本文在对我国民事诉讼检察监督历史考察的基础上 ,针对当前我国民事诉讼检察监督的权限、审级和结案方式等问题进行了剖析 ,并提出自己的观点。     

英语写作中的中国式英语错误分析

中国式英语是英语写作的最大障碍之一,在措词、句式、篇章结构等方面严重影响英语写作的质量以及书面交际的效果。因此有必要对其产生的原因进行错误分析,在此基础上提出相应的对策,来帮助学生在英语写作中,尽量避免中国式英语的出现,切实提高学生的英语写作能力。     

对预防交通民警在执法中遭受不法侵害的思考

近年来,交通民警在执法过程中遭受各种不法侵害的事件在不断增多。当前交通民警受到不法侵害的原因是多方面的,从起因上来看,不法侵害可分为以下两种类型:第一是由犯罪行为引发的不法侵害;第二是由交通执法纠纷引发的不法侵害。为了有效降低交通民警遭受不法侵害,应提高民警自我保护的能力,完善交警应急指挥机制,改善媒体导向的环境,提高交警执法工作水平。     

对海德格尔和列维纳斯死亡概念的比较分析

死亡是哲学的永恒主题。海德格尔将死亡定义为一种不可能的可能性。与此相反,列维纳斯将死亡界定为“可能性的不可能性”。海德格尔给“不可能性”以优先性,对他来说,作为此在的我们面对的死亡是一种无法超越的可能性。我们也可以说,海德格尔从死亡的角度观察生命。而列维纳斯则是将死亡与生命的观点一起考虑,因为他觉得只有生命才能为我们打开可能性;从生命的视角看,死亡是所有可能性的终结,即不可能性。     

From CNOOC to Huawei: securitization,the China threat,and critical infrastructure

ABSTRACT

This article uses critical discourse analysis to examine how China has been constructed as an existential threat by the United States. Specifically, it explores how US reactions to the China National Offshore Oil Corporation (CNOOC) in 2005 created precedent for similar reactions to Huawei a decade later. It uses these case studies to demonstrate how the interplay between the China threat and security discourses of critical infrastructure has worked to successfully securitize China within broader American discourse. These examinations demonstrate a deliberate and protracted securitization of China by US elites, and they support more critical approaches to securitization theory that emphasize cumulative and incremental aspects over a securitized/de-securitized binary. Discourse analysis of key texts allows the reader to uncover how security issues are socially constructed, and discursive examinations of CNOOC and Huawei illustrate how concerns about national security are now employed in everyday American political discourse so that the China Threat Discourse has become the primary reading of China by US observers.     

高职商务英语专业学生语言综合能力提升途径——基于ESP需求分析理论的视角

ESP需求分析理论要求,ESP课程的教学应该以目标岗位的能力要求为依托。商务英语作为ESP的重要分支,其教学过程也应该遵循这一原则。因此,在商务英语专业的语言教学过程中,通过对本专业目标岗位群进行统计分析,再依据这些岗位对语言方面的能力要求形成本专业语言综合能力的内涵,以此为总体要求来厘清专业能力的培养目标,指导语言教学,提升学生的语言综合能力。     

An Economic Analysis of a Swedish Environmental Liability Case

A High Court case illustrates Swedish legal reasoning. The case extends the use of strict liability, although the main liability rule is negligence. The aim of the paper is to show the usefulness of the economic analysis in a practical case. The case concerns liability for damages caused by a leaky, hot-water pipe. The defendant maintained that it should not be held liable because it had not acted negligently, and the district court and the court of appeals supported the defence. Nevertheless, the High Court decided on strict liability. The High Court used a line of argumentation that, partly and implicitly, may have been economically correct. However, the precedence was most limited and unclear. Given an explicit goal of economic efficiency, the precedence would, in this simple and straightforward case, be that strict liability should prevail where the cause is unilateral and the injurer is able to cover and/or insure the loss.     

论公司、企业高层管理人员职务侵占犯罪案件的特点及侦查对策

当前职务侵占犯罪中，犯罪主体身份为公司、企业高层管理人员的案件较为突出，这类案件的案源大多来自于其他股东或出资人的举报，犯罪手段隐蔽，智能化程度高，共同犯罪或指使手下操作的较多，案情复杂，侦查难度大。对此，侦查机关应缜密初查，准确定性，在侦查中立足证据调查，恰当运用询问策略，通过查证书证材料寻找犯罪痕迹，并利用证据突破口供，最终查清犯罪行为的各个环节。     

吉林省民营经济症结分析与发展路径研究

吉林省民营经济发展起步晚、规模小、效益不高、结构不合理,与发达地区相比还明显处于落后状态。而市场的约束、融资瓶颈的制约、发展环境差、缺少优秀企业家队伍等都是吉林省民营经济发展落后的症结;从振兴东北老工业基地出发,民营经济的发展对吉林省经济社会的发展将起到不可或缺的作用。因此,全社会应达成共识,积极营造民营经济健康、公平、快速、持续发展的社会环境,使之获得更大的发展。     

换一种思路看犯罪分析技术

近几年，通过刑侦理论界有识之士的不懈努力，犯罪现场重建等先进的犯罪分析技术已经被许多刑事侦查人员所认知，其中一些理念已经应用到实战中。但是，在实践中，一些刑侦人员的现场分析水平往往连传统现场分析所要求的标准都达不到，所以我们应该将先进的犯罪分析技术引入侦查实践，重视和弥补犯罪分析技术在实际应用中的不足之处，使犯罪分析技术更好地为侦查破案服务。
