关于警民关系与社会稳定的思考

社会稳定是国家建设发展的保障,是国家繁荣昌盛的根基。保障社会稳定是公安机关的任务,也是公安工作的最终目的。警民关系是政群关系在社会上最直接的反映,体现着国家的执政状况、民主程度和文明进程,也是影响社会稳定的关键因素。警民和谐不仅是公安机关履行本职工作的重要基础,更是社会稳定的题中要义。     

Mental health symptoms in mutually violence： An empirical research on Taiwanese ＆ US couples

Although there are studies that have investigated the prevalence of dating violence among Taiwanese and U.S. college students, the mental health consequences of the victimization have not been investigated and compared between the two groups. The study explored the prevalence of mutual dating violence （MDV） and the relationship between victimization and mental health symptoms among Taiwanese and U.S. college student heterosexual couples （Taiwan = 1019; U.S. = 1049）. Results were that U.S. participants reported significantly higher partner violence victimization and perpetration than Taiwanese participants. Additionally, strong support for MDV was found in both Taiwanese and U.S. participants. Finally, multivariate analyses found that MDV was significantly related to mental health symptoms among Taiwanese females and males but only for U.S. females. These findings reveal the high prevalence of MDV and suggest similar mental health consequences are similar among some Taiwanese and U.S. victims and therefore, appropriate assessments should be completed to both members of the couple.     

Dharmakīrti on the role of causation in inference as presented in Pramāṇavārttika Svopajñavṛtti 11–38

In the svārthānumāna chapter of his Pramāṇavārttika, the Buddhist philosopher Dharmakīrti presented a defense of his claim that legitimate inference must rest on a metaphysical basis if it is to be immune from the risks ordinarily involved in inducing general principles from a finite number of observations. Even if one repeatedly observes that x occurs with y and never observes y in the absence of x, there is no guarantee, on the basis of observation alone, that one will never observe y in the absence of x at some point in the future. To provide such a guarantee, claims Dharmakīrti, one must know that there is a causal connection between x and y such that there is no possibility of y occurring in the absence of x. In the course of defending this central claim, Dharmakīrti ponders how one can know that there is a causal relationship of the kind necessary to guarantee a proposition of the form “Every y occurs with an x.” He also dismisses an interpretation of his predecessor Dignāga whereby Dignāga would be claiming non-observation of y in the absence of x is sufficient to warrant to the claim that no y occurs without x. The present article consists of a translation of kārikās 11–38 of Pramānavārttikam, svārthānumānaparicchedaḥ along with Dharmakīrti’s own prose commentary. The translators have also provided an English commentary, which includes a detailed introduction to the central issues in the translated text and their history in the literature before Dharmakīrti.

中日韩第四次首脑峰会使东北亚自贸区的建设提上了日程,但是敏感而复杂的政治安全形势对自贸区的发展构成了现实的挑战。基于功能主义的现有地区合作框架并不能解决该地区深化发展所要面对的问题,中日韩三国需要构建一种基于相互承认逻辑的新地区发展战略。     

全球化时代海陆关系的超越与中国的选择

在全球化时代,海陆关系发生着实质性的改变。从理论上来看,传统地缘政治的内涵、外延以及逻辑起点都发生了变化,因此,海陆关系要突破地理环境决定论、对抗性思维以及形而上学的思想桎梏,由片面的、静止的海陆关系向联合、互动的方向转变;从实证角度看,通过回顾海陆大国处理地缘政治关系的历史事实,提出当今海陆大国合作意愿不断加强,融合性思维逐渐替代对抗性思维的论断。全球化时代的背景下,中国在处理海陆关系上需要突出合作思想,把握地缘政治重点,处理好大国关系。     

International mutual legal assistance in criminal law made redundant: A comment on the Belgian Yahoo! case

This article offers a critical examination of the court judgements in a recent Belgian case against Yahoo!. It examines the challenges related to the establishment of jurisdiction for Internet-based services and the role that procedures of mutual legal assistance should play. Belgian law obliges providers of “electronic communications services/electronic communications networks” to cooperate with Belgian law-enforcement authorities and to handle over communication and personal data. Although the terms are derived from the EU Electronic Communications Regulatory Framework, a much broader interpretation to them was finally given by the Belgian Supreme Court. Seemingly this implies that, from now on, a US-based company such as Yahoo! is, at least under Belgian law, under a legal obligation to directly comply with an order issued by Belgian law-enforcement authorities.     

两岸政治互信的困境析论

两岸政治互信问题极其复杂,利益认知上的差异和冲突是根本原因;建立互信的过程,本质上就是追求利益重叠面、构建共同利益的过程。本文从利益认知与两岸互信的关系出发,先后讨论了“台独”势力、威慑战略、制度差异、台湾的“国际空间”、自信与互信的关系等重要因素与两岸互信之间的关系,其实也就是两岸互信面临的诸多困境,最后探讨了破解这些困境、建立两岸互信的根本途径。     

贵阳工业强市发展战略研究

“十二五”时期,贵阳市实施工业强市战略,对加快经济结构调整、转变经济发展方式、推进城镇化进程和保障民生等都具有重大意义,也是贵阳市建设生态文明市的现实选择。课题组通过实地调研,对贵阳市工业发展的现状进行了实证分析,并对贵阳市工业发展面临的问题和挑战、优势和机遇进行了分析。进而提出,贵阳工业强市战略要按照“走科学发展路、建生态文明市”的路径,坚持“加速发展、加快转型、推动跨越”主基调,加快工业发展方式转变,增强招商引资力度,重点发展和壮大特色优势产业、培育和发展战略性新兴产业、强化产业向工业园区集聚。
