现代科学技术的迅猛发展对司法审判产生了巨大的影响,各种科学问题、技术证据、鉴定意见呈现于法庭,法官在审判案件中由于知识和经验的局限性而难以判断,在此背景下专家辅助人制度应运而生。英美法系有专家证人制度,存在完善的以交叉询问为主的专家证人出庭质证规则,大陆法系国家和地区有诉讼辅助人制度,虽然立法中没有明确的出庭质证规则,但是有完善的鉴定人出庭质证规则。我国当前专家辅助人出庭质证规则没有明确的规定,但准用证人出庭质证规则。不过目前缺乏进一步的理论阐述,且简单直接适用也存在问题,同时缺乏系统的、具体的、具有可操作性的质证规则。对此笔者提出构建专家辅助人出庭质证规则的建议。  相似文献

农民法律意识的内部架构是,法律意识淡漠与对传统伦理和乡土规范的青睐相伴。其成因是:简单经济关系使其亲近法律缺少利益的驱动;农村家庭的生产职能滋养了具有生产组织文化特点的儒家伦理;人治传统下法律的作用使其缺少对法律的利益感受。觉醒农民法律意识有益于:构建市场经济运动之基础和市民社会之人格——心理基础;塑造崇尚权利的现代法治和民主政治运行之逻辑习惯。  相似文献

To participate in the global economy authoritarian states are pressed to offer international business a legal order that protects the interests of investors, customers, and sellers, but the creation of a modern legal order threatens to undermine the leaders’ control of public life. An increasingly common way to resolve this dilemma, I argue, is developing formal legal institutions that appear to meet world standards, while using informal practices to maintain control over the administration of justice when needed. In this paper I show how the governments of post-Soviet Russia (with its hybrid or competitive authoritarian regime) and the fully authoritarian People’s Republic of China as well, have used this approach in their relations with judges and defense lawyers in their respective countries. The analysis underscores the utility of investigating informal practices along with the reform of formal legal institutions, especially in the context of transition.  相似文献

Anti-corruption efforts in Europe’s post-communist states have been less successful than anticipated. Criticism has been raised against the role of the international community in promoting anti-corruption programmes. Besides, such programmes have been deemed vague and “all-inclusive”. They have largely failed to address local factors “informing” corrupt behaviour in post-communist states, such as (a) negative perceptions of law, and (b) informal practice.‘ I'd be grateful if you could retain the original sentence as it is more precise.  相似文献

Lavrentii Beria built up one of the most powerful patronage networks in Soviet history. Its success represents a unique case in Soviet history in which a regionally based secret police patron-client network, comprised primarily of representatives of ethnic minorities, took control first of the civilian leadership of one of the major regions of the Union, and then of the most powerful institution in the USSR, the national secret police, and subsequently became one of the main competing factions in the “crypto-politics” of the late-Stalin era. The fact that the Beria network emerged from the secret police gave it certain advantages in the political struggles of the period, but it also held weaknesses that played a role in Beria’s final undoing. The evolution and political struggles of Beria’s network also shed light on the inner workings of the competition among informal networks that made up the crypto-politics of the period. Using recent memoirs, new archival sources and interviews, this article will examine how Beria developed, managed and advanced his informal network, giving particular attention to the specific and unique outcomes that resulted from the rooting of this network in the secret police, at five critical junctures in Beria’s career.  相似文献

船员外派是指船员被选派到境外,且通常在外籍船舶上提供劳动服务。《中华人民共和国船员条例》把船员服务机构定义为从事代理船员办理申请培训、考试、申领证书等有关手续,代理船员用人单位管理船员事务,提供船舶配员等船员服务业务的机构。结合《中华人民共和国船员条例》《中华人民共和国船员服务管理规定》以及2008年颁布的《中华人民共和国劳动合同法》,对在船员外派中船员服务机构的身份和法律地位进行分析,厘清船员、船员服务机构和境外船东三者关系,从而确定船员服务机构在此类案件中应承担的责任。  相似文献

二次世界大战之前,国际社会普遍坚持条件责任原则,认为执行上级命令在一般情况下可以作为免除刑事责任的辩护理由;二战之后,纽伦堡审判确立了绝对责任原则,强调无论在任何情况下都不能将执行上级责任作为免除刑事责任的理由。《国际刑事法院规章》第33条是两种责任形式的融合。9.11事件后,恐怖主义的出现使国际社会对于执行上级命令能否免责的问题再次进行了思考。本文认为条件责任原则的存在,一方面是考虑到了军事社会的特殊性质,一方面也顾及到了当代对于战俘、普通民众的保护,并不会削减国际法的基础,是当代国际社会应当努力达成的目标。  相似文献

Abstract

This article seeks to analyse the informal borrowing sources of the poor as well as the purposes for borrowing. The obsession on characterising the poor as financially excluded fails to grasp their active financial lives. This article emphasises how relations of credit/debt are rooted in complex social and cultural forces. It is precisely because of the social embeddedness of credit that family finance, though interest-free, is not a first resort. Similarly, credit in kind from shopkeepers, though critical to consumption smoothing, is detested by some people. Also, it is argued that the involvement of the traditional leader in repayment enforcement in informal financial groups challenges the economistic narrative that attempts to separate credit from cultural norms.  相似文献
