期待可能性理论之否定

期待可能性理论同规范责任论相适应，同我国通说的心理责任论并不相容；因我国尚未形成特有的罪过理论，加之传统刑法文化的遗失，才致使期待可能性理论备受关注；在我国刑事立法和司法实践中遇到的一些用期待可能性理论解决的问题，完全可以在犯罪动机的范畴内解决。     

世界银行扶贫贷款项目机构的满意度与期望值研究

本文是关于中国西南扶贫世界银行贷款项目贵州项目区受益农户、业务局对世行扶贫项目机构的满意度、管理印象、期望值的调查结果的实证分析。调查结果显示 ,不同民族、不同文化者均表示出对项目机构较好的满意度、心理认同和较高的期望值。从中也说明 ,世界银行贷款扶贫项目机构的制度化、专业化、规范化职能体系和财务报帐机制是扶贫项目机构在五年的项目过程中项目受益地产生良好社会效益的根本原因之一。同时扶贫项目机构不仅造就一批高素质、极具敬业精神和现代管理意识的管理队伍 ,而且这一“财富”又将有助于推动这一世纪的国际社会主题———“相对贫困”的扶贫管理工作走向科学和高效化。所以 ,项目机构建设的研究应该是长期而艰巨的     

关于人民币升值预期下我国货币政策有关问题的思考

在人民币升值预期下,中国要扩大对外开放,从中国自身的利益角度出发,应该实施由市场供求决定的灵活的汇率制度。政府不要干预过多,否则不可能存在比较独立的货币政策。因此,在我国建立一个有效的货币政策体系前,必须保持汇率稳定,以减少风险和波动。     

Effects of Public Service Motivation on Turnover and Job Satisfaction in the U.S. Teacher Labor Market

A substantial body of research has addressed the importance of the match between the person and the organization, or jobs for individuals and organizational outcomes across diverse fields. Despite growing attention to the role of the person–environment (P–E) fit, there are few studies incorporating the characteristics of jobs in the relationship between public service motivation (PSM) and job satisfaction. Drawing on the growing literature concerning PSM and teacher recruitment and retention, this study investigates whether altruistic work values, such as a strong altruistic desire and a preference for correcting social inequity, affect job satisfaction and teacher turnover.     

Work Engagement in the Public Service Context: The Dual Perceptions of Job Characteristics

Interest in work engagement research has increased significantly due to its positive influence on both employee and organizational performance. Studies show how engagement is explained through job characteristics in the Job Demands-Resource model, yet a more nuanced approach has been proposed. In this qualitative study, home caregivers’ perceptions of job characteristics are investigated. Semi-structured interviews and observations reveal three main themes: Optimization, helping others, and emotional work. These show a dual perception of job characteristics consequently influencing the experienced engagement. Using Public Service Motivation literature, these dual perceptions are discussed.     

Public Service Motivation and Job Sector Choice: Evidence from a Developing Country

This article explores the determinants of actual job sector decisions of highly skilled professionals across four different sectors in a developing country, with a particular interest in the relationship with public service motivation (PSM). Unlike most previous cross-sectional studies, it uses a pooled time series of individual antecedents and job characteristics, both before and after the individuals leave the job market to pursue graduate education abroad. The results indicate that there are key differences in terms of the determinants of job sector choices across the four sectors, and that PSM appears to have a differential role on the attraction of individuals to each of those sectors.     

论“合理期待原则”在保险法中的适用——以司法裁判为视角

“合理期待原则”建立在保险合同附合性基础上,但与疑义不利解释、格式条款的说明义务、免责无效制度等格式条款传统规制规则不同,其是在总结、反思上述规则的基础上,产生的一种独立的保险合同规则。适用“合理期待原则”并不是简单地满足投保人的主观期待,而是在探究可能导致投保人与保险人利益失衡的各种客观因素的基础上,为平衡保险各方权利义务而做出的必要司法调整和干预。“合理期待原则”的适用会导致一定程度上的缔约自由萎缩,为了保持司法的谦抑性,有必要明确“合理期待原则”的客观适用标准和具体适用程序,以实现公平和效率的统一,并为我国最终引入该规则提供有益的借鉴。

检察事业的基础在基层,难点在基层,希望也在基层.从1978年检察机关恢复重建至今的三十年中,基层检察院的整体状况有了长足的进步.回顾这三十年来基层检察工作所取得的成绩,正视并分析当前基层检察工作中存在的问题,以及探索未来基层检察工作的发展方向既有利于进一步推动基层检察院的建设,也关乎检察事业的整体向前推进.     

Religion und Arbeitnehmerschutzgesetzgebung: Eine Fuzzy Set‐Analyse

This article focuses on the relationship between religion and employment protection legislation in Western democracies. While Esping‐Andersen claimed that catholic social teaching is the most important determinant of the level employment protection legislation, we argue that his argument must be extended by introducing political actors, religiosity and a distinction between lutheran and reformed Protestantism. The empirical part shows that religious factors can explain part of the observed variation, but the discussed extensions prove to be crucial.     

新加坡的职业再造计划及其启示

为降低日益严重的结构性失业问题对劳动力市场的冲击,新加坡工会、雇主、政府三方合作推出职业再造计划,试图通过提升职业形象、改善劳动条件、在提高效率的基础上提高工资的方法增加这些职业的吸引力,并在现有职业的基础上识别和发掘出更多的就业机会以利新加坡人就业。新加坡的经验对中国解决结构性失业问题提供了有益的启示。
