房地产抵押权的实行与相关权利的协调

房地产抵押权的实行是房地产抵押权效力的最终体现 ,但在其实行过程中往往需要与已存在的其他相关权利进行协调。债权人应先实行房地产抵押权 ,只有在抵押物拍卖后仍不足以清偿债务时才享有对债务人其他财产的求偿权 ,亦即应采取先行主义。房地产抵押权的实行要受在先存在的优先权与租赁权的制约。房地产抵押权的实行也不得对抗国家受益权。

AN EXPLORATORY STUDY OF THE VIOLENT VICTIMIZATION OF WOMEN: RACE/ETHNICITY AND SITUATIONAL CONTEXT*

Although much has been learned in recent years about the victimization experiences of women, there remains a considerable knowledge gap with respect to the victimization of women of different racial and ethnic backgrounds. In order to confront this issue, we use the large number of cases available in the National Crime Victimization Survey (1992–2000) to examine the risk and protective factors associated with violent victimization among non‐Hispanic white, non‐Hispanic black, Hispanic, Asian/Pacific Islander, and Native American women. We then describe in more detail the violent incidents against these women, looking for distinguishing patterns across groups. Our results are useful for fine‐tuning theories of victimization to explain variance in violence for females across racial and ethnic subgroups.

公共利益限制基本权利的逻辑

以公共利益作为基本权利的限制是各国宪法之通例 ,“公共利益”和“法律保留”分别构成了限制基本权利的实质要件和形式要件。对于公共利益和基本权利的关系 ,有两种不同的理解 ,即“外在限制说”和“内在限制说”。“内在限制说”的危险性较之“外在限制说”为小 ,但其可能提供的权利保障范围也小于“外在限制说”。而且 ,“内在限制说”有着为严谨的法学学理所不能容纳的逻辑问题。故而 ,可以采纳的学说仍然是“外在限制说” ,但是必须通过确定一定理念与规则去消除其危险性 ,也就是对“公共利益”作出严格的限制 ,对“权利的限制”进行限制。     

BEING PURSUED: STALKING VICTIMIZATION IN A NATIONAL STUDY OF COLLEGE WOMEN*

Research Summary: We provide the results of a 1997 national‐level study of stalking among college women. Over an approximately seven‐month period, 13.1% of the women reported being stalked. Although physical harm was not common, the incidents typically lasted two months, involved frequent contact by offenders, and prompted victims to take protective actions. Lifestyle‐routine activities, prior sexual victimization, and demographic characteristics affected the risk of victimization. Policy Implications: Due to its prevalence, college and university administrators need to rectify their current neglect of stalking. Interventions may include educational programs, crime prevention seminars, reducing opportunities for stalking, and increasing informal and formal controls over stalkers.     

National Academy of Sciences “Standardization”: On What Terms?

The frequently cited 2009 National Academy of Sciences Report entitled “Strengthening Forensic Science in the United States: A Path Forward” has become a focal point of forensic science practitioners' discussions and research since its publication. One of its recommendations is “Standardized Terminology and Reporting”. Little has been published to date on this topic, although conversations and dialogs on the subject are ongoing. The upshot of this communication is to draw attention to the problem of one term in particular, perimortem, which may be only the proverbial “tip of the iceberg” in the lexicon‐related concerns of forensic scientists. Even if it is an isolated issue, it is one that reflects the need for a consensus on term use and definitions by interdisciplinary practitioners who are currently using the term haphazardly, to the confusion of colleagues and potentially finders‐of‐fact in the courts.

侦查学作为一门实践科学,其理论基础何在?这是一个为许多学者苦心孤诣所追问并试图揭示的问题。博弈论对于侦查中的策略与行为选择具有很强的解释性,实际就是解构了侦查策略和侦查行为选择的理论根据,对于现实的侦查行为具有很好的指引作用。李双其教授的最新专著《侦查博弈论》就是将博弈论全面运用于侦查学基础理论研究的重要成果,不仅具有开创意义,也深具独到见解。当然,该著述的得失,还有赖于更多的读者来评说。
