目前,国际社会对公海保护区进行了一定程度的规范,但依然存在着没有直接的法律依据的处境。在此背景下,现有相关公约、条约或宣言等体现出来的法律原则为公海保护区提供了主要法理基础。公海保护区包括不同类别的法律原则,即国际法基本原则中直接与公海保护区有关的原则,国际环境法基本原则以及国际海洋法基本原则。公海保护区是适用于基本原则的领域,同时,它也是基本原则引中和发展出来的具体规则。  相似文献

In recent years, students in police academies and higher education institutions around the world have worked together to analyse cold cases including long-term missing persons cases in collaboration with investigators and prosecutors. In 2020, three European organisations, the Police Expert Network on Missing Persons (PEN-MP), AMBER Alert Europe and Locate International, succeeded in connecting these educational organisations enabling them to work collectively on cases and conduct cold case analyses (CCA) across international borders. The International Cold Case Analysis Project (ICCAP) learning objectives were to 1) collect the necessary information about the victim, 2) reconstruct the crime, and 3) investigate trace control.In a learning objective-based evaluation using Computer-Assisted Web Interviewing, 76 participating students from the German and International ICCAP teams were asked to complete a pre- and post-review questionnaire to self-assess their personal competence development. Participants reported significant increases in competence in all evaluated areas, thus demonstrating that authentic and relevant collaborations can enrich the learning environment, promote the use of professional skills, and provide significant knowledge exchange opportunities between academia and industry.Drawing on case studies of cold case missing persons' investigations and unidentified found remains, this article shares how university academics, students and community volunteers can work together nationally and internationally to find out what has happened to missing people and how we can more effectively identify the previously unidentified. In so doing, we share the expertise required to progress these cold cases and provide recommendations to support other institutions and organisations in adopting this innovative approach.  相似文献

国际社会活跃着大量不同类型的国际非政府组织,而目前只有为数不多且限于从事赈灾扶贫、文化教育、卫生和环保等领域工作的国际非政府组织允许进入我国。持续的对外开放将会有更多的国际非政府组织进入中国,部分国际非政府组织有可能给中国带来非传统安全威胁,但更多的组织能起到信息沟通和协调作用。国际非政府组织所强调的公平与正义价值观对于构建和谐社会有一定的启迪和促进作用,而国际非政府组织与中国本土非政府组织的互动将极大地影响到后者的发展趋势。应充分了解国际非政府组织的特性,在合理利用其观念和资金的同时,尽可能地把它们所带来的负面影响减少到最低程度。  相似文献

国际刑事法院是一个追究个人刑事责任的常设性国际刑事司法机构,它既不同于只处理国家间争端的国际法院,也不同于安理会特设的几个国际刑庭。其补充管辖原则表明,它对国内法院起着补充作用而不是优先于国内法院行使管辖权。国际刑事法院与联合国安理会是合作与协调的关系,但规约第16条规定安理会以通过决议的方式要求法院推迟调查和起诉这个机制存在很大的缺陷,它为政治干涉司法提供了方便之路。  相似文献

Over the past decade, as human rights discourses have increasingly served to legitimize state militarism, a growing number of thinkers have sought to engage critically with the human rights project and its anthropological foundations. Amongst these thinkers, Giorgio Agamben’s account of rights is possibly the most damning: human rights declarations, he argues, are biopolitical mechanisms that serve to inscribe life within the order of the nation state, and provide an earthly foundation for a sovereign power that is taking on a form redolent of the concentration camp. In this paper, I will examine Agamben’s account of human rights declarations, which he sees as central to the modern collapse of the distinction between life and politics that had typified classical politics. I will then turn to the critique of Agamben offered by Jacques Ranciere, who suggests that Agamben’s rejection of rights discourses is consequent to his adoption of Hannah Arendt’s belief that, in order to establish a realm of freedom, the political realm must be premised on the expulsion of natural life. In contrast to Ranciere, I will argue that far from sharing the position of those thinkers, like Arendt, who seek to respond to the modern erosion of the borders between politics and life by resurrecting earlier forms of separation, Agamben sees the collapse of this border as the condition of possibility of a new, non-juridical politics.

泉州回民在中国回民的社会史上占有特殊的地位.与全国其他地方的回族不同,泉州回民的西亚穆斯林先入主要通过海路而来,其穆斯林认同在历史上的起伏与泉州作为中古时期的重要国际贸易口岸密切相关,同时也与理学在福建的高度发展有一定的关系;随着泉州港的式微,泉州回民渐渐地失去了原有的穆斯林认同.新中国成立之后的国家政治需要有少数民族的参与,泉州的地方历史文化资源引起了地方政府的重视,泉州的回民也因此进入了国家的认同政治过程.对泉州回族的历史过程和他们近年来的穆斯林认同建构运动的分析与讨论支持了这样的一个假设:如果没有政府的民族政策,中国的民族形貌将与人们今日之所见全然不同.  相似文献

This article examines the effects of the Charity Commission’s implementation of risk-based regulation on the political campaigning activities of charities. In doing so, it draws on the findings of a recent empirical study which explored charity representatives’ awareness of relevant law and regulation and their perceptions of the obstacles they faced in their campaigning work. The article begins with a brief exploration of the emergence of risk-based approaches to regulation, followed by consideration of the legal and regulatory requirements for risk management by charities. Moving to its main focus of political campaigning, the article notes the unique legal issues faced by charities in campaigning work. It provides a comparative evaluation of the 2004 and 2008 versions of Charity Commission guidance CC9 on campaigning and political activity by charities (CC9) in terms of their approach to legal compliance, their formulation of the specific risks of campaigning and their approach to the process of risk management itself. In addition, the article considers the relevance to campaigning activity of the Commission’s current plans for an ‘enhanced approach’ to risk in its compliance work. The article concludes by considering the potential impacts on charitable campaigning of both the Commission’s overall approach to campaigning and its perceived risks, and of further entrenchment of risk principles in charity regulation.

This paper presents an evaluation of the Anti-Money Laundering and Combating Financing of Terrorism (AML/CFT) program. It briefly discusses why this can be seen as the birth of a “regime for financial integrity”. We find that some areas of the AML/CFT framework are consistently weaker than others in the area of prevention measures. Specifically, we have two findings: the first, positive one, points to a substantial adequacy of the repressive measures; the second, negative one, points to a substantial failure of countries to adopt adequate preventive measures, and calls for renewed efforts to improve implementation of preventive measures across the board, with specific regard to the activity of financial sector regulatory and supervisory authorities. Also, Eurozone countries outperform all other groups in the sample. Finally, the limited availability of country information and the multiplicity of assessors and methodologies make it difficult to evaluate the performance of the program. Therefore, we suggest greater transparency and availability of detailed countries’ information, and follow up assessments of the weak areas of a country’s AML/CFT framework at higher frequency than the established 5 years.
