论线人侦查行为的法制化

作为一种特殊的侦查手段,利用线人侦查行为收集犯罪信息和证据在刑事案件的侦查中发挥着不可忽视的作用。考察我国现阶段有关线人侦查行为的相关规定以及在使用线人侦查过程中所出现的问题,我们不难发现对于线人侦查手段的实施和法律规制已经成为相当棘手的问题。结合域外的司法实践,只有对线人侦查手段予以法制化,才能使其更好地发挥作用,以有力地打击刑事犯罪,保障人权。     

数字化时代的侦查措施转型

数字化时代的到来,使犯罪演进态势在质和量上发生了巨大变化,进而使刑事案件的构成要素发生变化。依照刑事案件构成要素决定侦查方法这一基本规律,刑事案件构成要素变化要求侦查方法创新,作为侦查方法子系统的侦查措施亦要进行转型,来回应数字化时代对刑事侦查理论与实践变革的呼唤。科技化与规范化是侦查措施转型的必由之路,但在推进侦查措施转型过程中要注意处理好以下关系:犯罪控制与保障人权的关系;方法创新、制度跟进与立法必要的关系;侦查措施转型中成本投入与现有侦查资源的关系;传统侦查措施与高科技侦查措施的关系。     

Evaluation of Topics in Utah's ONE‐HOUR Divorce Education Program

Divorce education programs are mandatory in most states. Despite the ongoing debate in the field regarding the appropriate duration of these programs, the goal of the current study was to identify the following five content areas in divorce education that may be most relevant for predicting favorable outcomes: (1) impact of divorce on children, (2) impact of divorce on family relationships, (3) financial responsibilities of divorcing parents for children, (4) benefits of positive coparenting, and (5) impact of domestic violence on children and family relationships. Using divorcing parents' self‐reported data (N = 3,275) from a one‐hour online divorce education program in Utah, we examined participants' post‐divorce intentions to treat each other respectfully, especially in front of the child(ren), and engage in positive coparental practices. The results showed that the program was effective in obtaining these objectives. We discuss these findings in depth and offer suggestions for future programs.

我国侦查辨认程序规范化研究初探

随着诉讼法治文明的不断推进,侦查辨认程序的规范化研究越来越受到理论界和实务部门的广泛关注。我国对侦查辨认程序的研究无论是距离法治化的要求还是从指导实践的需要方面都具有明显的＂滞后性＂。因此,我国侦查辨认应在考虑程序立法和司法现状的基础上,从法治文明和侦查实效双重视角来探讨侦查辨认程序的完善措施。     

论商法课程资源的开发和利用

商法课程资源是课程资源的有机组成部分,其开发和利用应该遵循互动性原则、开放性原则、针对性原则和特色化原则;其开发和利用的重点在教师的主体地位上,资源的载体形成是多元化的。开发商法课程资源应该充分结合当地社区、学校的特色和优势来进行,从社会需求的角度开发课程资源,注重培养学生将来更好地适应社会的能力。     

Y-chromosomal kinship estimation for forensic familial searching: YMrCA to the rescue

The Y-chromosome can be used as an identification method to find paternally related males of the perpetrator. When a close Y-haplotype match is identified, the time to their most recent common ancestor (tMRCA) needs to be estimated to reconstruct their genealogy. To date, two mutation models and three online tMRCA calculators exist. But, they do not include individual mutation rates with multi-step changes, while ignoring hidden multiple, back or parallel modifications. To improve tMRCA estimation, we developed a user-friendly calculator, the ‘YMrCA’, including all previously mentioned mutation characteristics. Here, a case using genealogical pairs with confirmed biological kinships visualizes the good estimation performance of the YMrCA compared to the state-of-the-art. Even when genealogical pairs have equal number of mutations, the YMrCA still estimates the correct number of generations due to the inclusion of individual Y-STR mutation rates and the different mutational influencing factors.     

对人民警察留置盘问权的法律思考

留置盘问权是《人民警察法》赋予人民警察当场强制扣押违法犯罪嫌疑人 ,对其进行讯问查证的重要权力。留置盘问是一种限制公民人身自由的强制措施 ,兼具行政性和司法性双重性质 ,其具有当场性、临时性、嫌疑性的特征。为在实践中正确适用留置措施 ,避免适用不当给公安机关带来负面影响 ,有必要对留置这一强制措施的性质、适用范围、适用程序等问题 ,在相关程序法中予以进一步规定。
