警察权力是国家权力的重要组成部分,它来源于公民权利,又服务于公民权利,两者既相互依存,又须保持动态平衡.而近年来涉警群体性事件的频发,从深层原因来分析,主要是由于警察权力的盲目扩张、高度扩张,造成警察权力的滥用,严重侵犯了人民群众自身的利益,因此一定要把警察权力关进制度的笼子,防止其侵害公民权益.     

刑事拘留引起的国家赔偿与赔偿监督

由于我国刑事诉讼法的规定和公安机关办案程序的原因,公安机关撤销案件的法律依据缺位,对公安机关采取刑事拘留措施后引起的国家赔偿和检察机关赔偿监督造成很大的困扰,文章提出解决现实困境的设想:公安机关撤销指控或出具《侦查终结告知书》。     

我国生产者责任延伸制度实施困境分析——从家电以旧换新政策实施谈起

生产者责任延伸是解决废弃产品问题的一项新兴的环境策略,在我国已初步构建并开始实施。为拉动经济增长,促进废旧电器电子产品的循环利用,我国实施了家电以旧换新政策。但该政策实施后遇到的一些问题,如回收企业技术落后不能满足回收的大量废弃电器电子产品的无害化资源化处置、生产者组织和废弃产品处理基金制度没有有效建立、政府行政干预机制和经济激励机制的缺位、法律规定的空白等阻碍着生产者责任延伸制度的实施。     

Filling the Moral Void: The Christian Right in Singapore

In March 2009 a group of Anglican Pentecostal women took over the Association of Women for Action and Research, a secular women's rights group in Singapore. This sparked an intense month-long public debate over a variety of issues which included the increasing aggression of the “Christian Right,” the secular nature of public space in Singapore, sex education and tolerance for gay communities, culminating in state intervention. While conventional sociological studies have suggested a variety of explanations for the growing presence of Pentecostal Christians in the public sphere, such as religious stratification or their links to party politics, few have examined it within the framework of nation-building. This paper seeks to understand the recent emergence of the “Christian Right” and its exposition on various moral issues within a historical context – a context from which the People's Action Party government successfully arose, in part, due to its self-construction as a moral state, and argues that the post-industrial challenges of globalisation have forced the government to be less morally conservative, resulting in a perceived moral vacuum which certain segments of Pentecostal Christians have felt compelled to fill.     

African Renaissance: The need for gender-inclusive developmental states

ABSTRACT

This article was developed from a paper presented at a seminar at the Africa Institute of South Africa in Pretoria in 2006 while the author was an Archie Mafeje Fellow. It argues the urgent need for the construction and consolidation of gender-inclusive democratic developmental states as central to grounding the concept of an African Renaissance, for an effective transformation of the human condition, and for ensuring that this renaissance does not become romanticised and meaningless. While the notion of developmental states has gained currency in recent years, very little, if at all, has been said about gender in relation to these debates – despite the United Nations warning that ‘without engendering development, development itself is endangered.’ In other words, formulating and implementing development policies with gender lenses are crucial for development.     

This violence good,that violence bad: normative and state-centric discourses in British school textbooks

ABSTRACT

Under the statutory obligations of the Prevent strategy, British schools have greater responsibility to counter terrorism and extremism than ever before. However, research has yet to fully explore how schools tackle such a complex issue in the classroom. This research critically examines the discourses of terrorism and extremism found within British secondary school textbooks to deepen understanding of how terrorism and extremism are taught in schools. This article deploys a mode of critical discourse analysis to assess and critique the ways in which the political realms of terrorism and extremism are constructed. I argue that these discourses construct an ethical proximity between the text, the reader and the state, while rendering voiceless both the “terrorist” and the civilian living in states prioritised by British foreign policy. As such, this article argues that British school textbooks construct a normative perspective through which the violence of states is sanitised and normalised. It raises concern regarding the role of contemporary schooling in perpetuating a global politics of violent foreign policy.     

PENALITY AND THE PENAL STATE

The sociology of punishment has developed a rich understanding of the social and historical forces that have transformed American penality during the last 40 years. But whereas these social forces are not unique to the United States, their penal impact there has been disproportionately large, relative to comparable nations. To address this issue, I suggest that future research should attend more closely to the structure and operation of the penal state. I begin by distinguishing penality (the penal field) from the penal state (the governing institutions that direct and control the penal field). I then present a preliminary conceptualization of “the penal state” and discuss the relationship between the penal state and the American state more generally.

实案测试中被测试对象心理状态探析

心理学的研究离不开各种实验,心理测试技术(俗称"测谎"技术)实际上就是心理学实验方法的一种。此项技术在我国的研究应用已经30多年,辅助司法领域进行了大量的实案心理测试①。不仅对陷入侦破困境的案件起到很大作用,也对心理学在实战领域的应用研究提供了一种实验范式。对进行心理测试案件的研究发现,很多的变量都会影响到测试的结果,进而影响测试效度。被测人②的心理状态是其中很重要但是很容易被忽视的因素之一,这是一个非常值得关注研究的领域,不仅关系到心理测试技术的发展,也关系到司法领域人权和司法公正问题。
