牟宗三对康德之误读举要——关于“智性直观”（上）

牟宗三认为,康德哲学中的“智性直观”这个概念可以作为康德哲学甚至西方哲学向中国哲学过渡的桥梁。但是牟宗三对康德的这一概念的理解是不准确的,而且他从康德的这一概念过渡到中国哲学的立场也是不合法的,实际上这是从康德的批判的高度退回到了非批判的独断论的陷阱。     

域名权可为抵押权标的之民法分析

知识产权具有不同于其它可供作为质权标的的性质 ,而具有极类似于抵押权标的的性质。知识产权作为抵押权的标的 ,符合现代物权法定原则的发展趋势。域名权应具有权利的地位 ,是一种独立的知识产权。域名权可作为抵押权标的 ,在物权法中可通过两种途径来实现 :一是在可抵押的财产中列举符合抵押权标的本质特征的知识产权种类 ,将域名权包括在内 ;二是在企业财产的集合抵押中予以规定 ,即域名权以一个企业的集合体的形式共同设定抵押来达到设定抵押的目的。构建域名权抵押制度 ,还应在立法中明确规定域名权抵押公示制度 ,完善域名权抵押的价值评估机制。     

制动“337”——中国知识产权国际战略的必然选择

近年来,中美贸易摩擦频发,其中,美国以保护本国知识产权为由频频对中国输美产品发起的337调查已严重影响了中国的出口,成为中美知识产权交锋的主要战场.应对337应是中国政府带领中国企业全面进行的一场战略,其中政府的作用应该更加凸现.除了更深层次了解337条款的特点和程序以外,政府应尽快建立由商务部、产业主管部门、行业中介机构、涉案企业、律师"五体联动"的应诉机制,并利用337条款与世贸组织协定的矛盾性通过中美双边磋商和世贸组织多边协定法律框架来应对化解"337危机".制动337,应成为中国正在制定的知识产权战略国际战略部分的重点.     

TRIPS-Plus Free Trade Agreements and Access to Medicines

The battle over access to essential medicines revolves around the rights to issue compulsory licenses and to manufacture and export generic versions of brand name drugs to expand access. Global brand name pharmaceutical firms have sought to ration access to medicines and have used their economic and political clout to shape United States trade policy. They have succeeded in getting extremely restrictive TRIPS-Plus, and even US-Plus, intellectual property provisions into regional and bilateral free trade agreements. Asymmetrical power relations continue to shape intellectual property policy, reducing the amount of leeway that poorer and/or weaker states have in devising regulatory approaches that are most suitable for their individual needs and stages of development. While the overall trend is disturbing, some recent activities in the World Health Organization and evidence of greater unity behind health-based TRIPs flexibilities provide some grounds for cautious optimism.

知识产权与公共利益密切相关,其不当使用会对公共利益造成极大的侵害。而现有的民事诉讼制度又不能对受损的公共利益提供救济,因此有必要构建知识产权公益诉讼制度,文章论证了构建知识产权公益诉讼的理论基础,对知识产权公益诉讼的受案范围、原告资格、诉前禁令、诉讼费用等进行了具体的制度设计。

后马克思主义是西方马克思主义在后现代以非学院化与去学科性的文化研究为主要方式与种种前沿理论的复杂互动.它们有着德法英美源头与主脉,对马克思主义既是挑战又有在低谷中的复兴作用.在“理论之后”西方知识左翼面临危机,盛极而衰,期待着新人、新思维和新理论.新近,日本后马克思主义者柄谷行人从康德到马克思的“跨越式批判”,把经济视野带回文化研究.他以消费者的联合实现资本-民族-国家解体的共产主义途径,仍然是一种新乌托邦.与之相对,杰姆逊提出维护福利国家“大政府”实现剩余价值再分配的方案,则比较接近马克思关于资本自身否定的逻辑.这是一种“回到马克思”之超越.     

Is administrative enforcement the answer? Copyright protection in the digital era

Copyright protection is becoming more challenging by the day in the digital era. In line with its political policy, China has established a copyright regime with particular characteristics. While the public interest in access is highlighted, the public interest in authorship has also been imposed and taken further. It also provides for public, non-criminal enforcement - copyright administrative enforcement. Could the Chinese model possibly be a solution for effective copyright protection? This will be explored in the light of an up-to-date case analysis in both actual and virtual environments.
