This article provides a critical analysis of the Council of Europe Cybercrime Convention Committee's Guidance Note of Production Orders, published on 1 March 2017. The article looks at the legal controversies surrounding production orders with a cross-border element. It explains the Guidance Note's background and origins, the basic provisions in the Cybercrime Convention allowing the law enforcement authorities to order and obtain certain information and discusses the requirements that follow from the relevant provisions of the Convention. This analysis is complemented by four critical remarks on the way the Guidance Note pushes the boundaries of acceptable treaty interpretation on the necessity of the Guidance Note, its position in regard to extraterritorial enforcement jurisdiction and sovereignty, its reticence towards fundamental rights and its refusal to define or clarify the important notion of “subscriber information”. The article argues that unilateralism is not a solution. Instead of soft law plumbing, what is needed is an agreement between sovereign states checked by their constituencies.  相似文献

This article analyzes the extent, substance, and underlying objectives of the European Union's (EU) new neighborhood policy in response to the Arab Spring. It questions whether the new policy approach constitutes a major policy shift or is just “old wine in new wineskins.” The article discusses the causes for much continuity and limited change in the new policy from a neo-institutionalist perspective. It concludes that both continuity and change primarily result from constraints inherent to the EU. In particular, the interaction between the Commission and the Council shapes a policy that corresponds with the normative aspirations and realist interests of the EU but hardly with the needs and expectations of the partner states.  相似文献

This article analyzes the European Union (EU) policy for democracy assistance toward the Southern Mediterranean countries and tracks changes in the last decade, with a special emphasis on the most recent period. It shows that the EU policy, which goes under the acronym of EIDHR, has evolved, but predominantly in response to internal dynamics rather than to developments in Arab countries. The EU has increasingly provided assistance to local actors on the ground in non-member countries and has differentiated its action in authoritarian countries from countries in transition. When it comes to implementing its own policy, however, the EU is less able to promote democracy than human rights, and most of the funds go to support projects centered on relatively uncontroversial rights such as women's and children's.  相似文献

民事没收是一种对物不对人的制裁措施,它所针对的是一类特殊的财物,即犯罪收益。民事没收可以在没有刑事案件的情况下没收财产,即便被告人已经死亡或者在逃,甚至即便还不知晓谁实施了违法行为。民事没收适用民事诉讼的"谁主张谁举证"原则,要求那些声称对财物享有合法权利的人员承担相应的证明责任,并且只要求法官"根据优势证据"的标准证明裁断有关财产是否应被没收。我国应当借鉴外国的民事没收制度以及相关的成功经验,尽快建立针对犯罪所得或者违法行为收益的、独立的财产没收制度。  相似文献

The paper shows a comparative analysis of the law of the united states of america (US) and the european union (EU) focusing on the principle of mutual recognition, which has served as a basis in order to achieve the enforcement of judicial decisions by the authorities of the different Member States. It illustrates the origins and evolution of this principle within the US legal system, as well as its recent implementation within the European integration system with the aim of creating a common space of freedom, security and justice. The paper lists and analizes a substancial number of legal acts adopted so far in the area of civil and criminal law. Furthermore, it highlights the influence the case-law of the US Supreme Court and the Court of Justice of the EU has had on the development of this principle. Moreover, it elaborates on the function of this principle as a nation-building element, raising the question whether this concept could be possibly transposed to a regional integration system with clear federal traits such as the EU.  相似文献

中国互信外交,自春秋时期肇端伊始,已有近三千年的历史。在这段漫长的历史长河中,中国互信外交在不同的历史时期形成了不同的理念和范式。这些既具时代特色、又一脉相承的互信外交理念和范式,确保了中国互信外交实践的历史连续性,并对当代中国产生了重大影响。当代中国互信外交,在继承前人成果的基础上,结合时代特色,形成了追求"和平"与"和谐"的互信外交实践理念与相应的实践范式,有效地回应了国际社会存在的"中国威胁论"、"中国崩溃论"和"中国责任论"等论调,对我国顺利推进互信外交和坚定世界各国关于中国和平发展的信念起了巨大的推动作用。  相似文献

The work cooperative as a social institution offers us a radical alternative to transnational market-based workplaces. Models such as the Mondragon coop network in Spain tell us it is possible for people to have their work-life's cake and eat it too. 政治锦标赛体制是中国政府官员的一种压力性激励范式与不容选择的政治生态。行政发包并进行量化考核、绩效排名与择优提拔,是政治锦标赛体制的主要表现形式。但实地调查表明,基层政府官员晋升往往是前台与台后多重原因作用的结果。派系关系、政治背景、社会网络等后台因素往往能左右基层干部的晋升。文章以一个县级市的乡镇干部为观察对象,检验了官员激励分析范式———锦标赛体制在基层地方官员晋升竞争中的解释力,重点对地方官员晋升博弈研究提供一个初步的描述类型学,认为推选博弈、排名博弈与借势博弈是地方官员晋升博弈的三种基本类型。本文初步提出了一个地方官员晋升决定因素的剧场分析模型,并指出,在政治锦标赛体制下,民主集中制在未来地方官员的选拔、任用中的积极作用将日益凸显。  相似文献
