outside working hours, and argues that the approach of UK courts and tribunals, which is based on a primarily spatial conceptualisation of privacy, is flawed. A fresh approach to privacy, resting on the idea of domination, is proposed, which is sensitive to the particularities of the employment relationship. Considering the fairness enquiry in dismissal, it argues that off‐duty conduct may lead to lawful termination of employment only if there is a clear and present impact or a high likelihood of such impact on business interests; a speculative and marginal danger does not suffice. It further proposes that a particularly meticulous test is appropriate when certain suspect categories, such as the employees' sexual preferences, are at stake.     

Y- STRs and forensic parameters in African populations

Short Tandem Repeat polymorphisms have been widely studied in the world, since specific databases are required to produce correct estimates of forensic statistical parameters. In this regard, Y-chromosome STRs have been studied mainly in Europe but are relatively scarce for sub-Saharan populations, despite these populations are represented in most of the Western countries. The aim of this work is to detect groups of populations with the lowest genetic variability within the African context. This allows to establish the relative homogeneity of Y-STRs databases for forensic casework and eventually to provide a wider insight into the African genetic history.     

Implementation of a robotized real-time PCR setup for the use of the Quantifiler™ Human DNA Quantification Kit

Human DNA quantification occupies a central role within the DNA analytic process of forensic casework samples as DNA quantification results have an important impact on the quality of the short tandem repeat data. Manual processing for the setup of quantification reactions can be time consuming and labor intensive. Therefore automation of quantitative real-time PCR setup was an important component of our DNA-analysis automation concept. Here we show the implementation of a robotized setup for the Quantifiler™ Human DNA Quantification Kit.     

中国法视野下的德国刑事诉讼制度

我国与德国的刑事诉讼制度有相似之处,但德国法律多了一些理性和节制。应借鉴其完备的法律制度,结合我国的司法实践,完善我国的刑事诉讼立法。     

论人本管理在寿险营销中的应用误区

人本管理，简单地概括就是“以人为本”核心理念在管理实践中的具体应用，其效果体现为内部员工对企业忠诚度的提高和企业外部良好社会形象的塑造。寿险营销无论从管理的形式上还是管理的内容上，都体现了人本管理，但从人性假设与制度基础两个方面来看，目前人本管理在寿险营销中的效果却与人本管理的目标相悖。
