Qualification and Disqualification in Rape Cases

Between 1946 and 1950, the police in Stockholm interrogated almost 150 men about their involvement in alleged rapes and attempted rapes. The results of these investigations eventually led to seventeen prosecutions and eleven convictions. It was not easy to convict someone of rape. However, a consequence of the way the court operated was also that only certain men could be convicted, only certain women regarded as reliable witness, and only certain kinds of attack regarded as plausible. The question of whether the alleged crime was considered possible to prove was dependent upon who reported whom for what. For the complainants it was a matter of qualifying for inclusion within the protection of the law. But what appeared as a rejection of someone's credibility, was in actual fact a result of a prior rejection of the individual's person and character. From the point of view of the legal system, some individuals were more fitted than others for the role of credible victim or likely offender. The sexually immoral woman and the man at the mercy of his sexuality were both in danger of having their credibility questioned: the former a poor victim and the latter all too suitable an offender.     

Equality and Postcolonial Claims of Discursive Injury

In Western Europe, individuals and groups increasingly claim that publicly enunciated denigrating racial discourse inflicts an injury upon them, and inscribe this claim under the rubric of equality. By adopting a method of claim‐centered critical theorizing, I discuss the possibilities and implications of reading “claims of racialized discursive injury” as claims to equality. A review of contemporary political theorists concerned with equality and injurious discourse establishes the democratic relevance of claims of discursive injury. A discussion of Judith Butler's theory of performativity then identifies the properties of the injurable subject and of discourse's power. Finally, I specify how a postcolonial stance enables us to grasp the actualization of discursive injury as it resonates between past colonial inequalities and threats of future exclusion or death. This equality‐focused reading sheds light on the transformative potential of claims of racialized discursive injury for resignifying equality in contexts marked by “race” and postcolonialism.     

实践与科学中的监狱学理论研究——读《监狱学导论》

监狱学是刑罚执行研究领域的一个重要组成部分。一段时间以来,我国监狱学研究出现了低谷,却不能因此而说明监狱学研究之花已凋谢。吴宗宪教授的《监狱学导论》一书即是一个例证。该书以其特有的研究风格、知识体系为我国当代监狱学研究与监狱学知识的整体构造树立了一个典范,同时也昭示着监狱学研究将会得到持续发展与开拓。     

《贵州民族研究》创刊40年“民族传统工艺研究”综述

民族传统工艺是重要的非物质文化遗产,是中华优秀传统文化的活态实践。新中国成立以来,专家学者一直关注传统工艺的传承与发展,作为学术研究论文发表的平台,《贵州民族研究》创刊40年来刊发了大量有关民族传统工艺的研究论文,根据所刊文章的基本情况、基本研究类型、创新启示等加以归纳分析,以期能对刊物今后的创新性发展和在传统工艺的挖掘、传承、振兴等方面产生借鉴作用。     

Leadership Styles as Perceived by Career Senior Service Executives

Abstract

This study identifies the prevailing leadership styles of career Senior Executive Service (SES) members of the Federal Government. This study also determines if an association exits between SES member's self‐perceived leadership style and personal characteristics, such as gender, years in the Federal Service, and highest academic degree earned. The study population consists of 6395 career SES members. A random sample of 364 career SES members was selected. The selected group was asked to respond to a demographic data questionnaire and the Styles of Leadership Survey (SLS). Over 34% of the sample completed the instrument and data questionnaire. This study reveals that Strategic Leadership Style (5/5) is the dominant self‐perceived leadership style of career SES members. The personal characteristics of gender, years employed in the Federal Government, and educational attainment were identified as being significant factors influencing leadership styles of Federal Government executives.     

《贵州民族研究》创刊40年“少数民族语言文字研究”综述

中华人民共和国成立以来,少数民族语言文字研究者深入民族地区,开展了少数民族语言文字调查,进行了大量的研究,取得了可喜的成果。《贵州民族研究》创刊40年来刊发了大量关于少数民族语言文字方面的论文,值得认真梳理并加以归纳综述。综合分析主要有少数民族语言文字工作、少数民族语言、少数民族文字、"双语"教育、少数民族语言文字翻译、少数民族语言文化等几个方面,在综述分析的基础上,对今后少数民族语言文字的研究提出了建议。     

在情理性传统中实现理性化使命——论中国传统价值观的现代化转型

西方文化以"理性"精神为主导,其率先步入现代化也与这种理性精神的普遍贯彻密不可分。相比之下,中国文化则以"情理"精神尤其是儒家的"血亲情理"为主导。由于两者之间的深度差异和张力冲突,中国社会如何在情理性的文化传统中完成理性化的历史使命,如何在肯定西方理性精神的现代意义的同时发挥中国情理精神的前现代-后现代意义,我们有必要通过"后儒家"的构想,探讨一条把中国传统的情理价值观加以现代化,以达成两种精神内在统一的可行途径。     

地方政府研究的三种路径：特征、优缺点及研究应用——兼评社会学近年来对中国地方政府的研究

在地方政府研究领域，既有研究成果通常包含着研究者对价值关怀、理论、经验事实三者之间关系的权衡和技术性处理，笔者以这三个侧面作为评述维度，区分了地方政府研究中的三条路径：即“参照-评估”路径，“视角-呈现”路径，“抽象-推导”路径，并以近年来关于中国地方政府问题的若干研究为例，讨论了这些路径的特征、优缺点及研究应用情况。笔者总结的这三条路径都是理想类型，在具体应用时，研究者可选择的路径是多元的，在地方政府研究中，研究者可以按照研究取向及研究需要选择与之匹配的路径方法。     

道路交通事故现场润滑油物证检验方法研究

在侦破交通肇事逃逸案件中,润滑油的鉴别是非常重要的。因此文中收集了108种不同厂家、不同品牌的适用于不同车型的润滑油样品,分别进行了荧光、薄层色谱、紫外光谱、红外光谱的检验,并建立了润滑油的系统检验方法,结果显示,上述方法用于润滑油样品的品种检验具有简单、快速、灵敏的特点。
