社会转型中的城市社会群体问题是影响城乡社会整体和谐的重大问题。解决陕西城市社会群体问题应当以科学发展观为统领,着眼于经济社会的全面发展和最广大人民根本利益,紧紧抓住利益关系这个根本,统筹改革和发展的全局,从陕西的实际情况出发,整体谋划,标本兼治。     

团体保险中的“代理”规则与“通知——损害”规则——以美国两则典型判例为中心

团体保险不同于普通人身保险之处就在于被保险人的多数性,故在团体保险中必须创制合理的制度保护被保险人的合法权益。从美国两个典型的判例产生的"代理"规则和"通知—损害"规则的分析中,我们可以得出团体保险中这两个规则适用的许多启示。     

Interviewing serious offenders: Ms. Egghead meets Mr. Gumshoe

Organised crime, due to its intricate nature, is a very challenging as well as less accessible research field. Although difficult to conduct a methodical research on this topic, organised crime, nevertheless, offers a unique opportunity to utilise an interdisciplinary research methodology. This paper describes (multiple) triangulation as an appropriate method for researching the role of culture in the advancement of ethnic Albanian organised crime groups in Europe. Triangulation, for the purpose of the described project, has been used to obtain confirmation of findings through convergence of different perspectives. Interviewing offenders is one of the research methods more thoroughly explained in this paper. The paper too explores some advantages of snowball technique used for interviewing less accessible research subjects. It also discusses various dilemmas, security-related or not, researchers are faced with when intending to interview serious offenders.

论业主团体法律地位的确立

作为一种组织或者机构,业主团体在我国是一个实质存在而形式缺失的概念。只有承认业主团体的法律地位,才能解决业主委员会目前存在的没有实体可以依托的问题,并理顺业主团体与业主大会和业主委员会之间的关系。我们应当在立法上承认符合条件的业主团体的法人地位和民事主体资格,同时,明确业主团体内部组织的性质和法律地位,明确业主团体内部组织的相互关系和治理结构,以进一步完善我国物业法律制度。     

《孙子兵法》与处置群体性事件谋略

《孙子兵法》作为一部论述谋略智慧的军事巨著,在孙子“全胜”思想的指导下,主张通过认识战争规律来控制战局,用计策谋略来赢得战果。当下,公安机关根据群体性事件的特点,按照“以柔克刚、依法行动、注重实效”的处置原则,通常采用《孙子兵法》的“攻心”、“择机”、“拖延”和“就势”谋略,科学妥善的处置群体性事件。     

Gendered Pathways to Bullying Perpetration via Social Achievement Goals – Mediating Effects of Sense of Belonging and Non-inclusive Group Norms

ABSTRACT

This study investigated the gender-specific effects of social achievement goals – i.e., social development goals, social demonstration approach goals, and social demonstration avoid goals – on bullying perpetration in a sample of 788 adolescents (53.3% girls), taking into account the mediating role of sense of belonging and non-inclusive group norms. Two-group structural equation modeling results indicated that social demonstration approach goals positively predicted bullying perpetration for both genders. For girls, higher social development goals and for boys, higher social avoidance goals decreased bullying perpetration. Gender-specific effects of belonging and non-inclusive group norms on bullying perpetration occurred. For boys, non-inclusive group norms mediated the relation between all social achievement goals and bullying perpetration. Implications for future research and (gender-sensitive) bullying interventions are discussed.

代表人诉讼制度具有其他诉讼方式难以替代的独到的公共利益实现功能。代表人诉讼分为代表人共同诉 讼和代表人集团诉讼,前者是在共同诉讼的前提和基础上发展而来,后者则突破了共同诉讼的极限,在不要求所有的人 起诉的前提下,由代表人代表集团起诉,进行集团诉讼。
