在因果流程中,如果实行行为能够被评价为危险现实化了,就能够肯定事实性因果关系和结果归责。危险的现实化包括直接实现型与间接实现型。前者包括不受介入因素干扰的直接实现与受到介入因素干扰的直接实现。后者是指实行行为的危险以介入因素为媒介而得以现实化,包括介入被害人行为、第三人行为、行为人行为。若能够评价为介入因素是实行行为所诱发的,实行行为内含引发介入因素的危险,且介入因素并非异常,就意味着实行行为的危险最终在危害结果中现实化了。通过对危险现实化判断的类型化,建立刑法结果归责的判断模型,是将外来理论学说在我国本土化努力的一部分。  相似文献

Studies have begun to explore how those women academics committed to social justice, namely feminist academics, are navigating the increasingly managerial Academy. To understand how these multiple social identities, including gender and ethnicity, interact and intersect, this paper adopts an intersectional approach to understanding the heterogeneity of women’s experiences in academia. Five focus groups with feminist academics (n = 6–10 in each focus group) reveal concerns of hampered career progression as a consequence of being female and openly feminist. Some ethnic minority academics felt that they were forced to choose between a feminist identity or that of their ethnic background. For some women, their feminist identity provided opportunities for challenging dominant practices. The paper concludes that the heterogeneity of feminist academics’ experiences within academia is under-researched and that the lens of intersectionality helps to illuminate this. This paper advances understanding of multiple identities at work, though demonstrating that intersectionality can lead to the accumulation of advantage as well as disadvantage in relation to social identities such as gender and ethnicity, and a political identity such as feminist.  相似文献

The success or failure of international peacebuilding missions is predominantly evaluated in reference to interveners’ ability to exercise their mandated authorities. To test the value of an empirically based analysis of authority-building processes in the course of such missions the article turns to the United Nations Transitional Authority in Cambodia (UNTAC, 1992–1993). In order to safeguard the country’s stability many supported the idea of holding presidential elections in addition to the ones for the Constituent Assembly forming the new government. To organize such unforeseen elections UNTAC would have had to change its mandate as determined by the Paris Peace Accords (PPA). Based on extensive archival research the paper analyses the debate surrounding this proposal as a series of legitimacy claims that were selectively recognized and rejected. The article concludes that evaluations of peacebuilding missions are indeed too focused on interveners’ authority to decide, while neglecting or underestimating challenges to their authority to interpret. This fosters a false sense of control over the direction of political processes.  相似文献

This study examines the latest tendencies in Russian research on public administration (2010–14) as it appears in Russian academic journals. The study considers the subjects of articles, their methodological features, and the characteristics of contributors. Revealing problems in public administration research in Russia contributes both to the development of Russian science and to the ongoing international discussion regarding the need for better research on public administration and state policy. By drawing attention to the shortcomings and weaknesses of Russian public administration research, the study is meant to advance the current discussion on ways to strengthen the quality of policy research around the world.  相似文献

This article asks how rebel leaders capture and lose legitimacy within their own movement. Analysing these complex and often uneasy relations between elites and grassroots of insurgency is important for understanding the success or failure of peace processes. This is because internal contestation over authority between rival rebel leaders can drive a movement’s external strategy. Based on ethnographic research on the Karen and Kachin rebellions in Myanmar and insights from Political Sociology, the article suggests that leadership authority is linked to social identification and the claim to recognition among insurgent grassroots. If rebel leaders manage to satisfy their grassroots’ claim to recognition, their insurgent orders are stable. Failing this, their authority erodes and is likely to be challenged. These findings contribute to understanding insurgency and peace negotiations in Myanmar and civil wars more generally by showing how struggles over legitimacy within rebel groups drive wider dynamics of war and peace.  相似文献

在风险社会语境下,中国农业除要面对自然和市场的双重风险,还要面对科学技术和政策变递等带来的振荡。对农业风险的预防和治理需要政府发挥主导作用,而政府干预不当却可能诱发或加剧农业风险。海南爆发的“香蕉危机”作为中国现代农业产业危机的缩影再次暴露出在农业生产经营和农业风险管理方面政府干预存在的严重问题,文章试图通过对海南“香蕉危机”事件的分析,剖析政府干预在农业产业危机的形成与治理中的作用,并进而提出政府适度干预以应对农业产业危机的对策与建议。  相似文献

民事诉讼《证据规定》第64条第一次以司法解释的形式,明确规定了法官在没有法律规定,或者法律规定不明的情况下,运用日常生活经验进行自主判断的权力,为法官的“无法”司法提供了制度依据。而法官的自由裁量离不开司法经验,广义的司法经验是泛指司法实践活动中逐渐形成和积累的关于法、法律和案件纠纷处理方面的知识和技能,是整个司法实践活动中形成的司法职业共识。狭义的司法经验则仅指法官个人在司法实践活动中的心得和体会,以及逐渐积累的知识和技能。在成文法背景下,司法经验的功能主要体现在法官的事实审理过程,具体地讲,司法经验在司法认知、事实推定、法律和证据选择、证据判断和证据采信等方面具有重要作用。因此,应当重视司法经验,并且在司法实践中合理利用司法经验;同时为防止司法自由裁量权的滥用,将司法经验的使用限制在合理的制度允许的范围内。  相似文献

清代台湾南部的鱼塭经营是台湾史研究一个比较薄弱的环节。本文利用晋江东石蔡氏的家族文献,结合地方史志以及田野调查等资料,对清代东石蔡氏在台湾布袋嘴的鱼塭经营进行纵向考察,同时就此个案反映出的股权经营形式进行探讨。文章认为,清代台湾的鱼塭经营有多种股权形式,一种为长期合股经营,另一种是在此基础上演变出来的更为复杂的股权形式,如蔡氏经营的北中横塭就有塭底份(大税)、韫佃份(小税)、现耕塭份,以及承包者再行转髅的堤份等。这些不同层面的权力,既与土地经营有某种关联或类似性,同时也有自身的特点。  相似文献
