论我国企业开拓东盟市场的商标策略

伴随着中国—东盟自由贸易区的快速建设,东盟国家已成为中国企业境外投资的热点,但是部分征战东盟的企业没有取得预期效益,更有多家企业遭遇了商标被抢注的事件。本文介绍了东盟各国现行的商标法律制度,提出国内企业开拓东盟市场时应当采取的商标设计、商标使用、商标保护策略及商标被侵权后应当采取的措施。

Do Industrial Tax Abatements Spur Property Value Growth?

Despite ongoing debate regarding the effectiveness of tax abatements, Michigan's Industrial Facilities Tax (IFT) abatement program has been widely and extensively used to boost local economic development. In this article, we estimate the effects of industrial property tax abatements on industrial, residential, and commercial property value growth in the context of regional competition for a panel of 152 communities in the five counties surrounding Detroit from 1983 through 2002. We find that: (1) offering tax abatements yields statistically significant positive impacts on industrial property value growth; (2) the impacts are larger in high tax than in low tax communities; (3) there are positive spillover effects of industrial tax abatements on residential and commercial property value growth; (4) tax abatements offered in competitor communities do not appear to influence own industrial property value growth; and (5) changes in the own as well as competitor property tax rates are important determinants of industrial property value growth. However, the fiscal benefits of tax abatements are quite small as compared with the costs of offering abatements even when spillover benefits to residential and commercial properties are considered.

工商行政管理所(队)公务员激励机制的完善与否直接影响到工商行政管理所(队)公务员工作积极性的调动和工作效率的提高。本文以西安市L区的200名工商行政管理所(队)公务员作为研究对象,从工作满意度、所需激励因素、激励因素的实际供给情况、执法环境对工商行政管理所(队)公务员工作动力的影响以及绩效考评与工作动力的关系等方面分析了接受调查的工商行政管理所(队)公务员的工作状况,在此基础上探索了适合该群体的工资、福利、考核、在职培训、职务升降等方面的激励机制,以期对我国工商行政管理所(队)公务员管理的实践有所裨益。

《反垄断法》私人实施之难题及其克服:一个前瞻性探讨

我国反垄断法的私人实施面临受害人数众多,原告资格难以确认,被告违法行为难以证明,损害赔偿数额难以计算等诸多难题,而竞争文化的缺失,法律工具主义的流行,可能使私人实施反垄断法变得更为困难。将反垄断诉讼之原告限定为直接受违法行为影响的人,以反垄断执法机关或法院作出了被告违法的有效决定或判决作为受理案件的条件,实行因果关系推定原则,统一规定损害赔偿数额的计算方法,重视竞争文化的培育和传播,可有效地克服这些困难。     

Historical institutional child abuse in Ireland: survivor perspectives on taking part in the Commission to Inquire into Child Abuse (CICA) and the redress scheme

This article explores the experience of taking part in the Irish State’s Commission to Inquire into Child Abuse (CICA) and the subsequent redress scheme. The Commission was set up in 2000 with the task of investigating Industrial and Reformatory Schools that were in existence for most of the twentieth century. A redress scheme was also set up by the government to compensate those who were abused in these institutions. 25 qualitative interviews were conducted with male and female Industrial and Reformatory School survivors. The focus of this article is to understand some of the issues that this cohort of survivors faced in taking part in the inquiry and redress process, dealing with issues such as re-traumatisation, retributive justice and procedural justice.
